92This came before the undersigned on RespondentÔs Motion for Summary
102Final Order (Motion) , filed November 30, 2021. The Motion represents that
113Petitioners do not oppose the relief being sought.
121In its Motion, the Florida Birth - Related Neurological Injury
131Compensation Association (NICA) asserts that in order for a claim to be
143compensable under the Florida Birth - Related Neurological Injury
152Compensation Plan (the Plan), the statutory prerequisites of section 766.309,
162Florida Statutes, must be met, including:
168(1) The administrative law judge shall make the
176following determinations based upon all a vailable
183evidence:
184(a) Whether the injury claimed is a birth - related
194neurological injury . . .
199* * *
202(2) If the administrative law judge determines that
210the injury alleged is not a birth - related neurological
220injury . . ., she or he shall enter an orde r . . . .
236(emphasis added).
238The term Ñbirth - related neurological injuryÒ is defined in section
249766.302(2) as:
251(2) ÑBirth - related neurological injuryÒ means
258injury to the brain or spinal cord of a live infant
269weighing at least 2,500 grams for a single gestation
279or, in the case of a multiple gestation, a live infant
290weighing at least 2,000 grams at birth caused by
300oxyg en deprivation or mechanical injury occurring
307in the course of labor, delivery, or resuscitation in
316the immediate postdelivery period in a hospital,
323which renders the infant permanently and
329substantially mentally and physically impaired.
334This definition sh all apply to live births only and
344shall not include disability or death caused by
352genetic or congenital abnormality. (emphasis
357added).
358F INDINGS OF F ACT
3631. On March 31, 2021, Petitioners filed a Petition for Benefits Pursuant to
376Florida Statute Section 766 .301 et seq. for benefits pursuant to sections
388766.301 - 766.316, otherwise known as the Plan.
3962. The baby was born on May 5, 2020, at North Florida Regional Medical
410Center (Hospital), located in Gainesville, Florida. The circumstances of the
420labor, del ivery, and birth of the minor child are reflected in the medical
434records provided by NICA in response to the Petition.
4433. In the instant case, NICA has retained Donald C. Willis, M.D., as its
457medical expert specializing in maternal - fetal medicine. Dr . WillisÔs medical
469report was filed with the Division of Administrative Hearings (DOAH) on
480June 4, 2021. Upon examination of the pertinent medical records, Dr. Willis
492opined:
493In summary, labor was complicated by a non -
502reassuring FHR pattern prior to birth. However,
509the baby was not depressed at birth with Apgar
518scores of 7/8. Umbilical cord blood pH was >7.0 and
528base excess was <12. resuscitation="">12.>
531stimulation and CPAP supplemental oxygen. The
537baby was transferred from delivery to the Well
545Baby Nurse ry. Seizure activity was observed on
553DOL 2, but may have been present since birth
562according to motherÔs observations. EEG was
568consistent with encephalopathy and MRI findings
574concerning for hypoxic brain injury.
579Multi - system organ failures are generally se en with
589birth - related hypoxic injuries. However, this child
597did not suffer multi - system organ failures,
605suggesting the brain injury was not related [or] due
614to oxygen deprivation at birth.
619There was no apparent obstetrical event that
626resulted in brain inj ury due to loss of oxygen or
637mechanical trauma during labor, delivery or the
644immediate post - delivery period.
6494. Additionally, NICA retained Raj D. Sheth, M.D., as its medical expert
661specializing in Pediatric Neurology. Dr. ShethÔs medical report was also filed
672with DOAH on June 4, 2021. Upon examination of the pertinent medical
684records and performance of an independent medical examination, Dr. Sheth
694opined:
695In SUMMARY, JosephÔs neurological examination
700reflected mild delays in gross motor with scoot ing
709with left leg underneath him. He had no evidence of
719spasticity. His history and neonatal records
725indicated seizures and evidence of hypoxic ischemic
732encephalopathy, although the cause does not
738appear to be related to oxygen deprivation or
746mechanical in jury occurring during labor, delivery
753or immediate post - delivery period.
759At the time of this examination and evaluation
767JosephÔs case indicates that he does not have
775substantial and permanent mental impairment and
781does not have substantial physical impair ment. As
789such, Joseph Gibson would not qualify for
796compensation under the NICA program.
8015. The medical reports of Dr. Willis and Dr. Sheth are the only evidence of
816record relating to the issue of whether the subject claim is compensable as
829defined by the statute. The Petition, along with the unrebutted medical
840reports of Dr. Willis and Dr. Sheth, establishes that there are no genuine
853issues of material fact regarding the compensability of this claim.
863C ONCLUSIONS OF L AW
8686. DOAH has jurisdiction over th e parties to and the subject matter of
882these proceedings. §§ 766.301 - 766.316, Fla. Stat.
8907. The Plan was established by the Legislature Ñfor the purpose of
902providing compensation, irrespective of fault, for birth - related neurological
912injury claimsÒ re lated to births occurring on or after January 1, 1989.
925§ 766.303(1), Fla. Stat.
9298. An injured infant, his or her personal representative, parents,
939dependents, and next of kin may seek compensation under the Plan by filing
952a claim for compensation with DOAH. §§ 766.302(3), 766.303(2), and
962766.305(1), Fla. Stat. Section 766.305(4) provides that NICA, which
971administers the Plan, has 45 days from the date that a complete claim is
985served to file a response to the petition and to submit relevant written
998info rmation relating to the issue of whether the injury is a birth - related
1013neurological injury.
10159. If NICA determines that the alleged injury is a birth - related
1028neurological injury that is compensable under the Plan, it may award
1039compensation to the claim ant, provided that the award is approved by the
1052assigned administrative law judge. § 766.305(7), Fla. Stat. However, if NICA
1063disputes the claim, as it does in this case, the dispute must be resolved by the
1079assigned administrative law judge in accordance wi th chapter 120, Florida
1090Statutes. §§ 766.304, 766.30, and 766.31, Fla. Stat.
109810. The first inquiry is whether the infant has sustained a birth - related
1112neurological injury as defined by section 766.302(2), which provides:
1121ÑBirth - related neurological in juryÒ means injury to
1130the brain or spinal cord of a live infant weighing at
1141least 2,500 grams for a single gestation or, in the
1152case of amultiple gestation, a live infant weighing
1160at least 2,000 grams at birth caused by oxygen
1170deprivation or mechanical inj ury occurring in the
1178course of labor, delivery, or resuscitation in the
1186immediate postdelivery period in a hospital, which
1193renders the infant permanently and substantially
1199mentally and physically impaired . This definition
1206shall apply to live births only an d shall not include
1217disability or death caused by genetic or congenital
1225abnormality. (emphasis added).
122811. If the administrative law judge determines that the infant meets the
1240statutory threshold for weight and has sustained a brain or spinal cord in jury
1254caused by oxygen deprivation or mechanical injury, and that as a result of the
1268injury the infant was rendered permanently and substantially mentally and
1278physically impaired, then section 766.309(1) provides that there is a
1288rebuttable presumption that the injury is a birth - related neurological injury.
130012. In this case, the evidence does not support a finding that the injury is
1315a birth - related neurological injury. This issue is dispositive with respect to
1328compensability. Based upon this evidence, Jo seph Gibson, Jr. , did not sustain
1340a birth - related neurological injury as defined in section 766.302(2), and is not
1354eligible for benefits under the Plan.
1360C ONCLUSION
1362Based upon the Findings of Fact and Conclusions of Law provided above,
1374PetitionersÔ claim i s not compensable under the Plan, and the Petition is
1387dismissed with prejudice.
