97S TATEMENT OF T HE C ASE

104On September 20, 2021, Petitioner s filed a Petition for Benefits Pursuant

116to Florida Statute Section 7 6 6.301 et seq. (Petition) with the Division of

130Administrative Hearings (DOAH), for a determinatio n of compensability

139under the Florida Birth - Related Neurological Injury Compensation Plan

149(Plan). The Petition named Nickoloz Tchankoshvili, M.D. , as the physician

159who provided obstetric services for the birth of Lyle Gillyard (Lyle) at Orange

172Park Medical Center in Orange Park, Florida, on December 30, 2015.

183On October 7, 2021, DOA H mailed a copy of the Petition to Respondent,

197Dr. Tchankoshvili , and Orange Park Medical Center via certified mail.

207Respondent was served with the same on or before October 8, 2021.

219On October 8, 2021, Respondent filed RespondentÔs Motion, requesting

228that a summary final order be entered finding that the claim is not

241compensable because Lyle did not meet the requisite minimum statutory

251birth weight as required by section 766. 302, Florida Statutes , and because

263the claim is time barred by section 766.313. Petitioner s did not file a response

278to RespondentÔs Motion.

281F INDINGS OF F ACT

2861. Lyle was born on December 30, 2015, at Orange Park Medical Center in

300Orange Park, Florida. He was a single gestation.

3082. The unrefuted medical records provided by Petitioner s to Respondent,

319pursuant to section 766.305(3), document that LyleÔs birth weight was 2 , 490

331grams.

3323. The Petition was filed on September 20, 2021, five ye a rs and 264 days

348af ter LyleÔs birth.

352C ONCLUSIONS O F L AW

3584 . DOAH has jurisdiction over the parties to and the subject matter of

372these proceedings. §§ 766.301 - 766.316, Fla. Stat.

3805 . The Plan was established by the Legislature Ñfor the purpose of

393providing compensation, irres pective of fault, for birth - related neurological

404injury claimsÒ related to births occurring on or after January 1, 1989.

416§ 766.303(1), Fla. Stat.

4206 . The injured infant, her or his personal representative, parents,

431dependents, and next of kin may seek com pensation under the Plan by filing

445a claim for compensation with DOAH. §§ 766.302(3), 766.303(2), and

455766.305(1), Fla. Stat. Respondent, which administers the Plan, has Ñ45 days

466from the date of service of a complete claim . . . in which to file a response to

485the petition and to submit relevant written information relating to the issue

497of whether the injury is a birth - related neurological injury.Ò £ 766.305(4), Fla.

511Stat.

5127 . Respondent has determined that Petitioner s do not have a claim that is

527compensable under the Plan and has filed a Motion for Summary Final

539Order, requesting that an order be entered finding that the claim is not

552compensable.

5538 . In ruling on RespondentÔs Motion, the administrative law judge (ALJ)

565must make the following threshold determ ination based upon the available

576evidence:

577(a) Whether the injury claimed is a birth - related

587neurological injury . If the claimant has

594demonstrated, to the satisfaction of the

600administrative law judge, that the infant has

607sustained a brain or spinal cord injury caused by

616oxygen deprivation or mechanical injury and that

623the infant was thereby rendered permanently and

630substantially mentally and physically impaired, a

636rebuttable presumption shall arise that the injury

643is a birth - related neurological injury as defined in

653s. 766.302 (2).

656§ 766.309(1), Fla. Stat.

6609 . The term Ñbirth - related neurological injuryÒ is defined in section

673766.302(2) as follows:

676ÑBirth - related neurological injuryÒ means injury to

684the brain or spinal cord of a live infant weighing at

695least 2,500 grams for a single gestation or, in the

706case of a multiple gestation, a live infant weighing

715at least 2,000 grams at birth caused by oxygen

725deprivation or mechanical injury occurring in the

732course of labor, delivery, or resuscitation in the

740immediate postdelivery period in a hospital, which

747renders the infant permanently and substantially

753mentally and phy sically impaired.

75810 . The Plan provides that Ñ[a]ny claim for compensation È that is filed

772more than five years after the birth of the infant alleged to have a birth -

788related neurological injury shall be barred.Ò £ 766.313, Fla. Stat.

79811. If the ALJ dete rmines that the injury is not a birth - related

813neurological injury, he or she is required to enter an order and immediately

826provide a copy to the parties. § 766.309(2), Fla. Stat.

8361 2 . The evidence, which is not refuted, establishe s that Lyle was a single

852g estation and did not weigh at least 2,500 grams at birth. Thus, Lyle did not

869sustain a birth - related neurological injury because he did not meet the

882minimum statutory weight . Accordingly, Petitioners Ô claim for benefits is not

894compensable under the Plan.

8981 3 . Additionally, as PetitionersÔ claim was filed more than five years after

912LyleÔs birth, said claim for compensation is barred.

920C ONCLUSION

922Based on the Findings of Fact and the Conclusions of Law, it is O RDERED

937that the Petition is dismissed with preju dice.
