407SETTLEMENT AGREEMENT

409Respondent, by and through, AHMED SALEM, as Manager, hereby enters into this

421settlement agreement pursuant to section 120.57(4), Florida Statutes, to resolve all administrative

433charges referenced in the Administrative Complaint for Case Number MS-21-422, in accordance

445with the following tem1s.

449I . Respondent enters into this agreement freely and without undue influence, and with

463the knowledge that doing so constitutes a waiver of the right to an administrative hearing pursuant

479to sections 120.569 and 120.57, Florida Statutes.

4862. Respondent understands and agrees that Respondent shall pay a civil fine in the

500amount of Two Hundred Fifty dollars ($250.00) for each count contained in the Administrative

514Complaint, for a total of Five Thousand Five Hundred dollars ($5,500.00).

5263. The civil fine in the full amount of Five Thousand Five Hundred dollars ($5,500.00)

542will be due and payable to the Department within fifteen (15) calendar days from the date of the

560filing of a final order with the agency clerk with the Department adopting and incorporating this

576settlement agreement.

5934. Respondent understands and agrees that if Respondent fails to pay the civil fine

607within the allotted timeframe set forth in paragraphs 2 and 3, the Department may suspend the

623Respondent' s license until payment has been made.

6315. Provided Respondent shall have fully performed all its obligations under this

643Settlement Agreement, then Petitioner shall be deemed to have released Respondent, its members,

656managers, employees and agents from any and all liabilities, claims and obligations of any matter

671in connection with all administrative charges and counts referenced in the Administrative

683Complaint for Case Number MS-21-422 and State of Florida Division of Administrative Hearings

696Case Number 22-0035.

6996. The Parties hereby acknowledge, recognize and understand that nothing contained

710in this Settlement Agreement shall constitute, be construed or be treated as an admission ofliability

725or wrongdoing.

7277. Respondent further understands and agrees that the Final Order adopting this

739agreement wi11 become part of the Department's permanent record.

7488. Respondent agrees to bear its own attorney's fees and costs arising from this

762matter.
