146S TATEMENT OF T HE C ASE
153On July 14, 2020, Melissa Prevatte a nd Derek Norsworthy, i ndividually
165a nd a s Parents a nd n atural g uardians o f Gracen Norsworthy ( " Gracen " ) , a
184m inor c hild , filed a Petition for Benefits Filed Pursuant to Florida Statute
198Section 766.301 et seq (the " Petition " ) , with the Division of Administrative
210Hearings ( " DOAH " ) for a determination of compensability under the Florida
222Birth - Related Neurological Injury Compensation Plan (the " Plan " ).
232The Petition identified Maya Kamath, M.D., as the physician who
242pr ovided obstetrical services at Gracen ' s birth on June 26, 2019, at
256Galencare, Inc., d / b / a Brandon Regional Hospital ( " Brandon Hospital " ), in
271Brandon, Florida.
273DOAH served Dr. Kamath wi th a copy of the Petition on August 3, 2020,
288and served Brandon Hospit al that same date. DOAH also served NICA with a
302copy of the Petition on August 3, 2020.
310Brandon Hospital mo ved to intervene in this matter on August 11, 2020,
323which was granted. Dr. Kamath and Women ' s Care Florida, L.L.C., also
336moved to intervene on Au gust 21, 2020, which was also granted .
349On October 13 , 2020, NICA filed its response to the Petition, taking the
362position that Petitioners ' claim is not compensable under the Plan. NICA
374requested DOAH schedule a n evidentiary hearing to determine
383compensa bility.
385On March 8, 2021, NICA filed a n Unopposed Motion for Final Summary
398Order requesting the Administrative Law Judge ( " ALJ " ) to enter a summary
411final order finding the claim not compensable under the NICA statute
422because Gracen did not suffer a " bir th - related neurological injury " as defined
436in section 766.302(2) , Florida Statues .
442F INDINGS OF F ACT
4471. Gracen was born on June 26, 2019, at Brandon Hospital located in
460Brandon , Florida.
4622. According to the Petition, Maya Kamath, M.D., provided obstetrica l
473services at Gracen ' s birth. 1
4803. Upon receiving the Petition, NICA retained Donald Willis, M.D., a
491board - certified obstetrician/gynecologist specializing in maternal - fetal
500medicine , as well as Luis E. Bello - Espinosa , M.D., a pediatric neurologist, to
514rev iew Gracen ' s medical records and condition. NICA sought to determine
527whether Gracen suffered a " birth - related neurological injury " as defined in
539section 766.302(2). Specifically, NICA requested its medical consultants opine
548whether Gracen experienced an in jury to the brain or spinal cord caused by
562oxygen deprivation or mechanical injury which occurred in the course of
573labor, delivery, or resuscitation in the immediate post - delivery period. And, if
586so, whether this injury rendered Gracen permanently and subs tantially
596mentally and physically impaired.
6004. Dr. Willis reviewed Gracen ' s medical records and noted that:
612The mother was admitted for induction of labor at
62139 weeks gestational age.
625* * *
628Cesarean section was done for a non - reassuring
637FHR pattern. A true knot was noted in the
646umbilical cord at birth.
650* * *
653The delivery operative note describes the baby as
661pink and vigorous at birth. Neonatal team noted
669poor respiratory effort once placed in the warmer.
677È Despite resuscitative measures, the bab y
684remained floppy with delayed perfusion.
689* * *
6921 No evidence was presented establish ing that Dr. Kamath w as a " participating physician "
707under the NICA statute at the time Gracen was born. See § § 76 6.302(7) and 766.314(4) , Fla.
725Stat. However, this finding is not pertinent to this Final Order as Gracen did not suffer a
742compensable injury under the Plan.
747The baby was taken to the NICU. È Chest X - ray
759suggested transient tachypnea of the newborn
765(TTN). Hypoxic ischemic encephalopathy (HIE) was
771suspected and the baby was transferred to [Tampa
779General Hospital ] for possible cooling protocol.
786* * *
789EEG showed depressed cerebral activity while on
796cooling protocol, but no seizure activity was noted.
804Neurologic exam at time of newborn hospital
811discharge was considered normal.
815* * *
818In summary, labor was ind uced at term. A non -
829reassuring FHR pattern during labor required
835Caesarean delivery. È Cooling protocol was
841initiated for suspected HIE. No seizure activity was
849noted, either clinically or by EEG. Head ultrasound
857was normal. MRI on DOL 7 was normal. There was
867some degree of oxygen deprivation at birth È
875However, MRI on DOL 7 did not identify any brain
885injury.
8865. Dr. Willis concluded that, " F ortunately, the oxygen deprivation did not
898result in any identifiable brain injury. "
9046 . Dr. Bella - Espinosa agreed wit h Dr. Willis that Gracen did not suffer
920injuries that qualify for inclusion in the NICA Plan. Dr. Bella - Espinosa
933reviewed Gracen ' s medical records, as well as conducted an independent
945medical exam ination of Gracen on October 9, 2020, when Gracen was
95715 mon ths old. Following the examination, Dr. Bella - Espinosa reported that:
970Gracen was quite alert and interactive. He had
978great attention. È The tone of arms and legs was
988normal. È [H]e was able to walk on his own power
999without difficulties. È He reached for ob jects
1007without any tremors or dysmetria.
1012Thereafter, Dr. Bella - Espinosa concluded that Gracen ' s prognosis is
" 1024excellent, " and that his " estimated life expectancy is normal. " Dr. Bella -
1036Espinosa then opined :
1040In reviewing all the available documents, there i s
1049no evidence of permanent and substantial mental
1056and physical impairments of the brain or spinal
1064cord that may have been due to oxygen deprivation
1073or mechanical injury that may have occurred
1080during labor, delivery or the immediate post -
1088delivery period. È Considering the clinical
1094presentation, I do feel that there is no evidence to
1104recommend Gracen is included in the NICA
1111program .
11137 . A review of the documents in the record reveals no contrary evidence to
1128dispute the findings and opinions of Dr. Willis and Dr. Bella - Espinosa . Their
1143opinions are credible and persuasive.
1148C ONCLUSIONS OF L AW
11538. The Division of Administrative Hearings has jurisdiction over the
1163parties and subject matter of this proceeding pursuant to sections 766.301
1174through 766.316. The undersi gned, as an Administrative Law Judge ("ALJ") ,
1187has " exclusive jurisdiction to determine whether a claim filed under [NICA] is
1199compensable. " §§ 766.301(1)(d), 766.304, and 766.311(1), Fla. Stat.
12079. The Florida Legislature established the Plan " for the purp ose of
1219providing compensation, irrespective of fault, for birth - related neurological
1229injury claims. " § 766.303(1), Fla. Stat.
123510. To seek compensation under the Plan, a legal representative on behalf
1247of an injured infant files a claim with DOAH. §§ 766.302 (3) and 766.305(1),
1261Fla. Stat. NICA, which administers the Plan, then has " 45 days from the date
1275of service of a complete claim ... in which to file a response to the petition and
1292to submit relevant written information relating to the issue of whether the
1304injury is a birth - related neurological injury. " § 766.305(4), Fla. Stat.
131611. If NICA determines that the injury alleged in a claim is a compensable
1330birth - related neurological injury, it may award compensation to the claimant,
1342provided that the award is app roved by the ALJ to whom the claim has been
1358assigned. § 766.305(7), Fla. Stat.
136312. In this matter, however, NICA determined that Petitioners ' claim is
1375not compensable under the Plan. Therefore, NICA filed the Unopposed
1385Motion for Final Summary Order, req uesting a finding that Gracen is not
1398eligible for NICA Plan benefits.
140313. In reviewing the compensability of a claim, section 766.309(1) directs
1414the ALJ to make the following determinations based upon " all available
1425evidence " :
1427(a) Whether the injury claim ed is a birth - related
1438neurological injury;
1440(b) Whether obstetrical services were delivered by a
1448participating physician in the course of labor,
1455delivery, or resuscitation in the immediate
1461postdelivery period in a hospital; or by a certified
1470nurse midwif e in a teaching hospital supervised by
1479a participating physician in the course of labor,
1487delivery, or resuscitation in the immediate
1493postdelivery period in a hospital; and
1499(c) How much compensation, if any, is awardable
1507pursuant to s. 766.31.
151114. The te rm " birth - related neurological injury " is defined in section
1524766.302(2) as:
1526injury to the brain or spinal cord of a live infant
1537weighing at least 2,500 grams for a single gestation
1547... caused by oxygen deprivation or mechanical
1554injury occurring in the cour se of labor, delivery, or
1564resuscitation in the immediate postdelivery period
1570in a hospital, which renders the infant permanently
1578and substantially mentally and physically
1583impaired.
158415. " The [NICA] Statute is written in the conjunctive and can only be
1597inte rpreted to require permanent and substantial impairment that has both
1608physical and mental elements. " Fla. Birth - Related Neurological Injury Comp.
1619Ass ' n v. Fla. Div. of Admin. Hearings , 686 So. 2d 1349, 1356 (Fla. 1997).
16351 6 . In reviewing the injury in this matter, the preponderance of the
1649evidence does not e stablish that Gracen sustain ed a " birth - related
1662neurological injury " as defined in section 766.302(2). Dr. Willis specifically
1672noted that, while there " was some degree of oxygen deprivation at birth, "
1684Gra cen ' s " MRI on DOL 7 did not identify any brain injury. " Similarly,
1699Dr. Bella - Espinosa found that " there is no evidence of permanent and
1712substantial mental and physical impairments of the brain or spinal cord that
1724may have been due to oxygen deprivation or mechanical injury that may have
1737occurred during labor, delivery or the immediate post - delivery period . "
17491 7 . Accordingly , based on all the available evidence in the record, the
1763undersigned determines that Gracen has not suffered a " birth - related
1774neurolog ical injury " and is not eligible for NICA benefits.
1784D ISPOSITION
1786Based upon the foregoing Findings of Fact and Conclusions of Law, it is
1799O RDERED that the Petition is dismissed, with prejudice.
