201S TATEMENT OF T HE C ASE
208On March 13, 2020, Petitioners, Jennifer Ann Mungillo and Colton
218Summerlin , individually and as natural parents and guardians of Kinley Ann
229Summerlin (K inley ), a minor, filed a Petition for Benefits Pursuant to Florida
243Statute Section 766.301 et. seq. (Petition) with the Division of Administrative
254He arings (DOAH), for a determination of compensability under the Florida
265Birth - Related Neurological Injury Compensation Plan (Plan). The Petition
275named Ravi Chokshi, M.D. and Charles K. Burlison, M.D., as the physician s
288who provided obstetric services for th e birth of Kinley at HealthPark Medical
301Center , in Fort Myers , Florida, on September 18, 2017 .
311On March 26, 2020, DOAH mailed a cop y of the Petition to Respondent,
325Drs. Burlison and Chokshi, and HealthPark Medical Center via certified
335mail. Respondent wa s served with the same on March 27, 2020.
347On June 10, 2020, Lee Memorial Health System 1 and Dr. Chokshi jointly
360filed a Petition for Leave to Intervene , which was granted. On June 10, 2020,
374Joseph F. Lang, M.D.; Charles Burlison, M.D.; and OB Hospitalist Group,
385LLC jointly filed a Petition for Leave to Intervene , which was granted.
397On August 17, 2020, Respondent filed its Response to Petition for
408Benefits, wherein Respondent maintained that the claim was not
417compensable because Kinley did not sustain a Ñbirth - related neurological
428injury,Ò as defined by section 766.302 (2), Florida Statutes. Respondent
439request ed that a bifurcated hearing be scheduled to address the issues of
452compensability and notice first, and, if required, to address the amount of an
465awa rd in a second hearing. On August 27, 2020, the undersigned issued an
479Order Requiring Response directing the parties to communicate and advise
489whether a final hearing would be required; and, if so, an estimate of the time
504required to conduct the hearing an d several mutually agreeable dates to
516conduct the hearing .
5201 Lee Memorial Health System n/k/a Lee Health owns and oper ates HealthPark Medical
534Center.
535The parties filed a Joint Status Report, and, on October 2, 2020, the final
549hearing was noticed for January 19 and 20, 2021. Thereafter, the parties
561engaged in significant discovery and, on Decembe r 23, 2020, requested a
573continuance of the hearing. The continuance was granted and the final
584hearing was rescheduled for February 25 and 26, 2021.
593On February 17, 2021, Respondent filed its Unopposed Motion to Cancel
604Final Hearing, which was granted. On March 10, 2021, RespondentÔs
614Unopposed Motion for Summary Final Order was filed; however, the same
625was denied, without prejudice on April 23, 2021. RespondentÔs Amended
635Motion was filed on May 18, 2021.
642F INDINGS OF F ACT
6471. Kinley was born on September 18 , 2017, at HealthPark Medical Center,
659in Fort Myers, Florida.
6632. Kinley was a twin, and her weight at birth exceeded 2,000 grams.
6773. As set forth in greater detail below, the unrefuted evidence establishes
689that Kinley did not sustain a Ñbirth - related neu rological injury,Ò as defined by
705section 766.302(2).
7074. Donald Willis, M.D., a board - certified obstetrician specializing in
718maternal - fetal medicine, was retained by Respondent to review the pertinent
730medical records of Ms. Mungillo and Kinley and opine as to whether Kinley
743sustained an injury to her brain or spinal cord caused by oxygen deprivation
756or mechanical injury that occurred during the course of labor, delivery, or
768resuscitation in the immediate post - delivery period in a hospital.
7795. Dr. Willis con ducted the review and in his supporting affidavit provides
792as follows:
794Based upon my education, training, and experience,
801it is my professional opinion, within a reasonable
809degree of medical probability, that there was no
817apparent obstetrical event that r esulted in oxygen
825deprivation and/or mechanical trauma to the brain
832or spinal cord during labor, delivery, or in the
841immediate post - delivery period.
8466. Respondent also retained Luis E. Bello - Espinosa , M.D. , a pediatric
858neurologist, to review the medical records of Ms. Mungillo and Kinley, and to
871conduct an Independent Medical Examination (IME) of Kinley. The purpose
881of his review and IME was to determine whether Kinley suffered from a
894permanent and substantial mental and physical impairment as a result of an
906injury to the brain or spinal cord caused by oxygen deprivation or mechanical
919injury in the course of labor, delivery, or resuscitation in the immediate post -
933delivery period.
9357. Dr. Bello - Espinosa reviewed the pertinent medical records and, on
947August 15 , 2020, conducted the IME. In his supporting affidavit, he
958summarized his opinions as follows:
963Based on my education, training, and experience, it
971is my professional opinion, within a reasonable
978degree of medical probability that Kinley
984Summerlin has no substantial or permanent
990mental impairment and no substantial or
996permanent physical impairment. There is no
1002evidence to indicate that Kinley has any residual
1010neurological impairments that occurred during
1015labor, delivery, or the immediate post - delivery
1023per iod.
10258. The undisputed and unopposed findings and opinions of Drs. Willis and
1037Bello - Espinosa are credited. The undersigned finds that Kinley did not
1049sustain an injury to the brain or spinal cord caused by oxygen deprivation or
1063mechanical injury occurring in the course of labor, delivery, or resuscitation
1074in the immediate post - delivery period in a hospital, which rendered her
1087permanently and substantially mentally and physical impaired.
1094C ONCLUSIONS OF L AW
10999 . DOAH has jurisdiction over the parties to and the subject matter of
1113these proceedings. §§ 766.301 - 766.316, Fla. Stat .
112210 . The Plan was established by the Legislature Ñfor the purpose of
1135providing compensation, irrespective of fault, for birth - related neurological
1145injury claimsÒ relating to b irths occurring on or after January 1, 1989.
1158§ 766.303(1), Fla. Stat .
11631 1 . The injured infant, her or his personal representative, parents,
1175dependents, and next of kin may seek compensation under the Plan by filing
1188a claim for compensation with DOAH. §§ 766.302(3) , 766.303(2) , and
1198766.305(1), Fla. Stat . Respondent, which administers the Plan, has Ñ45 days
1210from the date of service of a complete claim ... in which to file a response to
1227the petition and to submit relevant written information relating to the issue
1239of whether the injury is a birth - related neurological injury.Ò § 766.305(4), Fla.
1253Stat .
12551 2 . If Respondent determines that the injury alleged is a claim that is a
1271compensable birth - related neurological injury, it may award compen sation to
1283the claimant, provided that the award is approved by the administrative law
1295judge (ALJ) to whom the claim has been assigned. § 766.305(7), Fla. Stat . If,
1310on the other hand, compensability is disputed, the dispute must be resolved
1322by the assi gned ALJ in accordance with the provisions of chapter 120, Florida
1336Statutes. §§ 766.304 , 766.309 , and 766.31 , Fla. Stat.
13441 3 . In discharging this responsibility, in the matterÔs present posture, the
1357ALJ is required to make the following thresh old determination based upon
1369the available evidence:
1372(a) Whether the injury claimed is a birth - related
1382neurological injury. If the claimant has
1388demonstrated, to the satisfaction of the
1394administrative law judge, that the infant has
1401sustained a brain or spi nal cord injury caused by
1411oxygen deprivation or mechanical injury and that
1418the infant was thereby rendered permanently and
1425substantially mentally and physically impaired, a
1431rebuttable presumption shall arise that the injury
1438is a birth - related neurological injury as defined in
1448s. 766.303(2) .
1451§ 766.309(1), Fla. Stat .
145614 . The term Ñbirth - related neurological injuryÒ is defined in
1468section 766.302(2) as follows:
1472ÑBirth - related neurological injuryÒ means injury to
1480the brain or spinal cord of a li ve infant weighing at
1492least 2,500 grams for a single gestation or, in the
1503case of a multiple gestation, a live infant weighing
1512at least 2,000 grams at birth caused by oxygen
1522deprivation or mechanical injury occurring in the
1529course of labor, delivery, or re suscitation in the
1538immediate postdelivery period in a hospital, which
1545renders the infant permanently and substantially
1551mentally and physically impaired.
155515. If the ALJ determines that the injury is not a birth - related
1569neurological injury, he or she is req uired to enter an order and immediately
1583provide a copy to the parties. § 766.309(2), Fla. Stat.
159316. The un disputed and unopposed e vidence establishes that there was
1605not an injury to KinleyÔs brain caused by oxygen deprivation or mechanical
1617injury occurrin g in the course of labor, delivery, or resuscitation in the
1630immediate post - delivery period in a hospital, which rendered her
1641permanently and substantially mentally and physically impaired . Thus, it is
1652concluded that she did not sustain a compensable birth - related neurological
1664injury, as defined in section 766.302(2), and, therefore, is not eligible for
1676benefits under the Plan.
1680C ONCLUSION
1682Based on the Findings of Fact and the Conclusions of Law, it is O RDERED
1697that RespondentÔs Amended Motion is granted an d the Petition is dismissed
1709with prejudice.
