136S TATEMENT OF T HE C ASE
143On April 13, 2021, Petitioners , Lillian Hen derson and Nicky Raines,
154on behalf of and as parents and natural guardians of Jack Raines (Jack),
167a minor, filed a Petition for Benefits Pursuant to Florida Statute
178Section 766.301 et seq. (Petition) with the Division of Administrative
188Hearings (DOAH) f or a determination of compensability under the Florida
199Birth - Related Neurological Injury Compensation Plan (Plan).
207The Petition identified Anthony Agrios, M.D., as the physician who
217provided obstetric services at the birth of Jack on October 24, 2019, at North
231Florida Regional Medical Center, located in Alachua County, Florida. The
241Petition also alleges, inter alia , that Jack does not appear to be Ñpermanently
254and substantially mentally and physically impaired , Ò and thus would not be
266qualified for NICA be nefits.
271DOAH served Dr. Agrios, North Florida Regional Medical Center, and
281NICA with a copy of the Petition on April 20, 2021.
292On June 4, 2021, NICA filed a Response to Petition for Benefits, which
305stated its determination that the instant claim is not compensable as the
317injury does not meet the definition of a Ñbirth - related neurological injury , Ò as
332defined in section 766.302(2), Florida Statutes (2019). On August 3, 2021, the
344parties filed a Joint Notice of Compliance, which stated that the parties did
357not contest the compensability determination that NICA reached in its
367Response to Petition for Benefits.
372On September 8, 2021, the undersigned conducted a telephonic status
382conference to determine the need for a hearing, if any, and if a hearing is
397neede d, when the parties will be prepared to proceed to a hearing, the issues
412in dispute, the estimate of time required for hearing, and the choice of venue.
426The parties indicated that a hearing was not necessary.
435On September 27, 2021, NICA filed its Motion for Summary Final Order
447(Motion). Petitioners did not file a response to the Motion within the seven -
461day time period for a response set forth in Florida Administrative Code Rule
47428 - 106.204(4). The Motion further indicates that Petitioners and Intervenors
485d o not intend to oppose the Motion.
493F INDINGS O F F ACT
4991. Jack was born on October 24, 2019, at North Florida Regional Medical
512Center, located in Alachua County, Florida.
5182. Donald Willis, M.D. (Dr. Willis), was requested by NICA to review the
531medical reco rds for Jack. In a medical report dated April 26, 2021, Dr. Willis
546summarized his findings and opined, in pertinent part, as follows:
556In summary, delivery was complicated by a failed
564forceps delivery, which resulted in a depressed
571skull fracture with unde rlying brain injury. EEG
579was consistent with seizure activity occurring from
586the area of brain injury underlying the skull
594fracture. MRI was also consistent with brain injury.
602There was an obstetrical event that resulted in
610mechanical trauma to the babyÔs brain during
617delivery. The head trauma resulted in a skull
625fracture to the underlying brain tissue. I am unable
634to comment about the severity of the injury.
6423. NICA retained Raj D. Seth, M.D. (Dr. Seth), a medical expert
654specializing in pediatric neurolo gy, to examine Jack and to review his medical
667records. Dr. Seth examined Jack on June 1, 2021. In a medical report dated
681June 1, 2021, Dr. Seth summarized his examination of Jack and opined, in
694pertinent part, as follows:
698In SUMMARY, Jack RainesÔs neurolo gical
704examination reveals evidence of expressive
709language delay, with good comprehension and
715apparent normal processing of language. His
721neurologic examination is normal for age.
727Much of JackÔs neonatal course was detailed in the
736history of present illnes s. He was born after a failed
747forceps delivery with a complication of a left
755parietal depressed fracture requiring neurosurgical
760intervention. He presented with neonatal seizures
766which responded well to Keppra and he has been
775successfully weaned off Keppra . CT head and MRI
784scans indicated a left parietal depressed fracture
791with changes in the left basal ganglia. He does not
801have neurological deficits as of this examination
808and his development is normal.
813In response to your question:
818ÑDoes the child suffer from both a substantial
826mental impairment and a substantial physical
832impairment?
833As of the time of this examination and evaluation
842JackÔs case indicates that he does not suffer from
851either substantial mental or substantial physical
857impairment.
8584. A revie w of the file in this case reveals that there have been no expert
875opinions filed that are contrary to Dr. SethÔs opinion that Jack should not be
889considered for inclusion in the NICA program. Dr. SethÔs opinion is credited.
901C ONCLUSIONS O F L AW
9075. DOAH has j urisdiction over the parties to and the subject matter of
921these proceedings. §§ 766.301 - 766.316, Fla. Stat.
9296. The Legislature established the Plan Ñfor the purpose of providing
940compensation, irrespective of fault, for birth - related neurological injury
950cl aimsÒ relating to births occurring on or after January 1, 1989. £ 766.303(1),
964Fla. Stat.
9667. The injured infant, her or his personal representative, parents,
976dependents, and next of kin may seek compensation under the Plan by
988filing a claim for compensatio n with DOAH. §§ 766.302(3), 766.303(2),
999and 766.305(1), Fla. Stat. NICA, which administers the Plan, has Ñ45 days
1011from the date of service of a complete claim . . . in which to file a response to
1030the petition and to submit relevant written information rel ating to the issue
1043of whether the injury is a birth - related neurological injury.Ò £ 766.305(4),
1056Fla. Stat.
10588. If NICA determines that the injury alleged in a claim is a compensable
1072birth - related neurological injury, it may award compensation to the claima nt,
1085provided that the award is approved by the administrative law judge to
1097whom the claim has been assigned. § 766.305(7), Fla. Stat. If, on the other
1111hand, NICA disputes the claim, as it has in the instant case, the dispute
1125must be resolved by the assigne d administrative law judge in accordance
1137with the provisions of chapter 120, Florida Statutes. §§ 766.304, 766.309,
1148and 766.31, Fla. Stat.
11529. In discharging this responsibility, the administrative law judge must
1162make the following determination based upo n the available evidence:
1172(a) Whether the injury claimed is a birth - related
1182neurological injury. If the claimant has
1188demonstrated, to the satisfaction of the
1194administrative law judge, that the infant has
1201sustained a brain or spinal cord injury caused by
1210o xygen deprivation or mechanical injury and that
1218the infant was thereby rendered permanently and
1225substantially mentally and physically impaired, a
1231rebuttable presumption shall arise that the injury
1238is a birth - related neurological injury as defined in
1248s. 766 .303(2).
1251(b) Whether obstetrical services were delivered by a
1259participating physician in the course of labor,
1266delivery, or resuscitation in the immediate
1272postdelivery period in a hospital; or by a certified
1281nurse midwife in a teaching hospital supervised by
1289a participating physician in the course of labor,
1297delivery, or resuscitation in the immediate
1303postdelivery period in a hospital.
1308§ 766.309(1), Fla. Stat. An award may be sustained only if the administrative
1321law judge concludes that the Ñinfant has su stained a birth - related
1334neurological injury and that obstetrical services were delivered by a
1344participating physician at birth.Ò £ 766.31(1), Fla. Stat.
135210. Section 766.302(2) defines the term Ñbirth - related neurological injuryÒ
1363as follows:
1365ÑBirth - relat ed neurological injuryÒ means injury to
1374the brain or spinal cord of a live infant weighing at
1385least 2,500 grams for a single gestation or, in the
1396case of a multiple gestation, a live infant weighing
1405at least 2,000 grams at birth caused by oxygen
1415deprivatio n or mechanical injury occurring in the
1423course of labor, delivery, or resuscitation in the
1431immediate postdelivery period in a hospital, which
1438renders the infant permanently and substantially
1444mentally and physically impaired.
144811. To be compensable under t he Plan, there must have been an
1461obstetrical event which resulted in loss of oxygen to the babyÔs brain during
1474labor, delivery, or resuscitation in the immediate post - delivery period
1485resulting in a permanent and substantial mental impairment and a
1495permanen t and substantial physical impairment, inasmuch as both are
1505required to establish compensability. Fla. Birth - Related Neurological Injury
1515Comp. AssÔn v. Div. of Admin. Hearings , 686 So. 2d 1349 (Fla. 1997).
15281 2 . The evidence, which the parties do not refute, established that Jack
1542did not suffer a birth - related neurological injury under the definition of
1555section 766.302(2). Therefore, Jack is not eligible for benefits under the Plan.
1567C ONCLUSION
1569Based on the Findings of Fact and the Conclusions of Law, it is
1582O RDERED that:
1585The Petition filed by Lillian Henderson and Nicky Raines, on behalf of
1597and as parents and natural guardians of Jack Raines, a minor, is D ISMISSED
1611with prejudice.
