118Association ( " NICA " ), on February 9, 2021.

126S TATEMENT OF T HE C ASE

133On September 28, 2020, Petitioners, David Peter Andris and Jessey

143Lauren Howard An dris, on behalf of and as parents and natural guardians of

157Tobias Andris ( " Tobias " ), a minor, filed a Petition for Benefits Pursuant to

171Florida Statute Section 766.301 et s eq. (the " Petition " ), with the Division of

185Administrative Hearings ( " DOAH " ) for dete rmination of compensability

195under the Florida Birth - Related Neurological Injury Compensation Plan (the

" 206Plan " ).

208The Petition identified Suzette M. Rodriguez, M.D., as the medical

218professional who provided obstetrical services at Tobias ' s birth on May 3,

23120 19, at Memorial Hospital West ( " Memorial " ) in Pembroke Pines, Florida.

244DOAH served Dr. Rodriguez with a copy of the Petition on October 28,

2572020, and served Memorial that same date. DOAH also served NICA with a

270copy of the Petition on October 28, 2020.

278Dr. Rodriguez moved to intervene in this matter on November 11, 2020,

290which was granted.

293On December 29, 2020, NICA filed its response to the Petition, taking the

306position that Petitioners ' claim is not compensable under the Plan. NICA

318requested DOA H schedule an evidentiary hearing to determine

327compensability.

328On February 9, 2021, NICA filed a Motion for Summary Final Order

340requesting the Administrative Law Judge ( " ALJ " ) enter a summary final

352order finding the claim not compensable under the NICA statute because

363Tobias did not suffer a " birth - related neurological injury " as defined in

376section 766.302(2) Florida Statues, and, therefore, the claim is not

386compensable under the Plan as a matter of law. As of the date of this Order,

402Petitioners have not responded to NICA ' s motion.

411F INDINGS OF F ACT

4161. Tobias was born on May 3, 2019, at Memorial located in Pembroke

429Pines, Florida.

4312. The Petition alleges that Suzette M. Rodriguez, M.D., was the medical

443professional who participated in Tobias ' s birth. No evidence was presented to

456the ALJ establishing whether Dr. Rodriguez was a " participating physician "

466under the Plan at the time Tobias was born. See §§ 766.302(7) and

479766.314(4), Fla. Stat.

4823. Upon receiving the Petition, NICA retained Donald Willis, M .D., a

494board - certified obstetrician/gynecologist specializing in maternal - fetal

503medicine, as well as Michael S. Duchowny, M.D., a pediatric neurologist, to

515review Tobias ' s medical records and condition. NICA sought to determine

527whether Tobias suffered a " b irth - related neurological injury " as defined in

540section 766.302(2). Specifically, NICA requested its medical consultants opine

549whether Tobias experienced an injury to the brain or spinal cord caused by

562oxygen deprivation or mechanical injury which occurred in the course of

573labor, delivery, or resuscitation in the immediate postdelivery period. And, if

584so, whether this injury rendered Tobias permanently and substantially

593mentally and physically impaired.

5974. Dr. Willis reviewed Tobias ' s medical records and op ined, within a

611reasonable degree of medical probability:

616The maternal history of decreased fetal movement

623prior to delivery and an abnormal [fetal heart rate]

632tracing for admission with no acidosis on the initial

641blood gas studies would be most consistent with a

650stroke (brain injury) occurring prior to birth.

657There was no obstetrical event that resulted in loss

666of oxygen or mechanical trauma to the baby ' s brain

677during labor or delivery. The baby suffered a stroke

686due to an occluded right carotid artery. It appears

695this event occurred prior to delivery. The mother

703was not in labor.

7075 . Dr. Duchowny also reviewed Tobias ' s medical records, as well as

721personally examined Tobias (via Zoom video conference) on December 22,

7312020. Dr. Duchowny noted that:

736Tobias wa s diagnosed with cerebral palsy at age 1

746year. He has extremely limited motor functions

753although his left hand is better than his right. He

763moves all limbs but none are functional.

770* * *

773Tobias had seizures in the NICU and remains on

782anti - seizure medic ations. He was formerly

790suspected of having infantile spasms but his EEG

798did not reveal hypsarrhythmia.

802* * *

805Tobias has not encountered respiratory difficulties

811or pneumonia. He has not been hospitalized since

819birth. His head has grown normally.

825* * *

828In summary, Tobias ' s examination reveals findings

836consistent with a substantial mental and motor

843impairment. He has four - limb spasticity, greater on

852the right, axial hypotonia, generalized hyper -

859reflexia with pathological reflexes and absent

865verbal co mmunication.

868* * *

871A review of Tobias ' s medical records reveals that he

882was born at Memorial West Hospital at 38 4/7

891week ' s gestation. His mother had noted decreased

900fetal movement the day before admission and

907presented for evaluation. Following a non -

914reassuring fetal heart rate assessment Tobias was

921delivered by Caesarian section. He weighed 2.87

928kg. at birth and had Apgar scores of 4, 5, and 9 at 1,

9425 and 10 minutes of life.

948* * *

951Seizures were noted on the first day of life and

961treated with Keppr a and phenobarbital. Tobias was

969discharged from the NICU after two weeks.

976* * *

979An MRI scan of the brain obtained on May 4th

989(DOL # 1) revealed diffuse [Hypoxic Ischemic

996Encephalopathy] findings involving both cerebral

1001hemispheres in the right and left anterior and

1009middle cerebral artery and the right internal

1016carotid territories. È Follow - up MR imaging

1024revealed the presence of a thrombus in the right

1033common and internal carotid arteries with

1039decreased flow in the right middle cerebral artery

1047and stenos is of the left middle cerebral artery with

1057retrograde perfusion of the right internal carotid

1064artery.

10656 . Following his independent medical examination, Dr. Duchowny opined,

1075within a reasonable degree of medical probability, that, " Despite Tobias ' s

1087substan tial delays, a review of the medical records reveals that his deficits

1100were likely acquired prior to birth and were not due to mechanical injury or

1114oxygen deprivation during labor, delivery, or the post - delivery period. "

1125Therefore, Dr. Duchowny concluded : " I am not recommending that Tobias be

1137considered for inclusion into the NICA program. "

11447 . A review of the records filed in this matter reveals no contrary evidence

1159to dispute the findings and opinions of Dr. Willis and Dr. Duchowny. Their

1172opinions are cred ible and persuasive.

1178C ONCLUSIONS OF L AW

11838 . The Division of Administrative Hearings has jurisdiction over the

1194parties and subject matter of this proceeding pursuant to sections 766.301 -

1206766.316. The undersigned, as an A dministrative L aw J udge, has " exclusiv e

1220jurisdiction to determine whether a claim filed under [NICA] is

1230compensable. " §§ 766.301(1)(d), 766.304, and 766.311(1), Fla. Stat.

12389. The Florida Legislature established the Plan " for the purpose of

1249providing compensation, irrespective of fault, for b irth - related neurological

1260injury claims. " § 766.303(1), Fla. Stat.

126610. To seek compensation under the Plan, a legal representative on behalf

1278of an injured infant files a claim with DOAH. §§ 766.302(3) and 766.305(1),

1291Fla. Stat. NICA, which administers the Plan, then has " 45 days from the date

1305of service of a complete claim ... in which to file a response to the petition and

1322to submit relevant written information relating to the issue of whether the

1334injury is a birth - related neurological injury. " § 766.305(4 ), Fla. Stat.

134711. If NICA determines that the injury alleged in a claim is a compensable

1361birth - related neurological injury, it may award compensation to the claimant,

1373provided that the award is approved by the ALJ to whom the claim has been

1388assigned. § 766 .305(7), Fla. Stat.

139412. In this matter, however, NICA determined that Petitioners ' claim is

1406not compensable under the Plan. Therefore, NICA filed the Motion for

1417Summary Final Order, requesting a finding that Tobias is not eligible for

1429NICA Plan benefits.

143213. In reviewing the compensability of a claim, section 766.309(1) directs

1443the ALJ to make the following determinations based upon " all available

1454evidence: "

1455(a) Whether the injury claimed is a birth - related

1465neurological injury;

1467(b) Whether obstetrical services were delivered by a

1475participating physician in the course of labor,

1482delivery, or resuscitation in the immediate

1488postdelivery period in a hospital; or by a certified

1497nurse midwife in a teaching hospital supervised by

1505a participating physician in t he course of labor,

1514delivery, or resuscitation in the immediate

1520postdelivery period in a hospital; and

1526(c) How much compensation, if any, is awardable

1534pursuant to s. 766.31.

153814. The term " birth - related neurological injury " is defined in section

1550766.302( 2) as:

1553injury to the brain or spinal cord of a live infant

1564weighing at least 2,500 grams for a single gestation

1574. . . caused by oxygen deprivation or mechanical

1583injury occurring in the course of labor, delivery, or

1592resuscitation in the immediate postdelive ry period

1599in a hospital, which renders the infant permanently

1607and substantially mentally and physically

1612impaired.

161315. " The [NICA] Statute is written in the conjunctive and can only be

1626interpreted to require permanent and substantial impairment that has bo th

1637physical and mental elements. " Fla. Birth - Related Neurological Injury Comp.

1648Ass ' n v. Fla. Div. of Admin. Hearings , 686 So. 2d 1349, 1356 (Fla. 1997).

16641 6 . In reviewing the injury in this matter, the preponderance of the

1678evidence does not establish that T obias sustained a " birth - related

1690neurological injury " as defined in section 766.302(2). Both Dr. Willis and

1701Dr. Duchowny noted Tobias ' s grave injury. However, they credibly opined

1713that Tobias ' s impairment did not occur during labor, delivery, or

1725resuscitat ion in the immediate postdelivery period. Dr. Willis further

1735remarked that Tobias suffered a stroke prior to delivery due to an occluded

1748right carotid artery.

17511 7 . Therefore, based on all the available evidence in the record, the

1765undersigned determine s that Tobias has not suffered a " birth - related

1777neurological injury " and is not eligible for NICA benefits.

1786D ISPOSITION

1788Based upon the foregoing Findings of Fact and Conclusions of Law, it is

1801O RDERED that the Petition is dismissed, with prejudice.
