48On December 13, 2019, Respondent, Florida Birth - Related

57Neurological Injury Compensation Association (NICA), filed a

64Motion for Summary Final Order (Motion) , which is due for

74consideration. Petitioner filed a Resp onse and Notice of No

84Objection to Respondent’s Motion for Summary Final Order.

92STATEMENT OF THE ISSUE

96The issue to be determined is whether the infant, Adrian

106Olmstead (Adrian), suffered a birth - related neurological injury

115as that term is defined by section 766.302, Florida Statutes

125(2018).

126PRELIMINARY STATEMENT

128On October 15, 2019, Christopher Olmstead and Heenesys

136Tamayo, individually and as parents and natural guardians of

145Adrian Olmste ad (Petitioners), filed a Petition under Protest

154for Benefits Pursuant to Florida Statute Section 766.301 et seq

164(Petition) . In the Petition, Petitioners acknowledge that the

173child does not meet the weight requirements for eligibility, but

183are filing the Petition in an abundance of caution, should it be

195a necessary precondition to a medical negligence proceeding.

203The Petition identifies Dr. John Vann Parker and Dr. Nateya

213Carrington as providing obstetrical services, with

219Dr. Carrington present at Adrian’s birth. AdventHealth

226Altamonte Springs, f/k/a Florida Hospital Altamonte

232(AdventHealth Altamonte Springs) , is identified as the hospital

240where Adrian was born.

244The Petition was provided by certified mail to NICA,

253AdventHealth Altamonte Springs, and Drs. P arker and Carrington.

262Certified return receipts indicated that they were properly

270served. On December 13, 2019, NICA filed the Motion, and

280Petitioners responded, stating they had no objection to the

289Motion.

290The Motion had a document attached to it that a ppears to be

303a discharge summary from a hospital, but does not identify the

314facility from which it was generated. On January 6, 2020, an

325Order Requiring Response was issued, advising NICA that without

334some supplementation, there was no competent evidence upon which

343findings could be made for a s ummary f inal o rder. That same

357day, NICA supplemented the record with a certified copy of the

368child’s birth certificate.

371All references to Florida Statutes are to the 2018

380codification.

381FINDINGS OF FACT

3841. On Novem ber 28, 2018, Heenesys Tamayo gave birth to a

396baby boy, Adrian Olmstead, at AdventHealth Altamonte Springs.

4042. Adrian’s birth certificate indicates that he weighed

412five pounds, six ounces at birth, which equates to approximately

4222,440 grams.

425CONCLUSIONS OF LAW

4283. The Division of Administrative Hearings (DOAH) has

436jurisdiction over the parties and the subject matter of this

446proceeding pursuant to sections 120.569, 120.57(1), and 766.304,

454Florida Statutes.

4564. The Florida Birth - Related Neurological Injury

464Compensation Plan (Plan) was established by the Legislature “for

473the purpose of providing compensation, irrespective of fault,

481for birth - related neurological injury claims” related to births

491occurring on or after January 1, 1989. § 766.303(1), Fla. Stat.

5025. An injured infant, his or her personal representative,

511parents, dependents, and next of kin may seek compensation under

521the Plan by filing a claim for compensation with DOAH.

531§§ 766.302(3), 766.303(2), and 766.305(1), Fla. Stat. Section

539766.305(4) p rovides that NICA, which administers the Plan, has

54945 days from the date that a complete claim is served to file a

563response to the petition and to submit relevant information

572regarding whether the injury suffered is a birth - related

582neurological injury comp ensable under the Plan.

5896. If NICA determines that the alleged injury is a birth -

601related neurological injury that is compensable under the Plan,

610it may award compensation to the claimant, provided that the

620award is approved by an administrative law judge. § 766.305(7),

630Fla. Stat. If NICA disputes the claim, as it does in this case,

643the dispute must be resolved by the assigned administrative law

653judge in accordance with chapter 120. §§ 766.304, 766.30, and

663766.31, Fla. Stat.

6667. Whether an infant has sus tained a birth - related

677neurological injury is determined in accordance with the

685definition in section 766.302(2), which states:

691(2) “Birth - related neurological injury”

697means injury to the brain or spinal cord of

706a live infant weighing at least 2,500 grams

715for a single gestation or, in the case of a

725multiple gestation, a live infant weighing

731at least 2,000 grams at birth caused by

740oxygen deprivation or mechanical injury

745occurring in the course of labor, delivery,

752or resuscitation in the immediate

757postdelive ry period in a hospital, which

764renders the infant permanently and

769substantially mentally and physically

773impaired. This definition shall apply to

779live births only and shall not include

786disability or death caused by genetic or

793congenital abnormality.

7958. If the administrative law judge determines that the

804infant meets the statutory weight threshold and has sustained a

814brain or spinal cord injury caused by oxygen deprivation or

824mechanical injury, and finds that as a result of the injury the

836infant was ren dered permanently and substantially mentally and

845physically impaired, then section 766.309(1) provides that there

853is a rebuttable presumption that the injury is a birth - related

865neurological injury.

8679. In this case, the evidence presented does not support

877such a finding. The undisputed evidence is that Adrian weighed

887approximately 2,440 grams at birth, which is below the threshold

898weight required by the definition in section 766.302(2). This

907issue is dispositive with respect to compensability. Based on

916this finding, Adrian did not sustain a birth - related neurological

927injury as defined in section 766.302(2), and is not eligible for

938benefits under the Plan.

942CONCLUSION

943Based upon the Findings of Fact and Conclusions of Law,

953NICA’s Motion for Summary Final O rder is granted, and

963Petitioners’ claim is found to be not compensable. Accordingly,

972Petitioners’ Petition is dismissed with prejudice.

978DONE AND ORDERED this 2 4th day of January , 2020 , in
