677. On July 13,2022, the Department served Employer a 3rd Amended Order of
81Penalty Assessment. The 3rd Amended Order of Penalty Assessment assessed a penalty of
94$1,673.42.
968. On July 15, 2022, Employer paid the assessed penalty in full.
1089. On July 22, 2022, Employer withdrew their Petition.
11710. The factual allegations contained in the Stop-Work Order and 3rd Amended
129Order of Penalty Assessment are hereby adopted as the Department's findings of fact in this

145CONCLUSIONS OF LAW
14811. Based upon the findings of fact adopted herein, the Department concludes
160Employer violated the specific statutes and rules as alleged in the Stop-Work Order and 3rd
175Amended Order of Penalty Assessment. The penalty has been paid in full.
187Accordingly, Lehigh Homestead Shell, L.L.C. is released from the Stop-Work Order.
