82On November 16, 2021, Respondent, Florida Birth - Related Neurological
92Injury Compensation Association (NICA), filed a Motion for Summary Final
102Order, which is due for consideration. The Motion for Summary Final Order
114is unopposed, and relies upon the affidavits of Donald C. Willis, M.D., and
127Raj D. Sheth, M.D., filed December 3, 2021, as well as the reports from b oth
143physicians filed with NICAÔs Response to Petition for Benefits.
152S TATEMENT O F T HE I SSUE
160The issue to be determined is whether the infant, Gianno Knight
171(Gianno), suffered a birth - related neurological injury as that term is defined
184in section 766.302(2) , Florida Statutes (2019).
190P RELIMINARY S TATEMENT
194On July 1, 2021, Shyany Knight and Gudiel Juarez Aguilar, as parents
206and natural guardians of Gianno, filed a Petition for Benefits Pursuant to
218Florida Statute Section 766.301 et seq. , on behalf of Gianno, seeking a
230determination of compensability under the Florida Birth - Related
239Neurological Injury Compensation Plan (Plan). The Petition named Todd
248Rasner, M.D., as the physician providing obstetrical services and Baptist
258Medical Center South as the hospital w here Gianno was born on
270May 29, 2020.
273NICA, Dr. Rasner, and Baptist Medical Center South were served with
284the Petition by certified mail on July 1 3, 2021. Certified mail return receipts
298were received indicating service on each of them.
306On August 23, 202 1, NICA filed a response to the Petition, asserting that,
320based on the review of the medical records provided; the independent medical
332examination performed ; and the expert medical reports prepared based on
342the records and the examination, Gianno did not s uffer a birth - related
356neurological injury as that term is defined in section 766.302(2) .
367Petitioner s did not respond to the Motion for Summary Final Order, and
380the Motion represents that Petitioners do not intend to challenge NICAÔs
391position on compensabi lity.
395F INDINGS O F F ACT
4011. Gianno was born May 29, 2020, at Baptist Medical Center South.
4132. Neither party disputes that Dr. Rasner was a participating physician in
425the NICA program at the time of GiannoÔs birth.
4343. Dr. Donald C. Willis is a physician boa rd - certified in obstetrics and
449gynecology and maternal - fetal medicine. He reviewed the medical records
460related to GiannoÔs birth, and prepared a report for NICA based on his
473review . By affidavit filed December 3, 2021, Dr. Willis affirmed that the
486opinions contained in his report are based on a reasonable degree of medical
499probability.
5004. Dr. WillisÔs report includes the following summary:
508In summary, labor was induced for fetal
515macrosomia . Vacuum and forceps were used to
523assist vaginal delivery. Delivery w as complicated
530by shoulder dystocia. Apgar scores were 1/8. The
538baby suffered a fractured humerus, unilateral
544paralysis of the diaphragm, subdural hemorrhage
550and subgaleal hemorrhage related to birth.
556Expanding subgaleal hemorrhage resulted in blood
562loss a nd hypotension. The newborn hospital course
570was complicat ed by multisystem organ failures,
577consistent with birth related oxygen deprivation.
583MRI on DOL 3 was read by Neuro - Radiology as
594normal. Despite the above complicated newborn
600hospital course, it does not appear the birth - related
610complications resulted in identifiable brain injury.
616There was an obstetrical even t that resulted in
625some degree of oxygen deprivation during delivery
632and continuing into the i mmediate post delivery
640period. Fortunately, based on available medical
646records, it does not appear that the oxygen
654deprivation result[ed] in identifiable brain injury.
6605. At NICAÔs request, Gianno was examined by Rash D. Sheth, M.D., a
673board - certified pediatric neurologist. Dr. ShethÔs report was submitt ed with
685NICAÔs response to the Petition, and in his affidavit filed December 3, 2021,
698Dr. Sheth affirmed that the opinions expressed in the report are within a
711reasonable degree of medical certainty.
7166. The summary in Dr. ShethÔs report states the followi ng in pertinent
729part:
730In response to your question:
7351. ÑDoes the child suffer from both a substantial
744mental impairment and a substantial physical
750impairment?Ò
752As of the time of this examination [when Gianno
761was 14 months old] and evaluation GiannoÔs case
769indicates that he does suffer from a right ErbÔs palsy
779[as] a direct result of delivery with shoulder
787dystocia. Additionally, he sustained a left humeral
794fracture that has healed well and is not expected to
804be a source of limitation. The Erbs palsy is
813per manent and surgical remedies for this are likely
822to have limited success. Regarding, su rgery there is
831a optimal time window for his evaluation and
839surgery as well mother is in the process of
848evaluating this. With regards to hypoxic ischemic
855encephalopathy the evidence suggest[s] that he did
862sustain hypoxic ischemic encephalopathy although
867did not sustain neonatal seizures. È He did not
876meet the criteria for brain cooling. In addition to
885this he has an expressive language delay and gross
894motor delay as descr ibed above. Taken together,
902Gianno Knight sustained substantial physical
907impairment with some additional mental
912impairment.
9132. In response to your question Ñmental and physical
922impairments likely to be permanent?Ò
928As of the time of this examination his p hysical
938impairment is likely to be permanent as a result of
948his right Erbs palsy.
9523. In response to your question ÑAre such permanent
961and substantial mental and physical impairments
967consistent with an injury to the brain acquired due
976to oxygen deprivation or mechanical injury
982occurring during labor delivery or the immediate
989post delivery period?Ò
993Based on the nature of his left humeral fracture and
1003right Erbs palsy which resulted from a vaginal
1011delivery by forceps for a shoulder dystocia his
1019findings are consistent with birth - related trauma
1027that resulted directly in the right ErbÔs palsy. He
1036also suffered mild hypoxic ischemic encephalopathy
1042with resulting delays as described above.
1048As such, Gianno KnightÔs case would not meet the
1057criteria for compensati on under the NICA program.
10657. Taken together, Dr. WillisÔs and Dr. ShethÔs opinions indicate that
1076while there was a birth - related injury that caused some level of physical and
1091mental injury, it does not appear that the injuries meet the definition of a
1105bi rth - related neurological injury as defined by section 766.302(2).
1116C ONCLUSIONS O F L AW
11228. The Division of Administrative Hearings ( DOAH ) has jurisdiction over
1134the parties and the subject matter of these proceedings pursuant to sections
1146120.569, 120.57(1), a nd 766.304, Florida Statutes (2021).
11549. The Legislature established the Plan Ñfor the purpose of providing
1165compensation, irrespective of fault, for birth - related neurological injury
1175claimsÒ related to births occurring on or after January 1, 1989. £ 766.30 3(1),
1189Fla. Stat.
119110. An injured infant and certain other statutorily - identified people,
1202including the infantÔs parents, may seek compensation under the Plan by
1213filing a claim for compensation with DOAH. §§ 766.302(3), 766.303(2), and
1224766.305(1), Fla. Stat. Section 766.305(4) provides that NICA, which
1233administers the Plan, has 45 days from the date that a complete claim is
1247served to file a response to the petition and to submit relevant written
1260information related to whether the child has suffered a birth - re lated
1273neurological injury.
127511. If NICA determines that there is a birth - related neurological injury
1288that is compensable under the Plan, it may award compensation to the
1300claimant, provided that the award is approved by the assigned
1310administrative law judge . § 766.305(7), Fla. Stat. If NICA disputes the claim,
1323as it does in this case, the dispute must be resolved by the administrative law
1338judge in accordance with chapter 120. §§ 766.304, 766.30, and 766.31,
1349Fla. Stat.
135112. The initial inquiry is whether the i nfant has suffered a birth - related
1366neurological injury as that term is defined in section 766.302(2), which
1377provides:
1378(2) ÑBirth - related neurological injuryÒ means injury
1386to the brain or spinal cord of a live infant weighing
1397at least 2,500 grams for a sin gle gestation or, in the
1410case of a multiple gestation, a live infant weighing
1419at least 2,000 grams at birth caused by oxygen
1429deprivation or mechanical injury occurring in the
1436course of labor, delivery, or in resuscitation in the
1445immediate postdelivery peri od in a hospital, which
1453renders the infant permanently and substantially
1459mentally and physically impaired. This definition
1465shall apply to live births only and shall not include
1475disability or death caused by genetic or congenital
1483abnormality.
148413. If the ad ministrative law judge determines that the infant has
1496sustained a brain or spinal cord injury caused by oxygen deprivation or
1508mechanical injury, and finds that as a result of the injury, the infant is
1522rendered permanently and substantially mentally and phy sically impaired,
1531then section 766.309(1) provides a rebuttable presumption that the injury is a
1543birth - related neurological injury.
154814. The evidence presented, through the physician reports and affidavits,
1558do es not establish a birth - related injury as secti on 766.302(2) defines that
1573term. First, while Dr. Willis concludes there was an obstetrical event that
1585caused some deprivation of oxygen, he finds that the records do not appear to
1599support an identifiable brain injury. Similarly, although Dr. Sheth reports
1609that the child has ErbÔs palsy associated with shoulder dystocia, he does not
1622report that this injury, while permanent, is the result of any spinal or brain
1636injury. Finally, w hile developmental delays for a 14 - month old are reported,
1650there is no indicatio n that these delays constitute permanent deficits of the
1663type that would meet the definition provided in section 766.302(2).
1673Accordingly, it is concluded that Gianno did not suffer a birth - related
1686neurological injury and is not eligible for benefits under the Plan.
1697C ONCLUSION
1699Based on the Findings of Fact and Conclusions of Law, NICAÔs Motion for
1712Summary Final Order is G RANTED . PetitionerÔs claim for benefits under the
1725Plan is dismissed.
