88September 16, 2019.

91STATEMENT OF THE CASE

95On December 3, 2018, Petitioner, Yusleidis Soto, as parent

104and natural guardian of Suleidis Lopez Soto (“Suleidis”), a minor,

114filed a Petition for Benefits Pursuant to Florida Statute Section

124the Florida Birth - Related Neurolog ical Injury Compensation Plan

134( the “Plan”).

137Petitioner identified Cielo Gnecco, M.D. , as the physician

145who provided obstetric al services at Suleidis’s birth on May 27,

1562017, at Orlando Health, Inc., d/b/a Winnie Palmer Hospital

165(“Winnie P a lmer”) , in Orlando, Florida.

172DOAH served Dr. Gnecco with a copy of the Petition on

183January 24, 2019, and served Winnie Palmer that same date. NICA

194was also served with a copy of the Petition on January 24, 2019.

207A Petition for Leave to Intervene was sub sequently filed on

218behalf of Eliza G. Bruscato, M.D., and Maria J. Kuffskie, M.D., on

230February 28, 2019, which was granted. The Petition to Intervene

240alleged that Dr. Bruscato and Dr. Kuffskie provided the

249obstetrical services to Suleidis at her birth.

256On September 16, 2019, NICA filed a Motion for Summary Final

267Order, requesting the administrative law judge enter an order

276finding that the claim was not compensable because Suleidis did

286not suffer a “birth - related neurological injury” as defined in

297sec tio n 766.302(2).

301On September 23, 2019, the undersigned issued an Order to

311Show Cause as to why NICA’s motion should not be granted. As of

324the date of this Summary Final Order of Dismissal, Petitioner has

335not responded to either the Order to Show Cause or NI CA’s motion.

348FINDINGS OF FACT

3511. Suleidis was born on May 27, 2017, at Winnie Palmer

362located in Orlando, Florida.

3662. Upon receiving a copy of the Petition, NICA retained

376Donald Willis, M.D., a board - certified obstetrician/gynecologist

384specializing in mat ernal - fetal medicine, as well as Michael S.

396Duchowny, M.D., a pediatric neurologist, to review Suleidis’s

404medical condition. NICA sought to determine whether Suleidis

412suffered a “birth - related neurological injury” as defined in

422section 766.302(2).

4243. S pecifically, NICA requested its medical experts opine

433whether Suleidis experienced an injury to the brain or spinal

443cord caused by oxygen deprivation or mechanical injury which

452occurred in the course of labor, delivery, or resuscitation in

462the immediate po stdelivery period; and, if so, whether this

472injury rendered Suleidis permanently and substantially mentally

479and physically impaired.

4824. Dr. Willis reviewed Suleidis’s medical records and

490described her birth as follows:

495In summary, a reported monochorionic ,

500diamniotic (identical twin) had a demise of

507one fetus at 31 weeks, followed by vaginal

515delivery of the surviving twin 4 weeks later.

523The baby was not depressed at birth.

530Umbilical cord blood pH was 7.3. Newborn

537hospital course was uncomplicated. Alth ough

543the birth weight was just under 2,500, this

552was a twin pregnancy.

556Dr. Willis also noted that the baby was vigorous at birth, and no

569resuscitation was required.

5725. Dr. Willis then opined, within a reasonable degree of

582medical probability, that:

585T here was no apparent obstetrical event that

593resulted in oxygen deprivation or mechanical

599trauma to the brain or spinal cord during

607labor, delivery or the immediate post -

614delivery period.

6166. Dr. Duchowny also reviewed Suleidis’s medical records,

624as well as personally examined Suleidis on August 27, 2019.

634Dr. Duchowny observed that:

638Suleidis’s neurological evaluation is

642consistent with substantial mental and motor

648impairment. She has spastic quadriplegic

653(double hemiparetic) cerebral palsy, oromotor

658incoor dination, alternating esotropia,

662microcephaly, absence of receptive and

667expressive communication, and multiple

671pathologic reflexes. Her developmenta l level

677approximates that of a 2 - 3 - month - old infant.

689Review of the medical records reveals that

696Suleidis w as born vaginally at Winnie Palmer

704Hospital at 36 weeks’ gestation via

710spontaneous vaginal delivery. Apart from

715fetal demise of Twin B at [31] weeks’

723gestation, the pregnancy was further

728complicated by maternal sickle cell trait and

735chorioamnionitis (mate rnal temp = 100.8 F.)

742Rupture of the membranes 8 hours before

749delivery yielded thick meconium - stained

755fluid. Suleidis weighed 2480 grams (5 pounds

7627 oz.) and had Apgar scores of 8 and 9 at 1

774and 5 minutes. An arterial cord gas was

7827.30. Her neonatal co urse was unremarkable

789with normal voiding, stooling and breast -

796feeding.

7977. Following his independent medical examination,

803Dr. Duchowny diagnosed Suleidis with cerebral palsy. He further

812opined, within a reasonable degree of medical probability, that

821Sul eidis’s “neurological impairments are permanent and

828substantial.” However, he concluded that her injuries “were

836acquired in utero and did not result from intrapartum oxygen

846deprivation or mechanical injury.” Therefore, he did not

854recommend that Suleidis be included in the NICA Plan.

8638. A review of the records filed in this matter reveals no

875contrary evidence to dispute the findings and opinions of

884Dr. Willis and Dr. Duchowny. Their opinions are credible and

894persuasive.

8959. Based on the conclusions of Dr . Willis and Dr. Duchowny,

907NICA determined that Petitioner’s claim is not compensable. NICA

916subsequently filed the Motion for Summary Final Order asserting

925that Suleidis has not suffered a “birth - related neurological

935injury” as defined by section 766.302( 2). Petitioner has not

945filed a response to NICA’s motion.

951CONCLUSIONS OF LAW

95410. The undersigned, as an administrative law judge, has

963exclusive jurisdiction over the subject matter of this proceeding.

972§ 766.304, Fla. Stat.

97611. The Florida Legislat ure established the Plan “for the

986purpose of providing compensation, irrespective of fault, for

994birth - related neurological injury claims” relating to births

1003occurring on or after January 1, 1989. § 766.303(1), Fla. Stat.

101412. The injured infant, her or hi s personal representative,

1024parents, dependents, and next of kin may seek compensation under

1034the Plan by filing a claim for compensation with DOAH.

1044§§ 766.302(3), 766.303(2), and 766.305(1), Fla. Stat. NICA, which

1053administers the Plan, then has “45 days f rom the date of service

1066of a complete claim . . . in which to file a response to the

1081petition and to submit relevant written information relating to

1090the issue of whether the injury is a birth - related neurological

1102injury.” § 766.305(4), Fla. Stat.

110713. If NICA determines that the injury alleged in a claim

1118is a compensable birth - related neurological injury, it may award

1129compensation to the claimant, provided that the award is approved

1139by the administrative law judge to whom the claim has been

1150assigned. § 76 6.305(7), Fla. Stat.

115614. In this matter, however, NICA determined that

1164Petitioner’s claim is not compensable under the Plan. Therefore,

1173NICA filed a Motion for Summary Final Order requesting entry of

1184such a ruling.

118715. In considering NICA’s motion, section 766.309(1)

1194provides that the administrative law judge must make the following

1204determination based upon the available evidence:

1210(a) Whether the injury claimed is a birth -

1219related neurological injury. If the claimant

1225has demonstrated, to the satis faction of the

1233administrative law judge, that the infant has

1240sustained a brain or spinal cord injury caused

1248by oxygen deprivation or mechanical injury and

1255that the infant was thereby rendered

1261permanently and substantially mentally and

1266physically impaired, a rebuttable presumption

1271shall arise that the injury is a birth - related

1281neurological injury as defined in

1286s. 766.302(2).

128816. The term “birth - related neurological injury” is defined

1298in section 766.302(2) as follows:

1303“Birth - related neurological injury” me ans

1310injury to the brain or spinal cord of a live

1320infant weighing at least 2,500 grams for a

1329single gestation or, in the case of a multiple

1338gestation, a live infant weighing at least

13452,000 grams at birth caused by oxygen

1353deprivation or mechanical injury occ urring in

1360the course of labor, delivery, or

1366resuscitation in the immediate postdelivery

1371period in a hospital, which renders the infant

1379permanently and substantially mentally and

1384physically impaired. This definition shall

1389apply to live births only and shal l not

1398include disability or death caused by genetic

1405or congenital abnormality.

140817. “ The [NICA] Statute is written in the conjunctive and

1419can only be interpreted to require permanent and substantial

1428impairment that has both physical and mental elements.” Fla.

1437Birth - Related Neurological Injury Comp. Ass ’n v. Fla. Div. of

1449Admin. H earing s , 686 So. 2d 1349, 1356 (Fla. 1997).

146018. The undisputed evidence establishes that Suleidis did

1468not sustain a “birth - related neurological injury” as defined in

1479section 766.3 02(2). Both Dr. Willis and Dr. Duchowny conclude

1489that Suleidis’s injury did not occur during labor, delivery, or

1499resuscitation in the immediate postdelivery period. Dr. Duchowny

1507did find that Suleidis suffers from a permanent and substantial

1517motor and ne urological impairment. However, he determined that

1526Suleidis’s medical condition occurred prior to her birth and not

1536during the period of time that would entitle Suleidis to

1546participate in the NICA Plan. Therefore, based on all the

1556evidence in the record, Suleidis has not suffered a “birth - related

1568neurological injury” and is not eligible for NICA benefits.

1577DISPOSITION

1578Based upon the foregoing Findings of Fact and Conclusions of

1588Law, it is ORDERED that the Petition is dismissed, with prejudice.
