52This cause came before the Board of Directors of the Florida Housing Finance
65Corporation ("Board") for consideration and final agency action on June 21, 2019.
79Petitioners Durham Place, Ltd., ("Durham Place"), Amelia Court at Creative Village
92-Phase II Partners, Ltd. ("Amelia Court"), HTG Banyan, LLC ("Banyan") and Blue
108Pinellas, LLC ("Blue Pinellas"), and Intervenors Hawthorne Park, Ltd. ("Hawthorne
121Park"), HTG Heron Estates Family, LLC, ("Heron") and The Shores Apartments,
135Ltd. ("The Shores") were Applicants under Request for Applications 2018-112,
147Housing Credit Financing for Affordable Housing Developments Located in
156Broward, Duval, Hillsborough, Orange, Palm Beach, and Pinellas Counties (the
"166RF A"). Durham Place Developer, LLC was the developer entity for Durham Place,
180and Hawthorne Park Developer, LLC was the developer entity for Hawthorne Park.
192The matter for consideration before this Board is a Recommended Order issued
204pursuant to§§ 120.57(1) and (3), Fla. Stat. and the Exceptions to the Recommended
217Order.
218On February 1, 2019, Florida Housing Finance Corporation ("Florida
228Housing") posted notice of its intended decision to award funding to several
241applicants, including Hawthorne Park as the sole applicant funded from Orange
252County; HTG Heron Estates as the sole applicant funded from Palm Beach County;
265and The Shores Apartments as the sole applicant funded from Pinellas County. The
278Board found that all of the Petitioners and Intervenors satisfied all mandatory and
291eligibility requirements for funding, but awarded funding based upon the ranking
302criteria in the RF A. Petitioners timely filed their notices of intent to protest followed
317by formal written protests. Intervenors each filed a Notice of Appearance. The
329protests were referred to the Division of Administrative Hearings ("DOAH"). The
342challenges by Amelia Court and Durham Place were consolidated, and the
353challenges from Banyan and Heron were consolidated.
360Banyan and Heron
363Banyan alleged in its petition that Herons' application should have been
374deemed ineligible for failure to demonstrate a Local Government Contribution.
384During discovery prior to the hearing, Florida Housing concluded that Banyan'
395allegations were correct, and agreed that Heron should not have been recommended
407for funding.
409Berkeley Landing, Ltd was an applicant that was deemed eligible but not
421selected for funding. It filed a notice of intent to protest and formal written protest
436challenging the eligibility of Heron, but filed a Notice of Voluntary Dismissal on
449March 20, 2019. Berkeley Landing also stipulated that it should have been found
462ineligible for funding.
465On April 1, 2019, Banyan, Heron, and Florida Housing entered into a
477Stipulation for Dismissal in which Heron agreed to the designation of its own
490application as ineligible and waived any right to challenge that determination. As a
503result, Banyan that same day filed a Notice of Voluntary Dismissal with the
516Administrative Law Judge (ALJ). Copies of the Notice and Stipulation are attached
528as Exhibits A and B.
533Blue Pinellas and The Shores
538Blue Pinellas alleged in its petition that The Shores' application should have
550been denied points for proximity to a public school and a medical facility. During
564discovery prior to the hearing, Florida Housing concluded that Blue Pinellas'
575allegations were correct, and agreed that The Shores should not have been
587recommended for funding. As a result, Florida Housing filed a Notice of Change of
601Position with the ALJ.
605On April 12, 2019, Blue Pinellas, The Shores, and Florida Housing entered
617into a Stipulation for Dismissal in which The Shores agreed to the designation of its
632own application as ineligible and waived any right to challenge that determination.
644As a result, Blue Pinellas that same day filed a Notice of Voluntary Dismissal with
659the ALJ. A copy of the Notice and Stipulation is attached as Exhibit C.
673Amelia Court, Hawthorne Park, and Durham Place
680Hawthorne Park included with its application two forms intended to
690demonstrate that Orange County had committed to a Local Government
700Contribution sufficient to demonstrate that Hawthorne Park would qualify for the
711Local Government Area of Opportunity funding preference. Amelia Court alleged
721that this contribution should have been found ineligible because a circuit court judge
734had issued a temporary injunction preventing Orange County from providing the
745contribution from its intended funding source.
751Amelia Court included with its application one form intended to demonstrate
762that the City of Orlando had committed to a Local Government Contribution
774sufficient to demonstrate that Amelia Court would qualify for the Local Government
786Area of Opportunity funding preference. Durham Place alleged that this
796contribution should have been found ineligible because based on the identified
807source of the funding. Durham Park also alleged that Amelia Court had not properly
821disclosed the identities of all developers of the proposed development.
831IfHawthorne Park had been deemed ineligible, then Amelia Court would have
842been selected for funding instead. If both Hawthorne Park and Amelia Court been
855deemed ineligible, Durham Place would have been selected for funding.
865A hearing was conducted on April 15, 2019, before ALJ James B. Culpeper.
878All parties filed Proposed Recommended Orders. After consideration of the
888Proposed Recommended Orders, the oral and documentary evidence presented at
898hearing, and the entire record in the proceeding, the ALJ issued a Recommended
911Order on June 7, 2019. The Recommended Order upheld Florida Housing's initial
923determination and recommended that the petitions of Amelia Court and Durham
934Place be dismissed and that Hawthorne Park should be awarded funding. A copy of
948the Recommended Order is attached as Exhibit D.
956On June 12, 2019, Amelia Court filed six Exceptions to the Recommended
968Order. On June 17, Florida Housing and Hawthorne Park filed Responses to
980Exceptions. Copies of the Exceptions and Responses are attached as Exhibits E, F
993&G.
994RULING ON EXCEPTION #1
9981. Petitioner filed an Exception to Findings of Fact 33, 37 and 46. After
1012a review of the record, the Board finds that these Findings of Fact are supported by
1028competent substantial evidence, and the Board rejects Exception # 1.
1038RULING ON EXCEPTION #2
10422. Petitioner filed an Exception to Conclusions of Law 83, 84, 85 and 86.
1056After a review of the record, the Board finds that these Conclusions of Law are
1071supported by competent substantial evidence and reasonable interpretations of
1080applicable law, and the Board rejects Exception #2. The Board further affirms that
1093in regards to Conclusion of Law 83-86, the ALJ did not conclude that an Application
1108including an improperly completed Contribution Form could still be found eligible
1119because any problems could be addressed during Credit Underwriting.
1128RULING ON EXCEPTION #3
11323. Petitioner filed an Exception to Conclusions of Law 79 and 80. After
1145a review of the record, the Board finds that these Conclusions of Law are supported
1160by competent substantial evidence and reasonable interpretations of applicable law,
1170and the Board rejects Exception #3.

11804. Petitioner filed an Exception to Conclusions of Law 75 and 82. After
1193a review of the record, the Board finds that these Conclusions of Law are supported

1224RULING ON EXCEPTION #5
12285. Petitioner's fifth Exception challenges the ALJ' s ruling, though not
1239expressed in the Recommended Order, that Durham Place had standing to participate
1251in these proceedings as a party litigant. This issue was addressed in the ALJ' s Order
1267of April 11, 2019, in which Petitioner's Motions to Dismiss were denied.
1279§120.57(1)(1), Fla. State. (2018), provides that an agency may only reject or modify
1292Conclusions of Law over which the agency has substantive jurisdiction. As the
1304question of standing is a procedural issue not within Florida Housing's substantive
1316jurisdiction, the Board rejects Exception #5.

13266. Petitioner filed an Exception to Conclusions of Law 89 and 90. After
1339a review of the record, the Board finds that these Conclusions of Law are supported
