115. On January 28, 2022, the Department referred this matter to the Division of

356. On March 29, 2022, counsel for the Respondent filed a Notice of Withdrawal of

50Counsel at the DOAH.

547. On March 29, 2022, the administrative law judge entered an Order Granting

67Withdrawal of Counsel and directed the Respondent to file an appearance no later than 5:00p.m.

82on April 5, 2022. Respondent failed to file an appearance.

928. On April 6, 2022, the administrative law judge entered an Order Closing File and

107Relinquishing Jurisdiction to the Department concluding that the Respondent abandoned its

118petition.

1199. The factual allegations contained in the Stop-Work Order and Amended Order of

132Penalty Assessment are hereby adopted as the Department's findings of fact in this case.

146CONCLUSIONS OF LAW

14910. Based upon the findings of fact adopted herein, the Department concludes

161Employer violated the specific statutes and rules as alleged in the Stop-Work Order and

175Amended Order of Penalty Assessment.

180Accordingly, the Employer remains subject to the Conditional Release until the entire

192penalty of $8,980.45 is paid.

214NOTICE OF RIGHT TO APPEAL

219A party adversely affected by this final order may seek judicial review as provided in section

235120.68, Florida Statutes, and Florida Rule of Appellate Procedure 9.190. Judicial review is
