121S TATEMENT OF T HE I SSUE S
129The issues for determination are: (1) whether PetitionerÔs housing
138discrimination complaint alleging handicap discrimination against
144Respondents in violation of the Florida Fair Housing Act (ÑFFHAÒ), chapter
155760, part II, Florida Statutes (2020), was timely filed with the Florida
167Commission on Human Relations (ÑFCHRÒ); and (2) whether PetitionerÔs
176Petition for Relief was timely filed with FCHR.
184P RELIMINARY S TATEMENT
188Petitioner, April Dukes (ÑPetitionerÒ), filed a fair housing discrimination
197complaint with FCHR on October 29, 2020. FCHR is a state agency charged
210with investigating fair housing discrimination complaints. After its
218investigation, FCHR issued a ÑNotice of Determination (No Cause)Ò and
228ÑDetermination (Lack of Jurisdiction). Ò The determinati on for lack of
239jurisdiction concluded that PetitionerÔs housing discrimination complaint was
247untimely filed with FCHR ; and , therefore, FCHR did not have jurisdiction
258over PetitionerÔs complaint.
261Dissatisfied with FCHRÔs determinations, Petitioner filed a Petition for
270Relief. On February 26, 2021, FCHR referred this matter to DOAH to assign
283an administrative law judge to conduct the final hearing.
292On March 18, 2021, the undersigned entered an Order setting the final
304hearing for May 10, 2021. The final h earing was held on May 10, 2021, with
320all parties present. Petitioner testified on her own behalf. PetitionerÔs
330Exhibits 1 and 2 were received into evidence. Respondents did not present
342any witnesses. Respondents Ô Composite Exhibits 1 through 3 and Exhibit 4
354were received into evidence. At the hearing, Petitioner made an ore tenus
366motion for continuance, which was opposed by Respondents. The undersigned
376denied the motion at the hearing.
382The one - volume final hearing Transcript was filed at DOAH on June 2,
3962021. The parties timely filed proposed recommended orders, which were
406considered in the preparation of this Recommended Order. Unless otherwise
416indicated, citations to the Florida Statutes and Florida Administrative Code
426Rules are to the 2020 versions.
432F INDINGS OF F ACT
4371. On October 29, 2020, Petitioner filed a fair housing discrimination
448complaint with FCHR, alleging that Respondents, Brennan Realty, Inc.,
457Joseph P. Brennan, Kathleen Brennan, and Thomas Brennan, discriminated
466against her based on a han dicap .
4742. According to her housing discrimination complaint, Petitioner rents an
484apartment at 937 Southwest 5th Street, Ap artment 4, Coral Gables, Florida,
49633134, Ñwhich is subject to rules and regulations of Respondent[,] Brennan
508Realty, Inc., owned by Respondent[,] Thomas Brennan, and Respondent
518Registered Agent Joseph P. Brennan, and landlord Respondent[,] Kathleen
528Brennan.Ò Petitioner alleged that Respondent Brennan Realty, Inc. , sent
537notices for her to vacate the premises after she made a maintenanc e request
551to property owners Kathleen and Joseph Brennan for repairs and a
562reasonable modification to install grab bars inside of her shower to assist her
575and prevent falls. Petitioner further alleged Ñshe provided medical
584documentation to the Respondents which also stated that it is medically
595necessary for [her] to have the grab bars installed as well.Ò Petitioner further
608alleged Respondents Kathleen Brennan and Joseph Brennan Ñstill [have] not
618installed the grab bars and [are] requesting for her to vacate the premises.Ò
631As such, Ñ [Petitioner] believes that Respondents subjected her to
641discriminatory terms and conditions based on her physical disability.Ò
6503. In May 2019, July 2019, and August 2019, Petitioner received notices
662informing her that her lease w ould expire on September 1, 2019; that the
676lease would not be renewed ; and that she needed to vacate and surrender the
690premises by no later than September 1, 2019.
6984. On September 9, 2019, an eviction complaint was filed against
709Petitioner in Miami - Dade C ounty Court. On September 12, 2019, Petitioner
722was served with the eviction complaint.
7285. The persuasive and credible evidence adduced at hearing demonstrates
738that the alleged discriminatory housing practice occurred, at the latest, on
749September 12, 2019, when Petitioner was served with the eviction complaint.
760Accordingly, Petitioner had one year from September 12, 2019, in which to
772file her housing discrimination complaint with FCHR. However, Petitioner
781did not file her complaint with FCHR until October 29 , 2020. Therefore,
793PetitionerÔs housing discrimination complaint was untimely.
7996. Even if PetitionerÔs housing discrimination complaint was timely filed
809with FCHR, her Petition for Relief was not timely filed.
8197. At hearing, Petitioner acknowledged she re ceived FCHRÔs no cause
830determination on January 13, 2021. The no cause determination expressly
840provides that if Petitioner Ñdoes not agree with this determination, [she] may
852request an administrative hearing by filing a Petition for Relief with the
864FCHR wi thin 30 days of the date of service of this Notice.Ò However,
878PetitionerÔs Petition for Relief was not filed with FCHR until February 26,
8902021. Therefore, PetitionerÔs Petition for Relief was untimely.
898C ONCLUSIONS OF L AW
9038. DOAH has personal and subject m atter jurisdiction in this proceeding
915pursuant to sections 120.569 and 120.57(1), Florida Statutes.
9239. The FFHA makes it unlawful to discriminate against any person "in the
936terms, conditions, or privileges of sale or rental of a dwelling, or in the
950provi sion of services or facilities in connection therewith, because of race,
962color, national origin, sex, handicap, familial status, or religion." § 760.23(2),
973Fla. Stat.
97510. The FFHA expressly requires that a complaint alleging a violation of
987the FFHA must be filed within one year after the alleged discriminatory
999housing practice occurred:
1002Any person who files a complaint under subsection
1010(1) must do so within 1 year after the alleged
1020discriminatory housing practice occurred. The
1025complaint must be in writing a nd shall state the
1035facts upon which the allegations of a discriminatory
1043housing practice are based. A complaint may be
1051reasonably and fairly amended at any time. A
1059respondent may file an answer to the complaint
1067against him or her and, with the leave of the
1077commission, which shall be granted whenever it
1084would be reasonable and fair to do so, may amend
1094his or her answer at any time. Both the complaint
1104and the answer must be verified.
1110§ 760.34(2), Fla. Stat.
111411. Petitioner has the burden to demonstrate, by a preponderance of the
1126evidence, that she complied with the time requirements in section 760.34(2).
1137§ 760.34(5), Fla. Stat.; Fla. Dep't of Transp. v. J.W.C. Co. , 396 So. 2d 778 (Fla.
11531st DCA 1981).
115612. A "preponderance of the evidence" means the "greater w eight" of the
1169evidence, or evidence that "more likely than not" tends to prove the fact at
1183issue. Gross v. Lyons , 763 So. 2d 276, 289 n.1 (Fla. 2000).
119513. As detailed above, the evidence adduced at hearing demonstrates that
1206Petitioner did not file her dis criminatory housing complaint with FCHR until
1218October 29, 2020, more than one year after the alleged discriminatory
1229housing practice occurred. Therefore, her complaint is untimely.
123714. Nevertheless, Petitioner argues she ÑfiledÒ her housing discrimination
1246complaint with U.S. Housing and Urban Development (ÑHUDÒ) I ntern Sarah
1257Malkin on September 25, 2019, which , therefore , constitutes a timely filing of
1269her housing discrimination complaint with FCHR. However, Petitioner failed
1278to present persuasive and cred ible evidence that she, in fact, filed a
1291discriminatory housing complaint with HUD. Moreover, no evidence was
1300presented at hearing establishing that HUD notified Respondents of any such
1311purported ÑcomplaintÒ or that HUD forwarded any such purported complai nt
1322to FCHR. Even if Petitioner had, in fact, filed a housing discrimination
1334complaint with HUD on September 25, 2019, which the evidence does not
1346establish, Petitioner cites no authority to support the proposition that such a
1358filing, standing alone, would constitute a timely filed discriminatory housing
1368complaint with FCHR.
137115. Even if Petitioner had timely filed her housing discrimination
1381complaint with FCHR, she failed to timely file her Petition for Relief with
1394FCHR. ÑA complainant may file a Petition f or Relief from a Discriminatory
1407Housing Practice within 30 days of service of Notice of Determination
1418(No Cause) or Notice of Determination (Cause).Ò Fl a. Admin . Code
1430R . 60Y - 8.001(1). As detailed above, Petitioner received FCHRÔs no cause
1443determination on January 13, 2021, but her Petition for Relief was not filed
1456with FCHR until February 26, 2021.
1462R ECOMMENDATION
1464Based on the foregoing Findings of Fact and Conclusions of Law, it is
1477R ECOMMENDED that the Florida Commission on Human Relations enter a
1488final o rder dismissing the Petition for Relief.
