93Division of Administrative Hearings on July 16, 2019, for the

103entry of an order approving the resolution of a claim for

114compensation benefits filed in accordance with the provisions of

123chapter 766 and a resolution of the exclusive remedy otherwise

133available as outlined in chapter 766.

139By the terms of their Stipulation, Petitioners, Sherri

147Savage and Mario Cruz, individually and as parents of Mateo Cruz,

158and Respondent, the Florida Birth - Related Neurological Injury

167Compensation Association (ÐNICAÑ), have agree that Sherri Savage

175and Mario Cruz are the parents and legal guardians of Mateo Cruz

187(ÐMateoÑ), who is no w deceased; that Mateo was born a live infant

200on or about October 26, 2018, at AdventHealth Orlando (formerly

210known as Florida Hospital Orlando), a ÐhospitalÑ as defined by

220section 766.302(6) located in Orlando, Florida; and that MateoÓs

229birth weight excee ded 2,500 grams. The parties further agree

240that Scott Boone, M.D., provided obstetrical services at MateoÓs

249delivery and was a Ðparticipating physicianÑ in the Florida

258Birth - Related Neurological Injury Compensation Plan, as defined

267by section 766.302(7). The parties agree that Mateo suffered a

277Ðbirth - related neurological injury,Ñ as that term is defined by

289section 766.302(2), which was the sole and proximate cause of

299MateoÓs death.

301It is ORDERED:

3041. The Stipulation filed on July 16, 2019, is hereby

314app roved, and the parties are directed to comply with the

325provisions of the Stipulation.

3292. Petitioners, Sherri Savage and Mario Cruz , as the

338parents and legal guardians of Mateo (deceased), are awarded one

348hundred thousand dollars ($100,000.00), pursuant to section

356766.31(1)(b)1., to be paid as a lump sum;

3643. Petitioners, Sherri Savage and Mario Cruz, as the parents

374and legal guardians of Mateo (deceased), are awarded a death

384benefit in the amount of ten thousand dollars ($10,000.00), to be

396paid as a lump s um;

4023. NICA will reimburse the McMillen Law Firm, legal counsel

412for Petitioners, agreed - upon attorneyÓs fees of $10,000.00 and

423expenses of $397.48, totaling $10,397.48, in full, for services

433rendered in the filing of this claim.

4404. Upon NICAÓs payment of the award of $100,000.00, a death

452benefit of $10,000, as well as $10,397.48 for attorneyÓs fees and

465costs, PetitionersÓ claims shall be deemed fully satisfied and

474extinguished.

4755. The Division of Administrative Hearings retains

482jurisdiction over this mat ter to resolve any disputes, should

492they arise, regarding the partiesÓ compliance with the terms of

502this Order.
