161By the terms of their stipulation, Petitioner s , Heather

170McClain and Yves - Marie Noel, as parent s and natural guardian s of

184Alexandria Noel , a minor, and Respondent, the Florida Birth -

194Related Neurological Injury Compensation Association (NICA), have

201agreed that Heather McClain and Yves - Marie Noel are the parent s

214and legal guardian s of Alexandria Noel ( Alexandria ), a minor;

226that Alexandria was born a live infant on or about February 28,

2382015 , a t Winnie Palmer Hospital for Women and Babies , a

249Ðhospital , Ñ as defined by section 766.302(6) , located in Orlando ,

259Florida; and that AlexandriaÓs birth weight exceeded 2,500 grams.

269The p arties have further agreed that April Merrit , M.D., provided

280obstetri cal services at AlexandriaÓs delivery and was a

289Ðparticipating physicianÑ in the Florida Birth - Related

297Neurological Injury Compensation Plan, as defined by section

305766.302(7). The p arties have agreed that Alexandria suffered a

315Ðbirth - related neurological injury,Ñ as that term is defined by

327section 766.302(2), which was the sole and proximate cause of

337Alexandria 's current medical condition.

342It is ORDERED:

3451. The Stipulation and Joint Petition filed on July 19,

3552019 , is hereby approved, and the p arties are directed to comply

367with the provisions of the Stipulation and Joint Petition.

3762. Petitioner s , Heather McClain and Yves - Marie Noel , as the

388parent s and legal guardian s of Alexandria , a minor, are awarded

400one hundred thousand dollars ($100,000.00), pursuant to

408section 766.31(1)(b)1., to be paid as a lump sum to the parent s ;

421payment of benefits up to and including the effective date of the

433Stipulation and Joint Petition pursuant to section 766.31(1)(a),

441subject to the provisions of paragraph 19 of the Stipula tion and

453Joint Petition; and payments of future expenses, as incurred.

4623. NICA will reimburse McMillen Law Firm , P.A., attorney s

472for Petitioner s , an agreed - upon attorneyÓs fee of $ 10,000.00 and

486expenses of $ 23.95 , totaling $ 10,023.95 in full , for services

498rendered in the filing of this claim.

5054. Upon the payment of the award of $100,000.00, past

516benefit/expenses, and $ 10,023.95 for attorneyÓs fees and costs,

526the claims of Petitioner s shall be deemed fully satisfied and

537extinguished, except for Respondent' s continuing obligation under

545section 766.31(2) to pay future expenses, as incurred.

5535. The Division of Administrative Hearings retains

560jurisdiction over this matter to resolve any disputes, should they
