235F INDINGS OF FACT
239Based upon the Stipulation and Joint Petition, the u ndersigned makes the
251following Findings of F act:
2561. Petitioners are the parents of Kyrie and are the Ñclaimants,Ò as defined
270in section 766.302(3), Florida Statutes .
2762. Kyrie suffered a Ñbirth - related neurological injuryÒ (ÑInjuryÒ), as defined
288in section 766.302(2), on or about March 23, 2020 .
2983. At birth, Kyrie weighed in excess of 2,500 grams.
3094. Angela Lenchinsk i, C.N.M. (ÑMidwife LenchinskiÒ), rendered obstetrical
318services in the delivery of Kyrie under the supervision of Wayne Cohen, M.D.
331Neither Midwife Lenchinski nor Dr. Cohen were participating physicians at
341the time of the delivery. However, Sarasota Memori al HospitalÔs (ÑHospitalÒ)
352OB hospitalist, Francisco Battaglia, M.D., also provided obstetrical services
361in the delivery of Kyrie and was at all material times a Ñparticipating
374physician,Ò as defined in section 766.302(7).
3815. The Hospital , located in Saras ota , Florida, is the Ñhospital,Ò as defined
395in section 766.302(6), where Kyrie was born.
4026. On May 25, 2021 , Petitioners filed a petition seeking compensation
413from NICA, pursuant to section 766.305. The Petition is incorporated herein
424by reference in its e ntirety, including all attachments. Any reference to NICA
437made within that document encompasses, where appropriate, the Florida
446Birth - Related Neurological Injury Compensation Plan (ÑPlanÒ).

466C ONCLUSIONS OF L AW
4717. The Division of Administrative Hearings (ÑD OAHÒ) has jurisdiction over
482the parties and exclusive jurisdiction over the subject matter of these
493proceedings pursuant to section 766.304 .
4998. Pursuant to section 766.305, the presiding administrative law judge
509may approve the settlement of any claim wher e NICA determines that the
522injury is compensable. This is such a case.
530C ONCLUSION
532Based upon the foregoing Findings of Fact and Conclusions of Law, it is

5479 . The Stipulation and Joint Petition, filed on November 17, 2021, is
560approved and t he parties are directed to comply with the provisions thereof.
57310. Petitioners are awarded Two Hundred Fifty Thousand Dollars
582($250,000.00), to be paid as a lump sum, pursuant to section 766.31(1)(d)1.a.
595Petitioners are also awarded payment of benefits as authorized in section
606766.31(1)(a) - (c) , subject to the provisions of paragraph 19 of the Stipulation
619and Joint Petition.
62211. NICA will reimburse Armando T. Lauritano, Esquire, counsel for
632Petitioners, an agreed - upon attorneyÔs fee of Twelve Thousand Five H undred
645Dollars ($12,500.00) and expenses of Three Thousand Seven Hundred and
656Seventy - Eight Dollars and Sixty - One Cents ($ 3,778.61 ), totaling Sixteen
671Thousand Two Hundred and Seventy - Eight Dollars and Sixty - One Cents
684($16,278.61) in full, for services rende red in the filing of this claim.
69812. Upon the payment of the award of $250,000.00, past benefits/expenses,
710and the total attorneyÔs fees and expenses awarded to PetitionersÔ counsel,
721PetitionersÔ claims alleged in their Petition shall be deemed fully sati sfied
733and extinguished, except for NICAÔs continuing obligation to pay future
743expenses as incurred, as required by section 766.31(2).
