133S TATEMENT OF T HE C ASE
140On April 7, 2021, Petiti oner, Princess Grant, as personal and natural
152guardian of Prince ' Nylan Grant, ( " Prince ' Nylan " ), a minor, filed a Petition for
169Compensation Pursuant to Florida Birth Related Neurological Injury
177Compensation Plan (the " Petition " ) with the Division of Adminis trative
188Hearings ( " DOAH " ) for a determination of compensability under the Florida
200Birth - Related Neurological Injury Compensation Plan (the " Plan " ).
210The Petition identified Eric Edwards, M.D., Neal Trulock, D.O., Kathryn
220Leenhouts, M.D., and Jill Young, APRN, as the healthcare practitioners who
231provided obstetrical services at Prince ' Nylan ' s birth on August 8, 2019, at
246Brandon Regional Hospital ( " Brandon Regional " ) in Brandon, Florida.
256DOAH served Dr. Edwards, Dr. Trulock, Dr. Leenhouts, and Ms. Young
267w ith copies of the Petition on April 20, 2021, and served Brandon Regional
281that same date. DOAH also served Respondent, the Florida Birth - Related
293Neurological Injury Compensation Association ( " NICA " ), with a copy of the
305Petition on April 20, 2021.
310Brando n Regional moved to intervene in this matter on April 30, 2021,
323which was granted.
326On July 2, 2021, NICA filed a Response to Petition taking the position
339that Petitioner ' s claim is compensable under the Plan.
349Petitioner, on September 20, 2021, filed a Notice of Acceptance of NICA ' s
363Finding that Prince ' Nylan Grant Suffered a Birth Related Neurological
374Injury acceding to NICA ' s determination that Prince ' Nylan sustained a
387compensable injury under section 766.302.
392On September 28, 2021, NICA filed an Un opposed Motion for Summary
404Final Order requesting the Administrative Law Judge enter a summary final
415order finding that Petitioner ' s claim is compensable under the Plan because
428Prince ' Nylan suffered a " birth - related neurological injury " as defined in
441secti on 766.302(2), and that Dr. Edwards and Dr. Leenhouts were
" 452participating physicians " pursuant to section 766.302(7). NICA's motion
460represents that neither Petitioner nor Brandon Regional oppose s the relief
471requested.
472F INDINGS OF F ACT
4771. Prince ' Nylan was b orn on August 8, 2019, at Brandon Regional located
492in Brandon, Florida.
4952. Eric Edwards, M.D., and Kathryn Leenhouts, M.D., were the delivering
506physicians for Prince ' Nylan ' s birth at Brandon Regional. At that time, both
521Dr. Edwards and Dr. Leenhouts qualif ied as " participating physicians " in the
533Plan as that term is defined in section 766.302(7).
5423. Petitioner was admitted to Brandon Regional on August 8, 2019, to
554deliver Prince ' Nylan. Petitioner was admitted for spontaneous labor.
5644. After her arriv al at Brandon Regional, Petitioner experienced
574spontaneous rupture of the membranes. At approximately 7:35 p.m. ,
583Petitioner was at category 2 of labor, with fetal monitoring tracing showing
595moderate variability and late decelerations. There was no recorded fetal
605heart rate. The delivery note indicated that tachycardia and late
615decelerations were present prior to birth. The fetal head was delivered with a
628nuchal cord, which was reduced.
6335. Prince ' Nylan weighed 3860 grams (8 pounds, 8.2 ounces) at birth.
6466. During the course of labor, delivery, or resuscitation in the immediate
658postdelivery period, Petitioner asserts that Prince ' Nylan suffered an injury.
669Petitioner subsequently filed the Petition with DOAH to determine whether
679Prince ' Nylan ' s injury qualified as a " birth - related neurological injury " as
694defined in section 766.302(2).
6987. After notification of Petitioner ' s Petition, NICA retained Donald
709Willis, M.D., a board - certified obstetrician/gynecologist specializing in
718maternal - fetal medicine, as well as Lu is E. Bello - Espinosa, M.D., a pediatric
734neurologist, to review Prince ' Nylan ' s medical records and condition. NICA
747sought to determine whether Prince ' Nylan suffered a " birth - related
759neurological injury " as defined in section 766.302(2). Specifically, NICA
768r equested its medical consultants opine whether Prince ' Nylan experienced an
780injury to the brain or spinal cord caused by oxygen deprivation or mechanical
793injury which occurred in the course of labor, delivery, or resuscitation in the
806immediate postdelivery period. And, if so, whether this injury rendered
816Prince ' Nylan permanently and substantially mentally and physically
825impaired.
8268. Dr. Willis reviewed Prince ' Nylan ' s medical records and noted:
839[Prince ' Nylan] was depressed at birth. Apgar scores
848were 4/7/7 an d arterial blood gas pH was 7.19 with
859a base excess of - 13. The newborn was floppy with
870poor tone, weak cry and clinically poor perfusion.
878The baby did not respond to stimulation.
885* * *
888The newborn hospital course was complicated by
895multi - system organ failures. È Seizure activity
903began after re - warming. Respiratory distress
910worsened, requiring nitric oxide for pulmonary
916hypertension. The baby was extubated on DOL 7.
924* * *
927Head ultrasound on DOL 1 was normal. MRI on
936DOL 8 showed acute ischemic change s, consistent
944with HIE. [ 1 ] After hospital discharge, the child was
955subsequently diagnosed with global developmental
960delay and visual loss.
964* * *
967The child ' s brain injury appears to be the result of
979birth related oxygen deprivation, with or without
986any contribution due to possible infection.
992* * *
995In summary, labor was complicated by an abnormal
1003[fetal heart rate] pattern and resulted in a
1011depressed newborn. È Despite cooling protocol for
1018HIE, the newborn hospital course was complicated
1025by multi - syst em organ failures, including
1033hypotension, oliguria, feeding difficult [sic],
10381 Hypoxic - i schemic e ncephalopathy .
1046respiratory distress and seizures. MRI on DOL 8
1054showed acute ischemia, consistent with HIE.
1060Cerebral palsy and global developmental delay
1066were diagnosed after hospital discharge.
10719. Based on his review of the medical records, Dr. Willis opined that:
1084[T]here was an obstetrical event that resulted in
1092loss of oxygen to the baby ' s brain during labor,
1103delivery and continuing into the immediate post -
1111delivery period. The oxygen depriva tion resulted in
1119brain injury.
1121Dr. Willis, however, was " unable to comment on the severity of the brain
1134injury. "
113510. Dr. Bello - Espinosa, on the other hand, did offer an opinion as to the
1151extent of Prince ' Nylan ' s injury. Dr. Bello - Espinosa reviewed Princ e ' Nylan ' s
1170medical records, as well as conducted an independent medical examination
1180( " IME " ) of Prince ' Nylan on June 18, 2021. Dr. Bello - Espinosa observed,
1196within a reasonable degree of medical probability:
1203Prince was awake and alert but did not interact at
1213all. He did not have any joint attention. He was
1223constantly fussing. There was no structured
1229language. He did not communicate verbally or non -
1238verbally.
1239* * *
1242Functionally, Prince sat on his own power, but with
1251poor truncal tone. Prince did not bear we igh [sic]
1261when he was placed in the standing position, and
1270did not walk.
1273* * *
1276SUMMARY:
1277* * *
1280On the examination today is evident that Prince
1288has severe neurological sequela. At 22 - month of
1297age, Prince has severe developmental language and
1304motor d elays. He has delays of cortical abilities
1313manifested by no expressive language, and does not
1321appear to have severe impaired receptive language.
1328On his motor exam has moderate axial hypotonia
1336with poor head and truncal control, moderate
1343hypertonia in both arms and legs, intermittent
1350abnormal ha n d fisting, and dystonic posturing of
1359hand and feet. These signs are indicative of
1367extrapyramidal dysfunction, resulting in a severe
1373degree of dystonic quadriparetic cerebral palsy.
137911. Dr. Bello - Espinosa ultimately opined that based on the IME, " Prince is
1393found to have substantial mental and physical impairment at this time. " He
1405also found that Prince ' s " substantial mental and physical impairments are
1417permanent. " Finally, Dr. Bello - Espinosa concluded, " I do feel that there is
1430enough evidence to recommend Prince is included in the NICA program. "
144112. Based on the opinions of Dr. Willis and Dr. Bello - Espinosa, NICA
1455determined that Petitioner ' s claim is compensable under section 766.302(2).
146613. A review of the documents in the record reveals no contrary evidence
1479to dispute the findings and opinions of Dr. Willis and Dr. Bello - Espinosa .
1494Their opinions are credible and persuasive.
150014. Based on " all available evidence " in the record, Prince ' Nylan suffered a
1514brain injury duri ng labor, delivery, or resuscitation in the immediate
1525postdelivery period that meets the requirements for compensation under
1534section 766.309(1). Accordingly, Prince ' Nylan is eligible for an award of NICA
1547benefits under the Plan.
1551C ONCLUSIONS OF L AW
155615. The Division of Administrative Hearings has jurisdiction over the
1566parties and the subject matter of this proceeding pursuant to sections
1577766.301 through 766.316. The undersigned, as an Administrative Law Judge
1587( " ALJ " ), has " exclusive jurisdiction to determine whether a claim filed under
1600NICA is compensable. " §§ 766.301(1)(d), 766.304, and 766.311(1), Fla. Stat.
161016. T he Florida Legislature created the Plan as a means to alleviate the
1624high costs of medical malpractice insurance for physicians practicing
1633obstetri cs. Bennett v. St. Vincent ' s Med. Ctr., Inc. , 71 So. 3d 828, 836 (Fla.
16502011); and Univ. of Miami v. Ruiz , 164 So. 3d 758, 764 (Fla. 3d DCA 2015).
1666The Plan ' s purpose is to " provid[e] compensation, irrespective of fault, for
1679birth - related neurological injury claims. " § 766.303(1), Fla. Stat.
168917. To seek compensation under the Plan, a legal representative on behalf
1701of an injured infant files a claim with DOAH. §§ 766.302(3) and 766.305(1),
1714Fla. Stat. NICA, which administers the Plan, then has " 45 days from the date
1728of service of a complete claim È in which to file a response to the petition and
1745to submit relevant written information relating to the issue of whether the
1757injury is a birth - related neurological injury. " § 766.305(4), Fla. Stat.
176918. If NICA determin es that the injury is a compensable birth - related
1783neurological injury, it may award compensation to the claimant, provided
1793that the award is approved by the ALJ to whom the claim has been assigned.
1808§ 766.305(7), Fla. Stat.
181219. When considering whether a claim is compensable under the Plan,
1823section 766.309(1) charges the ALJ to make the following determinations
" 1833based upon all available evidence " :
1839(a) Whether the injury claimed is a birth - related
1849neurological injury. If the claimant has
1855demonstrated, to th e satisfaction of the
1862administrative law judge, that the infant has
1869sustained a brain or spinal cord injury caused by
1878oxygen deprivation or mechanical injury and that
1885the infant was thereby rendered permanently and
1892substantially mentally and physically imp aired, a
1899rebuttable presumption shall arise that the injury
1906is a birth - related neurological injury as defined in
1916s. 766.302(2).
1918(b) Whether obstetrical services were delivered by a
1926participating physician in the course of labor,
1933delivery, or resuscitation in the immediate
1939postdelivery period in a hospital; or by a certified
1948nurse midwife in a teaching hospital supervised by
1956a participating physician in the course of labor,
1964delivery, or resuscitation in the immediate
1970postdelivery period in a hospital; and
1976(c) How much compensation, if any, is awardable
1984pursuant to s. 766.31.
1988(d) Whether, if raised by the claimant or other
1997party, the factual determinations regarding the
2003notice requirements in s. 766.316 are satisfied. The
2011administrative law judge has the exclusive
2017jurisdiction to make these factual determinations.
202320. The term " birth - related neurological injury " is defined in section
2035766.302(2) as:
2037[I] njury to the brain or spinal cord of a live infant
2049weighing at least 2,500 grams for a single gestation
2059... caused by oxygen deprivation or mechanical
2066injury occurring in the course of labor, delivery, or
2075resuscitation in the immediate postdelivery period
2081in a hospital, which renders the infant permanently
2089and substantially mentally and physically
2094impaired.
209521. The NICA statute is written in the conjunctive and can only be
2108interpreted to require " permanent and substant ial impairment that has both
2119physical and mental elements. " Fla. Birth - Related Neurological Injury Comp.
2130Ass ' n v. Fla. Div. of Admin. Hearings , 686 So. 2d 1349, 1356 (Fla. 1997).
214622. If a claim qualifies for compensation, section 766.31(1) lists the
2157expens es and payments the ALJ shall award " [u]pon determining that an
2169infant has sustained a birth - related neurological injury and that obstetrical
2181services were delivered by a participating physician at the birth. "
219123. The burden of proof in this matter falls on Petitioner, as the
" 2204claimant, " to prove that Prince ' Nylan is covered by the NICA Plan.
2217§ 766.302 , Fla. Stat., and Balino v. Dep ' t of Health & Rehab. Servs. , 348 So.
22342d 349, 350 (Fla. 1st DCA 1977) ( " The general rule is, that as in court
2250proceedings, the burden of proof, apart from statute, is on the party asserting
2263the affirmative of an issue before an administrative tribunal. " ). If Petitioner
2275demonstrates the statutory prerequisites for NICA benefits, a rebuttable
2284presumption of compensation arises in th eir favor. Bennett , 71 So. 3d at 845;
2298and Fla. Health Scis. Ctr., Inc. v. Div. of Admin. Hearings , 974 So. 2d 1096,
23131099 (Fla. 2d DCA 2007).
231824. The preponderance of the evidence standard is applicable to this
2329matter. See § 120.57(1)(j), Fla. Stat.
233525. T urning to the injury in this case, the competent substantial evidence
2348establishes that Prince ' Nylan suffered a " birth - related neurological injury " as
2361defined in section 766.302(2). Dr. Willis, following his review of the medical
2373records, concluded that Pri nce ' Nylan experienced oxygen deprivation during
2384his birth, which resulted in brain injury. Dr. Willis was not able to assess the
2399severity of Prince ' Nylan ' s brain injury. However, Dr. Bello - Espinosa
2413persuasively opined that Prince ' Nylan sustained substantia l mental and
2424physical impairments, which are permanent. Dr. Willis ' s and Dr. Bello -
2437Espinosa ' s opinions are credited. Accordingly, based on the evidence in the
2450record, the undersigned determines that Prince ' Nylan suffered a " birth -
2462related neurological injur y. "
246626. In conclusion, the evidence in the record establishes that Petitioner ' s
2479claim meets the statutory requirements for compensability under the Plan.
2489Prince ' Nylan suffered a " birth - related neurological injury " during the course
2502of the labor, delivery, or resuscitation in the immediate postdelivery period as
2514described in section 766.302(2). The evidence further shows that the
2524obstetrical services provided at Prince ' Nylan ' s birth were delivered by a
" 2538participating physician " as defined in section 766.302 (7). Accordingly,
2547Prince ' Nylan is eligible for an award of NICA benefits under section 766.31.
2561D ISPOSITION
2563Based upon the foregoing Findings of Fact and Conclusions of Law, it is
2576O RDERED :
25791. Petitioner ' s Petition for compensation under the NICA Plan is
2591A PPROVED .
25942. NICA shall make immediate payment of all actual expenses previously
2605incurred, and shall make payment for future expenses as incurred pursuant
2616to section 766.31(1)(a).
26193. Princess Grant, as the parent and natural guardian of Prince ' Nylan, is
2633entitled to the full award authorized under section 766.31(1)(d)1.a.
26424. Petitioner is also entitled to an award of reasonable expenses incurred
2654in connection with the filing of the claim, including reasonable attorney ' s
2667fees, pursuant to section 766.31(1) (e).
26735. T he parties are accorded 45 days from the date of this Final Order to
2689resolve, subject to approval by the Administrative Law Judge, the amount
2700and manner in which any portion of the above - listed award s should be paid.
2716If not resolved within such p eriod, the parties will so advise the
2729Administrative Law Judge, and a hearing will be scheduled to determine
2740such issues.
27426 . Pursuant to section 766.312, the Division of Administrative Hearings
2753retains jurisdiction over this matter to address the amount of an award
2765pursuant to section 766.31, as well as to resolve any disputes regarding the
2778parties ' compliance with the terms of this Final Order.
