160S TATEMENT OF T HE C ASE
167On May 20, 2 020 , Petitioner s Brooke Bailey and Robert Howe, on behalf
181of and as parent s and natural guardians of Elaina Z. Howe (Elaina) , a minor,
196filed a Petition for Benefits Pursuant to Florida Statute Section 766.301 et
208seq. (Petition) with the Division of Adminis trative Hearings (DOAH ) for a
221determination of compensability under the Florida Birth - Related
230Neurological Injury Compensation Plan (Plan).
235The Petition identified Nkemdilim Nwosa, M.D., as the physician who
245provided obstetric services at the birth of El aina on July 23, 2018 , at
259St. VincentÔs Hospital, located in Duval County , Florida.
267DOAH served Nkemdilim Nwosa, M.D., St. VincentÔs Hospital, and NICA
277with a copy of the Petition on May 29, 2020 .
288On June 24, 2020 , NICA filed a Response to Petition for Benefits,
300asserting that Elaina did not sustain a Ñ birth - related neurological injury Ò as
315that term is defined in section 766.302(2), Florida Statutes, and requested
326that a hearing be scheduled to determine compensability. On June 30, 2020,
338the undersigned entered an Order that required the parties to confer and
350advise concerning the need for a hearing, if any, and if a hearing wa s needed,
366when the parties would be prepared to proceed to a hearing, the issues in
380dispute, the estimate of time required for he aring, and the choice of venue.
394On July 9, 2020, the parties filed a Joint Response to June 30 Order,
408requesting an additional 10 - day extension to respond to the June 30, 2020,
422Order. On July 10, 2020, the undersigned entered an Order granting the
434requeste d ten - day extension. On July 17, 2020, NICA filed a Response to
449Order of June 30, 2020, noting that Petitioners had not yet retained counsel,
462but that NICA had spoken with PetitionersÔ potential counsel, and further
473noting that NICA intended to file a moti on for summary final order and
487requesting that the undersigned not schedule this case for hearing. On
498July 20, 2020, the undersigned entered another Order, providing the parties
509an additional 30 days to respond to the June 30, 2020, Order. On July 31,
524202 0, counsel appeared on behalf of Petitioners.
532On July 29, 2020, NICA filed its Motion for Partial Summary Final Order
545(Motion). Having received no response from Petitioners to the Motion within
556the seven - day time period for a response set forth in Florida Administrative
570Code Rule 28 - 106.204(4), the undersigned issued an Order to Show Cause on
584August 7, 2020, ordering Petitioner to show cause, on or before August 19,
59720 20 , in writing, why NICAÔs Motion should not be granted and a summary
611final order be ente red finding that PetitionerÔs claim is not compensable. On
624August 10, 2020, Intervenors filed a Request for Additional Time. And, on
636August 20, 2020, Petitioners, who at this point were represented by counsel,
648filed a Motion for Extension of Time to Respon d to RespondentÔs Motion for
662Summary Final Order, requesting until November 20, 2020, to respond to the
674Motion. On August 20, 2020, the undersigned entered an Order on Pending
686Pleadings that, inter alia , allowed the parties to respond to the Motion no
699late r than November 20, 2020.
705On November 20, 2020, Petitioners filed a Response to RespondentÔs
715Motion for Summary Order and Motion for Extension of Time, which
726requested an additional 60 days for NICAÔs expert to consider fetal heart
738tracing, and included, as an exhibit, such fetal heart tracing. On December 8,
7512020, the undersigned entered an Order Granting Extension of Time for
762Petitioner to Respond to Motion for Summary Final Order, ordering that
773ÑPetitioner [sic] shall file its complete response to the M otion for Summary
786Final Order no later than January 19, 2021.Ò On December 21, 2020, NICA
799filed a Supplemental Affidavit of Donald C. Willis, M.D., which offered an
811opinion after reviewing the additional fetal heart tracing records submitted
821by Petitioner.
823On February 5, 2021, the undersigned entered a Second Order to Show
835Cause, noting that Petitioners had not filed a response to the Motion, and
848that the Motion had been pending for over six months. The Second Order to
862Show Cause ordered Petitioners to sho w cause, in writing, why the Motion
875should not be granted and a summary final order be entered, on or before
889February 12, 2021. Petitioners have not responded to NICAÔs Motion or the
901undersignedÔs Second Order to Show Cause.
907F INDINGS OF F ACT
9121 . Elaina was born on July 23, 2018 , at St. VincentÔs Hospital , located in
927Duval County , Florida.
9302. Donald Willis, M.D. (Dr. Willis) , was requested by NICA to review the
943medical records for Elaina . In a medical report dated August 13 , 2020,
956Dr. Willis summarized his findings and opined , in pertinent part , as follows:
968In summary, pregnancy was essentially
973uncomplicated. Spontaneous vaginal birth resulted
978in a healthy newborn with Apgar scores of 8/9. The
988newborn hospital course was uncomplicated. MRI
994at about one yea r of age showed cerebral volume
1004loss, consistent with prior brain injury. The brain
1012injury was apparently not due to birth related
1020oxygen deprivation or trauma.
1024As such, it is my opinion that there was no
1034apparent obstetrical event that resulted in oxygen
1041deprivation and or mechanical trauma to the brain
1049or spinal cord during labor, delivery or in the
1058immediate post - delivery period.
10633. NICA retained Raj D. Sheth , M.D. (Dr. Sheth) , a medical expert
1075specializing in pediatric neurology, to examine Elaina and to review her
1086medical records. Dr. Sheth examined Elaina on June 17, 2020. In a medical
1099report dated June 17, 2020, Dr. Sheth summarized his examination of Elaina
1111and opined , in pertinent part , as follows:
11181. Elaina Howe does suffer from substantial
1125phys ical impairment and substantial mental
1131impairment as manifest by delays in gross motor,
1139and fine motor, language and personal social skills.
11472. Elaina Howe mental and physical impairments
1154are likely to be permanent although there is likely
1163to be some impr ovement with time.
11703. The mental and physical impairments are not
1178consistent with an injury to the brain or spinal cord
1188acquired due to oxygen deprivation or mechanical
1195injury occurring during labor and delivery or
1202immediate post delivery period.
12064. The permanent and substantial impairments
1212from the records provided and this evaluation do
1220not appear to have occurred during labor, delivery
1228or the immediate post - delivery period.
12354. NICA filed a Supplemental Affidavit of Dr. Willis on December 21,
12472020, in which he offered an opinion on the fetal heart tracing records
1260submitted by Petitioners. Dr. Willis opined as follows:
1268The FHR tracing during labor was reassuring (no
1276distress), consistent with my previous opinion,
1282dated 6/17/20, that there was no apparen t
1290obstetrical event that resulted in oxygen
1296deprivation and or mechanical trauma to the brain
1304or spinal cord during labor, delivery or in the
1313immediate post delivery period.
1317The Opinions se[t] forth in my Affidavit executed
1325July 21, 2020 remain the same a nd are not
1335modified by my review of the additional medical
1343records as indicated herein.
13475. A review of the file in this case reveals that there have been no expert
1363opinions filed that are contrary to the opinion of Dr. W illis that it is unlikely
1379that any significant oxygen deprivation occurred prior to the birth of Elaina.
1391Dr . WillisÔs opinion is credited. There are no expert opinions filed that are
1405contrary to Dr. ShethÔs opinion that Elaina should not be considered for
1417inclusion in the NICA program. Dr. ShethÔs opinion is credited.
14276. Petitioners have failed to respond to the Motion or the undersignedÔs
1439Second Order to Show Cause.
1444C ONCLUSIONS OF L AW
14497. DOAH has jurisdiction over the parties to and the subjec t matter of
1463these proceedings. §§ 766.301 - 766.3 16, Fla. Stat.
14728. The Legislature established the Plan Ñ for the purpose of providing
1484compensation, irrespective of fault, for birth - related neurological injury
1494claims Ò relating to births occurrin g on or after January 1, 1989. § 766.303(1),
1509Fla. Stat.
15119. T he injured infant, her or his personal representative, parents,
1522dependents, and next of kin may seek compensation under the Plan by
1534filing a claim for compensation with DOAH. §§ 766.302(3), 766.303( 2),
1545and 766.305(1), Fla. Stat. NICA, which administers t he Plan, has Ñ 45 days
1559from the date of service of a complete claim . . . in which to file a response to
1578the petition and to submit relevant written information relating to the issue
1590of whether the injury is a birth - related neurological injury.Ò £ 766.305(4 ),
1604Fla. Stat.
160610. If NICA determines that the injury alleged in a claim is a compensable
1620birth - related neurological injury, it may award compensation to the claimant,
1632provided that the award is approved by the administrative law judge to
1644whom the claim ha s been assig ned. § 766.305(7), Fla. Stat. If, on the other
1660hand, NICA disputes the claim, as it has in the instant case, the dispute
1674must be resolved by the assigned administrative law judge in accordance
1685with the provisions of chapter 120, Florida Statute s. §§ 766.304, 766.309,
1697and 766.31, Fla. Stat.
170111. In discharging this responsibility, the administrative law judge must
1711make the following determination based upon the available evidence:
1720(a) Whether the injury claimed is a birt h - related
1731neurological i njury. If the claimant has
1738demonstrated, to the satisfaction of the
1744administrative law judge, that the infant has
1751sustained a brain or spinal cord injury caused by
1760oxygen deprivation or mechanical injury and that
1767the infant was thereby rendered permanently and
1774substantially mentally and physically impaired, a
1780rebuttable presumption shall arise that the injury
1787is a birth - related neurological injury as defined in
1797s. 766.303(2).
1799(b) Whether obstetrical services were delivered by a
1807participating physician in the course of labor,
1814delivery, or resuscitation in the immediate
1820postdelivery period in a hospital; or by a certified
1829nurse midwife in a teaching hospital supervised by
1837a participating physician in the course of labor,
1845delivery, or resuscitation in the imm ediate
1852postdelivery period in a hospital.
1857§ 766.309(1), Fla. Stat. An award may be sustained only if the administrative
1870law judge concludes that the Ñ infant has sustained a birth - related
1883neurological injury and that obstetrical services were delivered by a
1893participating physician at birth. Ò § 766.31(1), Fla. Stat.
190212. Section 766.302(2) defines t he term Ñ birth - related neurological injury Ò
1916a s follows:
1919Ñ Birth - related neurological injury Ò means injury to
1929the brain or spinal cord of a live infant weighing at
1940least 2,500 grams for a single gestation or, in the
1951case of a multiple gestation, a live infant weighing
1960at least 2,000 grams at birth caused by oxygen
1970deprivation or mechanical injury occurring in the
1977course of labor, delivery, or resuscitation in the
1985immediate postdelivery period in a hospital, which
1992renders the infant permanently and substantially
1998mentally and physically impaired.
200213. To be compensable under the Plan, there must have been an
2014obstetrical event which resulted in loss of oxygen to the babyÔs brain during
2027labor, delivery, or resuscitation in the immediate post - delivery period
2038resulting in a permanent and substantial mental impairment and a
2048permanent and substantial physical impairment, inasmuch as both are
2057required to establish compensab ility. Fla. Birth - Related Neurological Injury
2068Comp. AssÔn v. Div. of Admin. Hearings , 686 So. 2d 1349 (Fla. 1997).
208114. The evidence, which Petitioners have not refuted or attempted to
2092refute, established that Elaina did not suffer a birth - related neurologi cal
2105injury. Therefore, Elaina is not eligible for benefits under the Plan.
2116C ONCLUSION
2118Based on the Findings of Fact and the Conclusions of Law, it is
2131O RDERED that:
2134The Petition filed by Brooke Bailey and Robert Howe, on behalf of and as
2148parents and nat ural guardians of Elaina Z. Howe , is dismissed with
2160prejudice.
