104S TATEMENT OF T HE C ASE

111On January 28, 2022 , Petitioner , Asiye Basakli, on behalf of

121Giovanni Faulkner (Giovanni) , a minor, filed a Petition , Under Protest, for

132Benefits Pursuant to Florida Statute Section 766.301 et seq. (Petition) with

143the Division of Administrative Hearings (DOAH ) for a determination of

154compensability under the Florida Birth - Related Neurological Injury

163Compensation Plan (Plan).

166The Petit ion identified Rachel Cartechine, M.D., as the physician who

177provided obstetric services at the birth of Giovanni on November 4, 2020 , at

190Holmes Regional Medical Center (HRMC), located in Brevard County ,

199Florida.

200DOAH served Dr. Cartechine, HRMC, and NIC A with a copy of the

213Petition on February 11, 2022 . On March 7, 2022, the undersigned entered an

227Order Granting Petition for Leave to Intervene, allowing HRMC to intervene

238in this matter.

241On May 5, 2022, NICA filed a Response to Petition for Benefits, wh ich

255stated its determination that the instant claim is not compensable as the

267injury does not meet the definition of a Ñbirth - related neurological injuryÒ as

281defined in section 766.302(2), Florida Statutes. On May 25, 2022 , the parties

293filed a Status Repor t, which stated that Petitioner did not challenge NICAÔs

306finding of non - compensability and would not request a final hearing, but that

320because Intervenor was in the process of obtaining records to evaluate its

332position on the claim, Intervenor requested th at the undersigned schedule a

344final hearing. On June 1, 2022, the undersigned noticed this matter for a

357final hearing on November 21, 2022.

363On August 9, 2022, the parties filed a Status Report, which indicated that

376Petitioners and Intervenor did not conte st NICAÔs determination of non -

388compensability, that NICA would file an unopposed motion for summary final

399order, and requested that the undersigned cancel the final hearing in this

411matter.

412On August 9, 2022, NICA filed its Motion. The Motion reflects tha t

425Petitioners and Intervenor do not oppose the Motion.

433F INDINGS OF F ACT

4381 . Giovanni was born on November 4, 2020 , at HRMC , located in

451Brevard County , Florida.

4542. Donald Willis, M.D. (Dr. Willis) , was requested by NICA to review the

467medical records for Gi ovanni . In a medical report dated February 24, 2022,

481Dr. Willis summarized his findings and opined , in pertinent part , as follows:

493In summary, vacuum extraction was applied to

500assist vaginal delivery due to a non - reassuring

509FHR pattern during labor. Delive ry was

516complicated by a shoulder dystocia, which resulted

523in a brachial plexus injury. The baby was depressed

532at birth with Apgar scores of 2/6/7 and a cord blood

543pH of only 6.97. Persistent hypotension occurred

550after birth due to blood loss from a subgale al

560hematoma. Cooling protocol was initiated for

566perinatal depression. MRI on DOL 6 identified

573diffuse cortical edema, compatible with hypoxic

579brain insult.

581There was an obstetrical event that resulted in loss

590of oxygen to the babyÔs brain during labor, de livery

600and continuing into the immediate post delivery

607period. The oxygen deprivation resulted in some

614degree of brain injury. I am not able to comment

624about the severity of the injury.

6303. NICA retained Luis E. Bello Espinosa , M.D. (Dr . Espinosa) , a medic al

644expert specializing in pediatric neurology, to examine Giovanni and to review

655his medical records. Dr. Espinosa examined Giovanni on April 30, 2022. In a

668medical report dated April 30, 2022, Dr. Espinosa summarized his

678examination of Giovanni and opined , in pertinent part , as follows:

688Giovanni is a 19 - month 26 - days - old boy [sic] with a

703history of perinatal depression and who underwent

710therapeutic hypothermia after he was assessed to

717have mild hypoxic - ischemic encephalopathy.

723Giovanni had no seizures in t he NICU. An MRI of

734the brain obtained on the 8 th day of life showed

745diffuse cortical edema with mild diffusion

751restriction, compatible with subacute hypoxemic

756ischemic insult, as well as an acute small focus of

766periventricular insult along the posterior bo dy of

774the right lateral ventricle. Background of

780subacute/chronic bilateral periventricular insult.

784On his evaluation today Giovanni has normal

791development. His neurological examination is also

797normal. There are no clinical findings to indicate

805evidence o f upper or lower motor neuron signs.

814There were no findings to indicate corticospinal,

821extrapyramidal, or cerebellar dysfunction.

825Results as of question 1: Does the child suffer from

835both a substantial mental impairment and a

842substantial physical impairme nt?

846Giovanni does not suffer of substantial mental or

854physical impairment at this time.

859Results as of question 2: If so, are both the mental

870and physical impairments permanent?

874Giovanni does not have permanent mental and

881physical impairments.

883Results o f question 3: Are such permanent and

892substantial mental and physical impairments

897consistent with an injury to the brain or spinal cord

907acquired due to oxygen deprivation or mechanical

914injury occurring during labor, delivery or the

921immediate post - delivery p eriod?

927Giovanni today has no substantial mental or

934physical impairments as result of the reported

941findings on his MRI of the brain which depicted

950diffuse cortical edema with mild diffusion

956restriction, compatible with subacute hypoxemic

961ischemic insult, a s well as an acute small focus of

972periventricular insult along the posterior body of

979the right lateral ventricle.

983Results as of question 4: Did the permanent and

992substantial mental and physical impairments

997themselves occur during labor, delivery or the

1004im mediate post - delivery period (which period

1012continues until the baby is medically stable)?

1019Giovanni does not have mental or physical

1026impairments due to events that occurred during

1033labor delivery or the immediate post - delivery

1041period.

1042Considering the clini cal presentation, I do feel

1050there not enough [sic] evidence to recommend

1057Giovanni is included in the NICA program.

10644. A review of the file in this case reveals that there have been no expert

1080opinions filed that are contrary to the opinion of Dr. Espinosa that Giovanni

1093did not suffer an injury that meets the definition of a birth - related

1107neurological injury under section 766.302(2). Dr . EspinosaÔs opinion is

1117credited.

1118C ONCLUSIONS OF L AW

11235. DOAH has jurisdiction over the parties to and the subjec t matter o f

1138these proceedings. §§ 766.301 - 766.316, Fla. Stat.

11466. The Legislature established the Plan Ñ for the purpose of providing

1158compensation, irrespective of fault, for birth - related neurological injury

1168claims Ò relating to births occurrin g on or after January 1 , 1989. § 766.303(1),

1183Fla. Stat.

11857. The injured infant, her or his personal representative, parents,

1195dependents, and next of kin may seek compensation under the Plan by

1207filing a claim for compensation with DOAH. §§ 766.302(3), 766.303( 2),

1218and 766.305(1), Fla. Stat. NICA, which administers the Plan, has Ñ 45 days

1231from the date of service of a complete claim . . . in which to file a response to

1250the petition and to submit relevant written information relating to the issue

1262of whether the injury is a birth - rela ted neurological injury.Ò £ 766.305(4),

1276Fla. Stat.

12788. If NICA determines that the injury alleged in a claim is a compensable

1292birth - related neurological injury, it may award compensation to the claimant,

1304provided that the award is approved by the administr ative law judge to

1317whom the claim has been assig ned. § 766.305(7), Fla. Stat. If, on the other

1332hand, NICA disputes the claim, as it has in the instant case, the dispute

1346must be resolved by the assigned administrative law judge in accordance

1357with the provis ions of chapter 120, Florida Statutes. §§ 766.304, 766.309,

1369and 766.31, Fla. Stat.

13739. In discharging this responsibility, the administrative law judge must

1383make the following determination based upon the available evidence:

1392(a) Whether the injury claimed is a birt h - related

1403neurological injury. If the claimant has

1409demonstrated, to the satisfaction of the

1415administrative law judge, that the infant has

1422sustained a brain or spinal cord injury caused by

1431oxygen deprivation or mechanical injury and that

1438the infan t was thereby rendered permanently and

1446substantially mentally and physically impaired, a

1452rebuttable presumption shall arise that the injury

1459is a birth - related neurological injury as defined in

1469s. 766.303(2).

1471(b) Whether obstetrical services were delivere d by a

1480participating physician in the course of labor,

1487delivery, or resuscitation in the immediate

1493postdelivery period in a hospital; or by a certified

1502nurse midwife in a teaching hospital supervised by

1510a participating physician in the course of labor,

1518del ivery, or resuscitation in the immediate

1525postdelivery period in a hospital.

1530§ 766.309(1), Fla. Stat. An award may be sustained only if the administrative

1543law judge concludes that the Ñ infant has sustained a birth - related

1556neurological injury and that obst etrical services were delivered by a

1567participating physician at birth. Ò § 766.31(1), Fla. Stat.

157610. Section 766.302(2) defines t he term Ñ birth - related neurological injury Ò

1590a s follows:

1593Ñ Birth - related neurological injury Ò means injury to

1603the brain or spina l cord of a live infant weighing at

1615least 2,500 grams for a single gestation or, in the

1626case of a multiple gestation, a live infant weighing

1635at least 2,000 grams at birth caused by oxygen

1645deprivation or mechanical injury occurring in the

1652course of labor, d elivery, or resuscitation in the

1661immediate postdelivery period in a hospital, which

1668renders the infant permanently and substantially

1674mentally and physically impaired.

167811. To be compensable under the Plan, there must have been an

1690obstetrical event which r esulted in loss of oxygen to the babyÔs brain or spinal

1705cord injury during labor, delivery, or resuscitation in the immediate post -

1717delivery period resulting in a permanent and substantial mental impairment

1727and a permanent and substantial physical impairmen t, inasmuch as both are

1739required to establish compensability. Fla. Birth - Related Neurological Inj .

1750Comp. AssÔn v. Div. of Admin. Hearings , 686 So. 2d 1349 (Fla. 1997).

176312. The evidence, which the parties do not refute, established that

1774Giovanni did not suf fer a birth - related neurological injury under the

1787definition of section 766.302(2). Therefore, Giovanni is not eligible for benefits

1798under the Plan.

1801C ONCLUSION

1803Based on the Findings of Fact and Conclusions of Law, it is

1815O RDERED that:

1818The Petition filed b y Aisye Basakli, on behalf of Giovanni Faulkner, a

1831minor , is dismissed with prejudice. The final hearing scheduled for

1841November 21, 2022, is hereby canceled.
