175S TATEMENT OF T HE C ASE
182On February 7, 2020, Petitioners filed an ÑAmended Petition Filed Under
193Protest for Determination as to the Applicability of Florida Birth - Related
205Neurolo gical Injury Compensation PlanÒ (Amended Petition) at the Division
215of Administrative Hearings (DOAH). The Amended Petition named Alison T.
225Clarke DeSouza, M.D., as the physician who provided obstetric services at
236the birth of Rhea LaTouche (Rhea) on August 18, 2017, at Coral Springs
249Medical Center, in Coral Springs, Florida.
255The Amended Petition alleges that Dr. DeSouza was a participant in the
267Florida Birth - Related Neurological Injury Compensation Association Plan
276(the Plan), and provided timely notice to Petitioners of her participation in
288the Plan. The Amended Petition further alleges that Coral Springs Medical
299Center, a hospital, while also a NICA participant, did not timely provide
311notice of its participation in the Plan.
318DOAH served Respondent with a copy of the Amended Petition on or
330before February 19, 2020. On February 18, 2020, DOAH mailed a copy of the
344Amended Petition by certified mail to Dr. DeSouza and Coral Springs
355Medical Center.
357On March 10, 2020, North Broward Hospital District d/b/a Bro ward
368Health Coral Springs a/k/a Coral Springs Medical CenterÔs (BHCS) Petition
378for Leave to Intervene was granted; and, on Ma y 11, 2020, Alison T. Clarke
393DeS ouza, M.D. and Alison T. Clarke De S ouza, M.D., LLCÔs Motion for Leave
408to Intervene was granted.
412O n March 10, 2020, Petitioners filed a ÑMotion for Partial Summary
424Judgement as to NICA Notice.Ò After an extension of time was granted, on
437April 27, 2020, BHCS filed its response to said motion. On May 11, 2020,
451PetitionersÔ motion was denied as material f acts remained in dispute
462concerning the notice issue.
466On June 11, 2020, Pedro Moscoso, M.D. and Pediatrix Medical Group of
478Florida, Inc. , filed a Motion for Leave to Intervene. PetitionersÔ response in
490opposition was filed June 15, 2020. The motion to int ervene was granted on
504June 29, 2020.
507On June 17, 2020, RespondentÔs Motion was filed wherein Respondent
517contends that Rhea sustained a birth - related neurological injury and
528requests the undersigned enter a summary final order concluding that
538PetitionersÔ claim is compensable. On July 2, 2020, the undersigned issued an
550Order to Show Cause, whereby Petitioners were ordered to show cause in
562writing why RespondentÔs Motion should not be granted.
570On June 17, 2020, Petitioners filed their response to Responde ntÔs Motion.
582Said response provides , in pertinent part , as follows:
590Petitioners do not oppose NICAÔs Motion for
597Summary Final Order. Petitioners do not dispute
604that RHEA LATOUCHE sustained a severe
610hypoxic ischemic injury resulting in substantial
616mental and physical impairments that are
622permanent. Petitioners do not dispute that the
629injuries are felt to be birth related.
636WHEREFORE, Petitioners do not oppose the entry
643of a Summary Final Order determining that the
651claim is compensable under the NICA plan a s a
661matter of law and reserving a determination of the
670applicability of NICA based on the evidentiary
677hearing on notice , which is to be set for the last
688week of August. PetitionersÔ position is that BHCS
696failed to give timely notice.
701F INDINGS OF F ACT
7061. R hea was born a live infant on August 18, 2017, at BHCS , located in
722Coral Springs, Florida.
7252. At the time of birth, Rhea weighed at least 2500 grams.
7373. BHCS is a Ñhospital,Ò as defined by section 766.302(6), Florida Statutes.
7504. Obstetrical services we re delivered by Alison T. Clarke DeSouza, M.D.,
762in the course of the subject labor, delivery, or resuscitation in the immediate
775post - delivery period in a hospital ; BHCS .
7845. At the time of RheaÔs birth, Dr. DeSouza was a Ñparticipating
796physician,Ò as defin ed in section 766.302(7).
8046. Dr. DeSouza satisfied the notice requirements of section 766.316.
8147. Donald Willis, M.D., an obstetrician specializing in maternal - fetal
825medicine, was retained by Respondent to review the medical records for Rhea
837and her moth er. In his affidavit dated June 16, 2020, Dr. Willis opines to a
853reasonable degree of medical probability, as follows:
860There was an apparent obstetrical event that
867resulted in oxygen deprivation to the brain during
875labor, delivery and continuing into the immediate
882post - delivery period. The oxygen deprivation
889resulted in brain injury.
8938. Respondent further retained Luis E. Bello - Espinosa, M.D., a pediatric
905neurologist. Dr. Bello - Espinosa was retained to review the available medical
917records and conduct an examination of Rhea to determine whether she
928suffers from an injury which rendered her permanently and substantially
938mentally and physically impaired ; and whether such injury is consistent with
949an injury caused by oxygen deprivation or mechanical injury o ccurring during
961the course of labor, delivery, or the immediate post - delivery period in the
975hospital.
9769. Dr. Bello - Espinosa conducted the examination on June 12, 2020. In his
990affidavit dated June 16, 2020, he opines to a reasonable degree of medical
1003proba bility, in pertinent part, as follows:
1010In summary, Rhea is a 34 - month old girl with a
1022history of severe hypoxic - ischemic encephalopathy
1029of birth. She was documented in the NICU to have
1039acute refractory electroclinical and electrographic
1044seizures, as well as MRI of the brain which were all
1055indicative of a neonatal hypoxic - ischemic injury. On
1064her examination, today is evident Rhea has severe
1072neurological sequela. At 34 - months of age, she has
1082marked delayed acquisition of language and motor
1089skills with salie nt signs on her neurological
1097examination. She has mild axial hypotonia,
1103moderate hypertonia in her left arm and both legs,
1112including sustained dystonic posturing of her left
1119hand, extensor posturing of her feet, and inability
1127to walk, all of which are sign s indicative of
1137combined athetoid spastic triplegic cerebral palsy.
1143Rhea is found to have substantial mental and
1151physical impairments at this time.
1156RheaÔs mental and physical impairments are
1162permanent.
1163In reviewing all of the available documents, the
1171evolution of her symptoms, the acute brain MRI
1179changes, her acute neonatal electroclinical seizures,
1185it is evident that she had an acute hypoxic event
1195perinatally. The injury is felt to be acquired due to
1205oxygen deprivation of the brain. The injuries are
1213felt to be birth - related.
1219In summary, it is felt that the permanent and
1228substantial mental and physical impairments
1233accrued during the perinatal period of labor and
1241delivery.
124210. The undisputed opinions of Dr. Willis and Dr. Bello - Espinosa are
1255credited . Based on their opinions, the undersigned finds that Rhea sustained
1267an injury to the brain caused by oxygen deprivation occurring in the course of
1281labor, delivery, or resuscitation in the immediate post - delivery period in a
1294hospital, which rendered Rhea p ermanently and substantially mentally and
1304physically impaired.
1306C ONCLUSIONS OF L AW
131111. DOAH has jurisdiction over the parties to and the subjec t matter of
1325these proceedings. §§ 766.301 - 766.316, Fla. Stat.
133312. The Plan was established by the Legislature Ñ fo r the purpose of
1347providing compensation, irrespective of fault, for birth - related neurological
1357injury claims Ò relating to births occurring on or after January 1, 1989.
1370§ 766.303(1), Fla. Stat.
137413. The injured infant, her or his personal representative, p arents,
1385dependents, and next of kin may seek compensation under the Plan by
1397filing a claim for compensation with DOAH. §§ 766.302(3), 766.303(2),
1407and 766.305(1), Fla. Stat. Respondent, which administers the Plan, has Ñ 45
1419days from the date of service of a complete claim . . . in which to file a
1437response to the petition and to submit relevant written information relating
1448to the issue of whether the injury is a birth - related neurological injury. Ò
1463§ 766.305(4), Fla. Stat.
146714. If Respondent determines that the injury alleged is a claim that is a
1481compensable birth - related neurological injury, it may award compensation to
1492the claimant, provided that the award is approved by the ALJ to whom the
1506claim has been assi gned. § 766.305(7), Fla. Stat. If, on the other hand,
1520compensability is disputed, as alleged in the Amended Petition, the dispute
1531must be resolved by the assigned ALJ in accordance with the provisions of
1544chapter 120, Florida Statutes. §§ 766.304, 766.309 and 766.31, Fla. Stat.
155515. In discharging this responsibility, the ALJ is required to make the
1567following threshold determinations based upon the available evidence:
1575(a) Whether the injury claimed is a birt h - related
1586neurological injury. If the claimant has
1592demonstrated, to the satisfaction of the
1598admi nistrative law judge, that the infant has
1606sustained a brain or spinal cord injury caused by
1615oxygen deprivation or mechanical injury and that
1622the infant was thereby rendered permanently and
1629substantially mentally and physically impaired, a
1635rebuttable presum ption shall arise that the injury
1643is a birth - related neurological injury as defined in
1653s. 766.303(2).
1655(b) Whether obstetrical services were delivered by a
1663participating physician in the course of labor,
1670delivery, or resuscitation in the immediate
1676postdel ivery period in a hospital; or by a certified
1686nurse midwife in a teaching hospital supervised by
1694a participating physician in the course of labor,
1702delivery, or resuscitation in the immediate
1708postdelivery period in a hospital.
1713§ 766.309(1), Fla. Stat.
171716 . The term Ñ birth - related neurological injury Ò is defined in
1731section 766.302(2) as follows:
1735Ñ Birth - related neurological injury Ò means injury to
1745the brain or spinal cord of a live infant weighing at
1756least 2,500 grams for a single gestation or, in the
1767cas e of a multiple gestation, a live infant weighing
1777at least 2,000 grams at birth caused by oxygen
1787deprivation or mechanical injury occurring in the
1794course of labor, delivery, or resuscitation in the
1802immediate postdelivery period in a hospital, which
1809renders the infant permanently and substantially
1815mentally and physically impaired.
181917. The evidence establishes that Rhea was born a live infant weighing at
1832least 2,500 grams. The unrefuted evidence further establishes that there was
1844an injury to RheaÔs brain c aused by oxygen deprivation occurring in the
1857course of labor, delivery, or resuscitation in the immediate post - delivery
1869period in a hospital. The undisputed evidence further establishes that said
1880injury has rendered her permanently and substantially mental ly and
1890physically impaired.
189218. The undisputed evidence further establishes that obstetrical services
1901were delivered by a participating physician, Dr. DeSouza, in the course of
1913labor, delivery, or resuscitation in the immediate post - delivery period in a
1926hospital, Coral Springs Medical Center. It is further undisputed that
1936Dr. DeSouza complied with the notice requirements of section 766.316.
1946Accordingly, the undersigned concludes that Rhea has sustained a
1955compensable birth - related neurological injury.
1961C O NCLUSION
1964Based on the Findings of Fact and the Conclusions of Law, it is O RDERED :
19801. RespondentÔs Motion is granted, and PetitionersÔ claim is found and
1991determined to be compensable.
19952. Jurisdiction is reserved to determine whether the notice requirements
2005of section 766.316 were satisfied by BHCS .
20133. Jurisdiction is reserved to determine the issue of an award pursuant to
2026section 766.31.
