94the Florida Birth - Related Neurological Injury Compensation

102Association (NICA), and Intervenor , Orlando Health, Inc., d/b/a

110Winnie Palmer Hospital (Winnie Palmer Hospital) seek entry of an

120order approving the resolution of the claim for benefits filed

130in accordance with the provisions of chapter 766, Florida

139Statutes.

140PRELIMINARY STATEMENT

142On Augus t 2, 2019, the estate of Asmi Gajera (Asmi), by and

155through Heli Patel and Ishan Gashera, filed a Petition for

165Determination of NICA Compensability (Petition), seeking

171benefits from NICA, for injuries related to Asmi’s birth. The

181Petition identified Dr. T errence Carter, M.D., as the physician

191providing obstetrical services, and Winnie Palmer Hospital as

199the hospital where Asmi was born.

205The Petition was served by certified mail to NICA,

214Dr. Carter, and Winnie Palmer Hospital on August 19, 2019. On

225August 29, 2019, Winnie Palmer Hospital moved to intervene, and

235on August 30, 2019, NICA filed a Motion to Act as Qualified

247Representative. Both motions were granted.

252On October 8, 2019, NICA filed a Response to Petition for

263Benefits, notifying Petitioner that it had determined the claim

272to be compensable, and was prepared to provide benefits as

282authorized by section 766.31.

286On October 17, 2019, an Order Requiring Status Report was

296issued, directing the parties to file a s tatus r eport no later

309than November 8, 2019, advising whether a hearing on the

319Petition would be necessary. When no response was filed, on

329January 6, 2020, an Order to Show Cause was issued. That same

341date, the Stipulation and Joint Petition was filed.

349FINDINGS OF FACT

352Based upon Petitio ners and Respondent’s stipulation, the

360following facts are found:

3641. Heli Patel and Ishan Gajera (Petitioners) are the

373pare nts and legal guardians of Asmi , and are the “claimants” as

385defined by section 766.302(3).

3892. Asmi incurred a “birth - related neurol ogical injury”

399(the injury) as that term is defined in section 766.302(2), on

410or about November 27, 2018, which was the sole and proximate

421cause of Asmi’s death.

4253. At birth, Asmi weighed 3,400 grams.

4334. Terrance Carter, M.D., rendered obstetrical servic es in

442Asmi’s delivery and, at all material times, was a “participating

452physician” as defined in section 766.302(7).

4585. Asmi was born at Winner Palmer Hospital, which is a

469hospital located in Orlando, Florida, and is the “hospital” as

479that term is defined in section 766.302(6).

4866. Asmi died on December 1, 2018.

4937. Petitioners filed a petition pursuant to section

501766.305, seeking compensation from NICA, and that Petition is

510incorporated by reference in its entirety, including all

518attachments. Any referenc e made within this document to NICA

528encompasses, where appropriate, the Florida Birth - Related

536Neurological Injury Compensation Plan (the Plan).

542CONCLUSIONS OF LAW

5458. The Division of Administrative Hearings has

552jurisdiction over the subject matter and the parties to this

562proceeding pursuant to section 766.301.

5679. Section 766.305(7) requires the presiding

573administrative law judge to approve the settlement of any claim

583where NICA determines that the injury is compensable.

591CONCLUSION

592Based upon the Findings o f Fact and Conclusions of Law, it

604is

605ORDERED:

6061. The Stipulation and Joint Petition filed January 7,

6152020, is approved, and the parties are directed to comply with

626the provisions of the Stipulation and Joint Petition.

6342. Petitioners, Heli Patel and I shan Gajera, as parents

644and natural guardians of Asmi Gajera, are awarded one hundred

654thousand dollars ($100,000.00), to be paid in a lump sum,

665pursuant to section 766.31(1)(b)1., and a ten thousand dollar

674($10,000.00) death benefit authorized by section 7 66.31(1)(b)2.

683Petitioners are also awarded payment of benefits for past

692expenses as authorized by section 766.31(1)(a), subject to the

701provisions of paragraph 20 of the Petition and Joint

710Stipulation.

7113. NICA will reimburse Richard Bates, Esquire, attor ney

720for Petitioners, an agreed - upon attorney’s fee of Twelve

730Thousand Five Hundred Dollars ($12,500.00) and expenses of Four

740Thousand Eight Hundred Twenty - Six Dollars and Seventy - Eight

751Cents ($4,826.78), totaling in full Seventeen Thousand Three

760Hundred Tw enty - Six Dollars and Seventy - Eight Cents ($17,326.78),

773for services rendered in this proceeding.

7794. Upon payment of the award of $100,000, the death

790benefit of $10,000, benefits/expenses as outlined in paragraph

79920 of the Joint Petition and Stipulation, and payment of the

810attorney’s fees and costs awarded to Petitioners’ counsel,

818Petitioners’ claims shall be deemed fully satisfied and

826extinguished.

8275. The Division of Administrative Hearings retains

834jurisdiction over this matter to resolve any disputes, should

843they arise, regarding the parties’ compliance with the terms of

853this Order.
