14. On March 30, 2018, the Department received Respondent's Petition.
115. On January 25, 2022, the Department referred the Petition to the Division of
25Administrative Hearings ("DOAH") for a formal hearing on Respondent's Petition.
376. On March 31, 2022, DOAH entered an order deeming matters admitted and
50relinquishing jurisdiction to the Department. A true and correct copy of the order is attached
65hereto as "Exhibit 1."
697. The factual allegations contained in the Stop- Work Order and the Amended Order
83of Penalty Assessment are hereby adopted as the Department's findings of fact in this case.
98CONCLUSIONS OF LAW
1018. Based upon the findings of fact adopted herein, the Department concludes
113Respondent violated the specific statutes and rules as alleged in the Stop-Work Order and the
128Amended Order of Penalty Assessment.
133Accordingly, Respondent remains subject to the Conditional Release until the entire
144penalty of$78,583.36 has been paid.
