90S TATEMENT OF T HE C ASE
97On April 22, 2022 , Petitioner , Jasmin Casey, on behalf of Izabella Hewitt
109(Izabella) , a minor, filed a Petition , Under Protest, for Benefits Pursuant to
121Florida Statute Section 766.301 et seq. (Petition) with the Division of
132Administrative Hearings (DOAH ) for a determination of compensability
141under the Florida Birth - Related Neurological Injury Compensation Plan
151(Plan).
152The Petition identified Emilio An t onetti, M.D., as the physician who
164provid ed obstetric services at the birth of Izabella on July 16, 2021 , at
178Ascension Sacred Heart Pensacola, located in Escambia County , Florida.
187DOAH served Dr. Antonetti, Ascension Sacred Heart Pensacola, and
196NICA with a copy of the Petition on May 3, 2022 .
208On June 17, 2022, NICA filed a Response to Petition for Benefits, which
221stated its determination that the instant claim is not compensable as the
233injury does not meet the definition of a Ñbirth - related neurological injuryÒ as
247defined in section 766.302(2), Florida Statutes. On July 5, 2022 , the parties
259filed a Joint Status Report, which stated that Petitioner did not challenge
271NICAÔs finding of non - compensability and would not request a final hearing.
284On August 15, 2022, NICA filed its Motion. The Motion reflects that
296Petitioner do es not oppose the Motion.
303F INDINGS OF F ACT
3081 . Izabella was born on July 16, 2021, at Ascension Sacred Heart
321Pensacola , located in Escambia County , Florida.
3272. Donald Willis, M.D. (Dr. Willis) , was requested by NICA to review th e
341medical records for Izabella . In a medical report dated May 25, 2022,
354Dr. Willis summarized his findings and opined , in pertinent part , as follows:
366In summary, labor was complicated by a non -
375reassuring FHR pattern. A fetal heart rate in the
38460 - 70 bpm ran ge was noted and emergency
394Cesarean section was done. The baby was
401depressed at birth with Apgar scores of 1/1/1
409despite a reasonable cord blood pH of 7.38.
417Resuscitation require d intubation and chest
423compressions followed by epinephrine and normal
429saline boluses. EEG was consistent with seizure
436activity shortly after birth. Metabolic acidosis
442continued during the immediate post - delivery
449period. The initial arterial blood gas pH was 7.1
458with a base excess of - 16. MRI on DOL 5 was
470consistent with hypoxic isc hemic brain injury.
477I am unable to completely explain the relatively
485normal umbilical cord blood pH of 7.38 with Apgar
494scores of 1/1/1 and significant clinical newborn
501depression. The cord blood gas could be incorrect or
510acidosis worsened immediately afte r birth. In
517either event, oxygen deprivation occurred that
523resulted in brain injury.
527There was an obstetrical event that resulted in loss
536of oxygen to the babyÔs brain during labor, delivery
545and continuing into the immediate post delivery
552period. The oxyg en deprivation resulted in brain
560injury as indicated by seizure activity and MRI
568findings consistent with hypoxic ischemic injury. I
575am not able to comment about the severity of the
585injury.
5863. NICA retained Luis E. Bello Espinosa , M.D. (Dr . Espinosa) , a m edical
600expert specializing in pediatric neurology, to examine Izabella and to review
611her medical records. Dr. Espinosa examined Izabella on June 11, 2022. In a
624medical report dated June 11, 2022, Dr. Espinosa summarized his
634examination of Izabella and opin ed , in pertinent part , as follows:
645Izabella is an Eleven - month - old girl with a history
657of moderate hypoxic - ischemic encephalopathy at
664birth, for which she underwent therapeutic
670hypothermia for 72 - hours. She had acute
678symptomatic electroclinical and electro graphic
683seizures in the NICU, and an MRI of the brain
693obtained on the 7 th day of life showed findings
703indicative of an acute hypoxic - ischemic injury.
711On the evaluation today, Izabella has no evidence
719of abnormal upper or lower motor neuron
726dysfunction. Sh e has no abnormal symptoms of
734corticospinal, extrapyramidal, brain stem,
738cerebellar or spinal cord dysfunction. There are no
746signs of abnormal behavior for her age, and no
755signs suggest residual brain dysfunction or
761encephalopathy.
762Results as of question 1: Does the child suffer from
772both a substantial mental impairment and physical
779impairment?
780Izabella is found to have no evidence of substantial
789mental or physical impairment at this time.
796Results as of question 2: If so, are both the mental
807and physical impairments permanent?
811Izabella has no evidence of permanent mental and
819physical impairments.
821Results of question 3: Are such permanent and
829substantial mental and physical impairments
834consistent with an injury to the brain or spinal cord
844acquired due to oxygen deprivation or mechanical
851injury occurring during labor, delivery or the
858immediate post - delivery period?
863In reviewing all the available documents, the
870evolution of her symptoms, the acute EEG and
878brain MRI changes, and her acute neonatal
885seizures, it is evident that Izabella has an acute
894hypoxic event at birth, which resulted in oxygen
902deprivation to specific areas of the brain which
910were found on her MRI done on day 7 of life. The
922changes were described as minimal, involving only
929the basal ganglia , with the rest of the brain spared
939of any abnormalities.
942Results as of question 4: Did the permanent and
951substantial mental and physical impairments
956themselves occur during labor, delivery or the
963immediate post - delivery period (which period
970continues unt il the baby is medically stable)?
978Izabella does not have substantial mental or
985physical impairments that occurred during labor,
991delivery, or the immediate post - delivery period.
999Considering the clinical presentation, I do feel
1006there not enough evidence to recommend Izabella
1013be included in the NICA program.
10194. A review of the file in this case reveals that there have been no expert
1035opinions filed that are contrary to the opinion of Dr. Espinosa that Izabella
1048did not suffer an injury that meets the definit ion of a birth - related
1063neurological injury under section 766.302(2). Dr . EspinosaÔs opinion is
1073credited.
1074C ONCLUSIONS OF L AW
10795. DOAH has jurisdiction over the parties to and the subjec t matter of
1093these proceedings. §§ 766.301 - 766.316, Fla. Stat.
11016. The Le gislature established the Plan Ñ for the purpose of providing
1114compensation, irrespective of fault, for birth - related neurological injury
1124claims Ò relating to births occurrin g on or after January 1, 1989. § 766.303(1),
1139Fla. Stat.
11417. The injured infant, her or his personal representative, parents,
1151dependents, and next of kin may seek compensation under the Plan by
1163filing a claim for compensation with DOAH. §§ 766.302(3), 766.303( 2),
1174and 766.305(1), Fla. Stat. NICA, which administers the Plan, has Ñ 45 days
1187fro m the date of service of a complete claim . . . in which to file a response to
1207the petition and to submit relevant written information relating to the issue
1219of whether the injury is a birth - related neurological injury.Ò £ 766.305(4),
1232Fla. Stat.
12348. If NICA determines that the injury alleged in a claim is a compensable
1248birth - related neurological injury, it may award compensation to the claimant,
1260provided that the award is approved by the administrative law judge to
1272whom the claim has been assig ned. § 766.305 (7), Fla. Stat. If, on the other
1288hand, NICA disputes the claim, as it has in the instant case, the dispute
1302must be resolved by the assigned administrative law judge in accordance
1313with the provisions of chapter 120, Florida Statutes. §§ 766.304, 766.309,
1324a nd 766.31, Fla. Stat.
13299. In discharging this responsibility, the administrative law judge must
1339make the following determination based upon the available evidence:
1348(a) Whether the injury claimed is a birt h - related
1359neurological injury. If the claimant has
1365d emonstrated, to the satisfaction of the
1372administrative law judge, that the infant has
1379sustained a brain or spinal cord injury caused by
1388oxygen deprivation or mechanical injury and that
1395the infant was thereby rendered permanently and
1402substantially mentally and physically impaired, a
1408rebuttable presumption shall arise that the injury
1415is a birth - related neurological injury as defined in
1425s. 766.303(2).
1427(b) Whether obstetrical services were delivered by a
1435participating physician in the course of labor,
1442deliver y, or resuscitation in the immediate
1449postdelivery period in a hospital; or by a certified
1458nurse midwife in a teaching hospital supervised by
1466a participating physician in the course of labor,
1474delivery, or resuscitation in the immediate
1480postdelivery period i n a hospital.
1486§ 766.309(1), Fla. Stat. An award may be sustained only if the administrative
1499law judge concludes that the Ñ infant has sustained a birth - related
1512neurological injury and that obstetrical services were delivered by a
1522participating physician a t birth. Ò § 766.31(1), Fla. Stat.
153210. Section 766.302(2) defines t he term Ñ birth - related neurological injury Ò
1546a s follows:
1549Ñ Birth - related neurological injury Ò means injury to
1559the brain or spinal cord of a live infant weighing at
1570least 2,500 grams for a si ngle gestation or, in the
1582case of a multiple gestation, a live infant weighing
1591at least 2,000 grams at birth caused by oxygen
1601deprivation or mechanical injury occurring in the
1608course of labor, delivery, or resuscitation in the
1616immediate postdelivery period in a hospital, which
1623renders the infant permanently and substantially
1629mentally and physically impaired.
163311. To be compensable under the Plan, there must have been an
1645obstetrical event which resulted in loss of oxygen to the babyÔs brain or spinal
1659cord i njury during labor, delivery, or resuscitation in the immediate post -
1672delivery period resulting in a permanent and substantial mental impairment
1682and a permanent and substantial physical impairment, inasmuch as both are
1693required to establish compensability. Fla. Birth - Related Neurological Inj .
1704Comp. AssÔn v. Div. of Admin. Hearings , 686 So. 2d 1349 (Fla. 1997).
171712. The evidence, which the parties do not refute, established that Izabella
1729did not suffer a birth - related neurological injury under the definition o f
1743section 766.302(2). Therefore , Izabella is not eligible for benefits under the
1754Plan.
1755C ONCLUSION
1757Based on the Findings of Fact and Conclusions of Law, it is
1769O RDERED that:
1772The Petition filed by Jasmin Casey, on behalf of Izabella Hewitt, a minor ,
1785is dism issed with prejudice.
