142S TATEMENT OF T HE C ASE

149On June 18, 2020, Petitioners , Ryan Bunch and Regina Oles, on behalf of

162and as parents and natural guardians of Jetty Bunch (Jetty), a minor, filed a

176Petition for Benefits Pursuant to Florida Statute Section 766.301 et seq.

187(Petition) with the Division of Administrative Hearings (DOAH) for a

197determination of compensability under the Florida Birth - Related

206Neurological Injury Compensation Plan (Plan).

211The Petition identified Tedra Gilmore, M.D., as the physician who

221provided obstetric services at the birth of Jetty on June 19, 2015, at H alifax

236Medical Center, located in Volusia County, Florida.

243DOAH served Dr. Gilmore, Halifax Medical Center, and NICA with a copy

255of the Petition on June 25, 2020.

262Between July 22, 2020, and July 12, 2021, the undersigned granted six

274extensions of time f or NICA to respond to the Petition, because of difficulties

288in securing medical records. On August 11, 2021, NICA filed a Response to

301Petition for Benefits, asserting that Jetty did not sustain a Ñbirth - related

314neurological injury , Ò as that term is defined in section 766.302(2), Florida

326Statutes, and requested that a hearing be scheduled to determine

336compensability. On August 13, 2021, the undersigned entered an Order that

347required the parties to confer and advise concerning the need for a hearing, if

361any, and if a hearing is needed, when the parties will be prepared to proceed

376to a hearing, the issues in dispute, the estimate of time required for hearing,

390and the choice of venue. On August 27, 2021, NICA filed a Response to Order

405Dated August 13, 2021, whic h noted the position of NICA and Intervenors

418was that this matter could be resolved by Motion for Summary Final Order,

431and the position of Petitioners was that they disputed NICAÔs determination

442and requested a hearing. The undersigned thereafter noticed t his matter for

454a final hearing for October 29, 2021.

461On September 23, 2021, NICA filed its Motion for Partial Summary Final

473Order (Motion). Having received no response from Petitioners to the Motion

484within the seven - day time period for a response set fort h in Florida

499Administrative Code Rule 28 - 106.204(4), the undersigned issued an Order to

511Show Cause on October 1, 2021, ordering Petitioner s to show cause, on or

525before October 14, 20 2 1, in writing, why NICAÔs Motion should not be

539granted and a summary fina l order be entered finding that PetitionerÔs claim

552is not compensable. Petitioners have not responded to NICAÔs Motion or the

564undersignedÔs Order to Show Cause.

569F INDINGS OF F ACT

5741. Jetty was born on June 19, 2015, at Halifax Health Medical Center,

587d/b/a H alifax Medical Center, located in Volusia County, Florida.

5972. Donald Willis, M.D. (Dr. Willis), was requested by NICA to review the

610medical records for Jetty. In a medical report dated August 6, 2021, Dr. Willis

624summarized his findings and opined, in per tinent part, as follows:

635In summary, spontaneous labor occurred at term

642and ended with a spontaneous vaginal delivery.

649Apgar scores were 5/9. Bag and mask ventilation

657was given for about 4 - minutes due to respiratory

667distress at birth. Oxygen was weaned wi th

675spontaneous respirations. The baby was considered

681stable and remained in the room with the mother.

690Twenty minutes after birth the baby was noted to

699be floppy and cyanotic. Laboratory evaluation

705identified severe hypoglycemia and DIC. MRI

711showed brain he morrhage with follow up MRI

719showing evolving brain injury related to the

726previously identified hemorrhage. Genetic

730evaluation was negative.

733The baby suffered brain injury as indicated by

741MRI. Although the baby was initially depressed at

749birth, stabilizati on occurred shortly after birth with

757the baby remaining in the room with the mother

766and not requiring nursery care. This would suggest

774the baby did not have significant oxygen

781deprivation at birth. The brain injury likely

788occurred at some time around deliv ery, but it does

798not appear the brain injury was caused by oxygen

807deprivation or trauma during labor and delivery. I

815do not have any opinions about issues related to the

825hypoglycemia or DIC as a cause for the brain

834injury.

8353. NICA retained Michael S. Ducho wny, M.D. (Dr. Duchowny), a medical

847expert specializing in pediatric neurology, to examine Jetty and to review his

859medical records. Dr. Duchowny examined Jetty on June 7, 2021. In a medical

872report dated August 8, 2021, Dr. Duchowny summarized his examinati on of

884Jetty and opined, in pertinent part, as follows:

892In summary , JettyÔs examination reveals

897substantial cognitive and motor deficits consistent

903with global developmental delay. Jetty is non -

911fluent, non - ambulatory with spastic quadriparesis

918and primitiv e reflex responses. He has

925asymmetrically greater right - sided involvement, a

932non - fixed right elbow contracture, and shortening

940of his right leg. He lacks consistent visual fixation

949and following, and a history suggestive of bilateral

957optic atrophy. There i s a longstanding pharmaco -

966resistant epilepsy. JettyÔs neurodevelopmental

970delays have been present since infancy and he has

979shown little developmental progress.

983A review of JettyÔs medical records reveals that he

992was born at Halifax Medical Center and was the

1001product of a 40 week gestation with a birth weight

1011of 3742 grams. The pregnancy was complicated by

1019maternal maintenance buprenorphine for

1023management of substance abuse. Rupture of

1029membranes occurred 4 hours prior to delivery and

1037revealed thickly meconi um - stained fluid.

1044Apgar scores were 5 and 9 at 1 and 5 minutes; cord

1056blood gases were therefore not ordered. Jetty was

1064placed with his mother in the newborn nursery but

1073suddenly became cyanotic and ashen, received

1079supplemental blow - by oxygen, and was tran sferred

1088to the NICU. An Accucheck was unrecordable and

1096serum glucose determination was recorded as 1.

1103Arterial blood gases revealed respiratory acidosis

1109with a pH of 7.24 and base excess of - 1.8.

1120Laboratory examination revealed a leukocytosis

1125(WBC=36.3) w ith elevated mononuclear cells and

1132bandemia. Jetty was subsequently transferred to

1138Shands Jacksonville where he evidenced an

1144elevated CRP, a PDA, acute adrenal insufficiency,

1151hematuria, acute renal failure and DIC with

1158thrombocytopenia and abnormal clottin g

1163parameters. MR imaging performed on July 7 th

1171revealed multifocal diffusion - weighted

1176abnormalities, ventriculomegaly and

1179periventricular signal abnormality; the report also

1185noted intracranial hemorrhage. Subsequent MR

1190imaging on July 20 th revealed the dev elopment of

1200multi - cystic white matter lesions, PVL and further

1209ventricular enlargement.

1211The clinical and imaging findings and brain injury

1219are most likely caused by the fetal inflammatory

1227response syndrome, and did not result from either

1235mechanical injury or oxygen deprivation in the

1242course of labor or delivery. The hemorrhage

1249reported on brain imaging did not contribute to the

1258brain injury. I am therefore not recommending that

1266Jetty be considered for inclusion in the NICA

1274program.

12754. A review of the file in this case reveals that there have been no expert

1291opinions filed that are contrary to the opinion of Dr. Willis that it is unlikely

1306that any significant oxygen deprivation occurred prior to the birth of Jetty.

1318Dr. WillisÔs opinion is credited. There hav e been no expert opinions filed that

1332are contrary to Dr. DuchownyÔs opinion that Jetty should not be considered

1344for inclusion in the NICA Plan . Dr. DuchownyÔs opinion is credited.

13565. Petitioners have failed to respond to the Motion or the undersignedÔs

1368Ord er to Show Cause.

1373C ONCLUSIONS OF L AW

13786. DOAH has jurisdiction over the parties to and the subject matter of

1391these proceedings. §§ 766.301 - 766.316, Fla. Stat.

13997. The Legislature established the Plan Ñfor the purpose of providing

1410compensation, irrespective of fault, for birth - related neurological injury

1420claimsÒ relating to births occurring on or after January 1, 1989. £ 766.303(1),

1433Fla. Stat.

14358. The injured infant, her or his personal representative, parents,

1445dependents, and next of kin may seek compensatio n under the Plan by

1458filing a claim for compensation with DOAH. §§ 766.302(3), 766.303(2),

1468and 766.305(1), Fla. Stat. NICA, which administers the Plan, has Ñ45 days

1480from the date of service of a complete claim . . . in which to file a response to

1499the peti tion and to submit relevant written information relating to the issue

1512of whether the injury is a birth - related neurological injury.Ò £ 766.305(4),

1525Fla. Stat.

15279. If NICA determines that the injury alleged in a claim is a compensable

1541birth - related neurologi cal injury, it may award compensation to the claimant,

1554provided that the award is approved by the administrative law judge to

1566whom the claim has been assigned. § 766.305(7), Fla. Stat. If, on the other

1580hand, NICA disputes the claim, as it has in the instan t case, the dispute

1595must be resolved by the assigned administrative law judge in accordance

1606with the provisions of chapter 120, Florida Statutes. §§ 766.304, 766.309,

1617and 766.31, Fla. Stat.

162110. In discharging this responsibility, the administrative law j udge must

1632make the following determination based upon the available evidence:

1641(a) Whether the injury claimed is a birth - related

1651neurological injury. If the claimant has

1657demonstrated, to the satisfaction of the

1663administrative law judge, that the infant has

1670sustained a brain or spinal cord injury caused by

1679oxygen deprivation or mechanical injury and that

1686the infant was thereby rendered permanently and

1693substantially mentally and physically impaired, a

1699rebuttable presumption shall arise that the injury

1706is a bi rth - related neurological injury as defined in

1717s. 766.303(2).

1719(b) Whether obstetrical services were delivered by a

1727participating physician in the course of labor,

1734delivery, or resuscitation in the immediate

1740postdelivery period in a hospital; or by a certi fied

1750nurse midwife in a teaching hospital supervised by

1758a participating physician in the course of labor,

1766delivery, or resuscitation in the immediate

1772postdelivery period in a hospital.

1777§ 766.309(1), Fla. Stat. An award may be sustained only if the admini strative

1791law judge concludes that the Ñinfant has sustained a birth - related

1803neurological injury and that obstetrical services were delivered by a

1813participating physician at birth.Ò £ 766.31(1), Fla. Stat.

182111. Section 766.302(2) defines the term Ñbirth - rel ated neurological injuryÒ

1833as follows:

1835ÑBirth - related neurological injuryÒ means injury to

1843the brain or spinal cord of a live infant weighing at

1854least 2,500 grams for a single gestation or, in the

1865case of a multiple gestation, a live infant weighing

1874at le ast 2,000 grams at birth caused by oxygen

1885deprivation or mechanical injury occurring in the

1892course of labor, delivery, or resuscitation in the

1900immediate postdelivery period in a hospital, which

1907renders the infant permanently and substantially

1913mentally and physically impaired.

191712. To be compensable under the Plan, there must have been an

1929obstetrical event which resulted in loss of oxygen to the babyÔs brain during

1942labor, delivery, or resuscitation in the immediate post - delivery period

1953resulting in a perman ent and substantial mental impairment and a

1964permanent and substantial physical impairment, inasmuch as both are

1973required to establish compensability. Fla. Birth - Related Neurological Injury

1983Comp. AssÔn v. Div. of Admin. Hearings , 686 So. 2d 1349 (Fla. 1997) .

199713. The evidence, which Petitioners have not refuted or attempted to

2008refute, established that Jetty did not suffer a birth - related neurological

2020injury. Therefore, Jetty is not eligible for benefits under the Plan.

2031C ONCLUSION

2033Based on the Findings of Fact and the Conclusions of Law, it is

2046O RDERED that:

2049The Petition filed by Ryan Bunch and Regina Oles, on behalf of and as

2063parents and natural guardians of Jetty Bunch, is dismissed with prejudice.

2074The final hearing scheduled for October 29, 2021, is cancel led.
