52On January 2, 2020, Respondent, Florida Birth - Related

61Neurological Injury Compensation Association (NICA), filed a

68Motion for Summary Final Order , whic h is due for consideration.

79The Motion for Summary Final Order relies upon medical records

89from Holmes Regional Medical Center (Holmes Regional). To date,

98no response to the Motion for Summary Final Order has been

109filed.

110STATEMENT OF THE ISSUE

114The issue to be determined is whether the infant, Zakeem

124Carter Lee (Zakeem), suffered a birth - related neurological

133injury as that term is defined in section 766.302(2), Florida

143Statutes (2018).

145PRELIMINARY STATEMENT

147On September 30, 2019, Petitioners, Latoya Wright and Aaron

156Lee, on behalf of and as parents and natural guardians of

167Zakeem, filed a Petition for Benefits Pursuant to Florida

176Statutes 766.301 et seq. (Petition). The Petition was

184incomplete, and Petitioner refiled the Petition with the

192necessary documen ts on November 5, 2019.

199The Petition identifies Anette Ferrell, CNM, as the person

208providing obstetrical services at the birth of the child. The

218hospital is identified as Holmes Regional. On November 15,

2272019, NICA, Ms. Ferrell, and Holmes Regional wer e served with

238the Petition by certified mail, and certified mail receipts were

248received indicating that both NICA and Ms. Ferrell were served.

258On January 2, 2019, NICA moved for Summary Final Order,

268based on the birth weight of the infant. Although Flor ida

279Administrative Code Rule 28 - 106.204 allows for seven days in

290which to file a response to any motion, to date, Petitioners

301have not filed a response to the Motion.

309FINDINGS OF FACT

3121. Zakeem was born on December 25, 2018, at Holmes

322Regional. He passed away shortly after birth.

3292. Zakeem weighed 2,425 grams at birth.

337CONCLUSIONS OF LAW

3403. The Division of Administrative Hearings (DOAH) has

348jurisdiction over the parties and the subject matter of this

358proceeding pursuant to sections 120.569, 120.57(1), and 766.304,

366Florida Statutes.

3684. The Florida Birth - Related Neurological Injury

376Compensation Plan (Plan) was established by the Legislature “for

385the purpose of providing compensation, irrespective of fault,

393for birth - related neurological injury claims” r elated to births

404occurring on or after January 1, 1989. § 766.303(1), Fla. Stat.

4155. An injured infant, his or her personal representative,

424parents, dependents, and next of kin may seek compensation under

434the Plan by filing a claim for compensation with D OAH.

445§§ 766.302(3), 766.303(2), and 766.305(1), Fla. Stat. Section

453766.305(4) provides that NICA, which administers the Plan, has

46245 days from the date that a complete claim is served to file a

476response to the petition and to submit relevant information

485regarding whether the injury suffered is a birth - related

495neurological injury compensable under the Plan.

5016. If NICA determines that the alleged injury is a birth -

513related neurological injury that is compensable under the Plan,

522it may award compensation to the claimant, provided that the

532award is approved by an administrative law judge. § 766.305(7),

542Fla. Stat. If NICA disputes the claim, as it does in this case,

555the dispute must be resolved by the assigned administrative law

565judge in accordance with chapt er 120. §§ 766.304, 766.30, and

576766.31, Fla. Stat.

5797. Whether an infant has sustained a birth - related

589neurological injury is determined in accordance with the

597definition in section 766.302(2), which states:

603(2) “Birth - related neurological injury”

609means injury to the brain or spinal cord of

618a live infant weighing at least 2,500 grams

627for a single gestation or, in the case of a

637multiple gestation, a live infant weighing

643at least 2,000 grams at birth caused by

652oxygen deprivation or mechanical injury

657occurri ng in the course of labor, delivery,

665or resuscitation in the immediate

670postdelivery period in a hospital, which

676renders the infant permanently and

681substantially mentally and physically

685impaired. This definition shall apply to

691live births only and shall no t include

699disability or death caused by genetic or

706congenital abnormality.

7088. If the administrative law judge determines that the

717infant meets the statutory weight threshold and has sustained a

727brain or spinal cord injury caused by oxygen deprivation or

737mechanical injury, and finds that as a result of the injury the

749infant was rendered permanently and substantially mentally and

757physically impaired, then section 766.309(1) provides that there

765is a rebuttable presumption that the injury is a birth - relate d

778neurological injury.

7809. In this case, the evidence presented does not support

790such a finding. The undisputed evidence is that Zakeem weighed

8002,425 grams at birth, which is below the threshold weight

811required by the definition in section 766.302(2). T his issue is

822dispositive with respect to compensability. Based on this

830finding, Zakeem did not sustain a birth - related neurological

840injury as defined in section 766.302(2), and is not eligible for

851benefits under the Plan.

855CONCLUSION

856Based upon the Finding s of Fact and Conclusions of Law,

867NICA’s Motion for Summary Final Order is granted, and

876Petitioners’ claim is found to be not compensable. Accordingly,

885Petitioners’ Petition is dismissed with prejudice.
