126Compensation Association (NICA), on October 14, 2021.
133S TATEMENT OF T HE C ASE
140On July 26, 2021, Petitioners , Tania M. Russo and China Bailey,
151in dividually and as parents and next friends of Knox Russo (Knox), a minor,
165filed a Petition for Benefits Pursuant to Florida Statute Section 766.301 et
177seq. (Petition) with the Division of Administrative Hearings (DOAH) for a
188determination of compensability under the Florida Birth - Related
197Neurological Injury Compensation Plan (Plan).
202The Petition identified Tamara Richards, M.D., as the physician who
212provided obstetric services at the birth of Knox on January 8, 2020, at
225Orlando Health South Lake Hospital , located in Lake County, Florida.
235DOAH served Dr. Richards, Orlando Health South Lake Hosptial, and
245NICA with a copy of the Petition on August 3, 2021.
256On September 29, 2021, NICA filed a Response to Petition for Benefits,
268asserting that Knox did not s ustain a Ñbirth - related neurological injury , Ò as
283that term is defined in section 766.302(2), Florida Statutes, and requested
294that a hearing be scheduled to determine compensability. On October 8, 2021,
306the undersigned entered an Order that required the par ties to confer and
319advise concerning the need for a hearing, if any, and if a hearing is needed,
334when the parties will be prepared to proceed to a hearing, the issues in
348dispute, the estimate of time required for hearing, and the choice of venue.
361On Octobe r 13, 2021, the parties filed a Joint Status Report, which stated, in
376part, Ñthat a final hearing on compensability will not be necessary as the
389Petitioners and Intervenor do not contest NICAÔs determination that this
399claim does not qualify for NICA benefi ts.Ò
407On October 14, 2021, NICA filed its Motion for Partial Summary Final
419Order (Motion). Given the stated position of all parties in the Joint Status
432Report, the undersigned treats the Motion as unopposed.
440F INDINGS OF F ACT
4451. Knox was born on January 8, 2020, at Orlando Health South Lake
458Hospital, located in Lake County, Florida.
4642. Donald Willis, M.D. (Dr. Willis), was requested by NICA to review the
477medical records for Knox. In a medical report dated August 23, 2021,
489Dr. Willis summarized his finding s and opined, in pertinent part, as follows:
502In summary, labor was induced for severe
509hypertension at 37 weeks gestational age. A non -
518reassuring FHR pattern developed at complete
524cervical dilation. Cesarean delivery was difficult
530due to the fetal head bein g impacted in the
540maternal pelvis. The baby was depressed at birth
548with a cord pH of only 6.83 and a base excess of -
56118.7. Cooling protocol was initiated for suspected
568hypoxic ischemic encephalopathy (HIE). Although
573the baby did not have any seizure activi ty, MRI
583was consistent with subtle HIE.
588There was an apparent obstetrical event that
595resulted in the loss of oxygen to the babyÔs brain
605during labor, delivery and continuing into the
612immediate post - delivery period. The oxygen
619deprivation resulted in at le ast some degree of
628brain injury, as identified by MRI on DOL 6, which
638suggested subtle HIE. I am not able to comment
647about the severity of the brain injury.
6543. NICA retained Luis E. Bello - Espinosa, M.D. (Dr. Bello - Espinosa), a
668medical expert specializing in pediatric neurology, to examine Knox and to
679review his medical records. Dr. Bello - Espinosa examined Knox on
690September 25, 2021. In a medical report dated September 25, 2021, Dr. Bello -
704Espinosa summarized his examination of Knox and opined, in pertinent part,
715as follows:
717SUMMARY:
718Knox is a 19 - month - old boy with a history of
731moderate hypoxic - ischemic encephalopathy of birth.
738He underwent therapeutic hypothermia for 72 -
745hours. In the NICU, he did not have seizures,
754apnea or irregular breathing. An MRI of brain
762showed findings indicative [of] a subtle hypoxic -
770ischemic injury.
772On the evaluation today Knox[Ôs] neurological
778examination and development are completely
783normal. There was no evidence of any residual
791abnormal cortical, extrapyramidal, cerebellar,
795u pper or lower motor neuro signs.
802Results as of question 1: Does the child suffer from
812both a substantial mental impairment and a
819substantial physical impairment?
822Knox is found to have no substantial physical or
831mental impairment at this time.
836Results as of question 2: If so, are bot the mental
847and physical impairments permanent?
851There are no mental or physical impairments.
858Results of question 3: Are such permanent and
866substantial mental and physical impairments
871consistent with an injury to the brain or spinal cord
881acquired due to oxygen deprivation or mechanical
888injury occurring during labor, delivery or the
895immediate post - delivery period?
900There are no permanent substantial mental or
907physical impairments.
9094. A review of the file in this case reveals t hat there have been no expert
926opinions filed that are contrary to Dr. Bello - EspinosaÔs opinion that Knox is
940not permanently and substantially mentally and physically impaired, and
949thus should not be considered for inclusion in the NICA Plan . Dr. Bello -
964Espi nosaÔs opinion is credited.
9695. Pursuant to the Joint Status Report, Petitioners do not oppose the
981Motion.
982C ONCLUSIONS OF L AW
9876. DOAH has jurisdiction over the parties to and the subject matter of
1000these proceedings. §§ 766.301 - 766.316, Fla. Stat.
10087. The L egislature established the Plan Ñfor the purpose of providing
1020compensation, irrespective of fault, for birth - related neurological injury
1030claimsÒ relating to births occurring on or after January 1, 1989. £ 766.303(1),
1043Fla. Stat.
10458. The injured infant, her o r his personal representative, parents,
1056dependents, and next of kin may seek compensation under the Plan by
1068filing a claim for compensation with DOAH. §§ 766.302(3), 766.303(2),
1078and 766.305(1), Fla. Stat. NICA, which administers the Plan, has Ñ45 days
1090fr om the date of service of a complete claim . . . in which to file a response to
1110the petition and to submit relevant written information relating to the issue
1122of whether the injury is a birth - related neurological injury.Ò £ 766.305(4),
1135Fla. Stat.
11379. If NIC A determines that the injury alleged in a claim is a compensable
1152birth - related neurological injury, it may award compensation to the claimant,
1164provided that the award is approved by the administrative law judge to
1176whom the claim has been assigned. § 766.30 5(7), Fla. Stat. If, on the other
1191hand, NICA disputes the claim, as it has in the instant case, the dispute
1205must be resolved by the assigned administrative law judge in accordance
1216with the provisions of chapter 120, Florida Statutes. §§ 766.304, 766.309,
1227and 766.31, Fla. Stat.
123110. In discharging this responsibility, the administrative law judge must
1241make the following determination based upon the available evidence:
1250(a) Whether the injury claimed is a birth - related
1260neurological injury. If the claimant ha s
1267demonstrated, to the satisfaction of the
1273administrative law judge, that the infant has
1280sustained a brain or spinal cord injury caused by
1289oxygen deprivation or mechanical injury and that
1296the infant was thereby rendered permanently and
1303substantially mental ly and physically impaired, a
1310rebuttable presumption shall arise that the injury
1317is a birth - related neurological injury as defined in
1327s. 766.303(2).
1329(b) Whether obstetrical services were delivered by a
1337participating physician in the course of labor,
1344deli very, or resuscitation in the immediate
1351postdelivery period in a hospital; or by a certified
1360nurse midwife in a teaching hospital supervised by
1368a participating physician in the course of labor,
1376delivery, or resuscitation in the immediate
1382postdelivery perio d in a hospital.
1388§ 766.309(1), Fla. Stat. An award may be sustained only if the administrative
1401law judge concludes that the Ñinfant has sustained a birth - related
1413neurological injury and that obstetrical services were delivered by a
1423participating physicia n at birth.Ò £ 766.31(1), Fla. Stat.
143211. Section 766.302(2) defines the term Ñbirth - related neurological injuryÒ
1443as follows:
1445ÑBirth - related neurological injuryÒ means injury to
1453the brain or spinal cord of a live infant weighing at
1464least 2,500 grams for a single gestation or, in the
1475case of a multiple gestation, a live infant weighing
1484at least 2,000 grams at birth caused by oxygen
1494deprivation or mechanical injury occurring in the
1501course of labor, delivery, or resuscitation in the
1509immediate postdelivery pe riod in a hospital, which
1517renders the infant permanently and substantially
1523mentally and physically impaired.
152712. To be compensable under the Plan, there must have been an
1539obstetrical event , which resulted in loss of oxygen to the babyÔs brain during
1552labo r, delivery, or resuscitation in the immediate post - delivery period
1564resulting in a permanent and substantial mental impairment and a
1574permanent and substantial physical impairment, inasmuch as both are
1583required to establish compensability. Fla. Birth - Relate d Neurological Injury
1594Comp. AssÔn v. Div. of Admin. Hearings , 686 So. 2d 1349 (Fla. 1997).
160713. The evidence, which Petitioners have not refuted or attempted to
1618refute, established that Knox did not suffer a birth - related neurological
1630injury. Therefore, Kno x is not eligible for benefits under the Plan.
1642C ONCLUSION
1644Based on the Findings of Fact and the Conclusions of Law, it is
1657O RDERED that:
1660The Petition filed by Tania M. Russo and China Bailey, individually and
1672as parents and next friends of Knox Russo, is dismissed with prejudice.
