141PRELIMINARY STATEMENT

143This proceeding was initiated when Westinghouse Communities of Naples,

152Inc., (Westinghouse) filed a Petition with the Secretary of the Florida Land and

165Water Adjudicatory Commission (FLWAC) on January 15, 1993, seeking establishment

175by rule of the Pelican Marsh Community Development District (CDD) in an

187unincorporated area of Collier County, Florida. The Secretary on March 12,

1981993, forwarded the Petition to the Division of Administrative Hearings.

208On May 3, 1993, Westinghouse filed an Amended Petition with the FLWAC

220Secretary, which, on May 21, 1993, was forwarded to the Division of

522FINDINGS OF FACT

5251. On January 15, 1993, Westinghouse Communities of Naples, Inc.,

535(Westinghouse) filed a Petition with the Secretary of the Florida Land and Water

548Adjudicatory Commission (FLWAC), seeking establishment by rule of the Pelican

558Marsh Community Development District (CDD) in an unincorporated area of Collier

569County, Florida.

5712. The Secretary certified that the contents of the Petition were complete

583and on March 12, 1993, forwarded the Petition to the Division of Administrative

596Hearings.

5973. On May 3, 1993, Westinghouse filed an Amended Petition with the FLWAC

610Secretary. The Amended Petition revised related provisions contained in

619Paragraph 10 and Exhibit 7 of the original Petition.

6284. The amendments address delivery of water, wastewater and irrigation

638service within the CDD and set forth the obligations of the proposed CDD and the

653Collier County Water-Sewer District related to the construction, ownership and

663operation of interim and permanent facilities for such services.

6725. The FLWAC Secretary determined that the contents of the Amended

683Petition were complete and on May 21, 1993, forwarded the Amended Petition to

696the Division of Administrative Hearings.

7016. Notice of the date and location of the public hearing was published in

715the Naples Daily News, a daily newspaper in Naples, Florida on May 13, 20, 27

730and June 3, 1993.

7347. A copy of such notice was served upon the Department of Community

747Affairs as required by Rule 42-1.011, Florida Administrative Code.

7568. Notice of the hearing was published by the FLWAC's Secretary in the

769Florida Administrative Weekly on May 14, 1993, as required by Rule 42-

7811.010(1)(b), Florida Administrative Code.

7859. Westinghouse submitted a copy of the Petition to the Collier County

797Board of County Commissioners ("Board") on February 26, 1993 and submitted a

811copy of the Amended Petition to the Board on April 16, 1993.

82310. As required by Section 190.005(1)(b)1, Florida Statutes, Westinghouse

832paid the $15,000 filing fee to the Board.

84111. A public hearing before the Board was held on May 4, 1993. Such

855hearing is optional pursuant to Section 190.005(1)(c), Florida Statutes.

86412. Upon completion of the hearing, the Board adopted Resolution No. 93-

876187 through which it determined that the establishment of the CDD was in the

890best interests of the county and its citizens and that the county was supportive

904of the establishment of the CDD. A transcript of the county hearing was filed

918with the FLWAC on May 4, 1993.

92513. If approved by the FLWAC, the CDD will be an independent special

938purpose local government as authorized by Chapter 190, Florida Statutes, with

949power to plan, finance, construct, operate and maintain the community

959infrastructure (except as to certain water and sewer services discussed

969elsewhere herein) within the jurisdiction of the CDD.

97714. The CDD will manage and finance basic services for the residential

989community known as Pelican Marsh.

99415. The 2,075 acres of the community development to be serviced by the CDD

1009is located north of the City of Naples within an unincorporated area of Collier

1023County. To the north of the CDD lies unimproved land, residential subdivisions

1035and Immokalee Road (County Road 846). To the east is unimproved land and the

1049site of a proposed extension of Livingston Road. To the south is Vanderbilt

1062Beach Road (County Road 862), the site of a proposed extension of Vanderbilt

1075Beach Road, and Pine Ridge subdivision. To the west is North Tamiami Trail

1088(U.S. Highway 41).

109116. The land within the proposed CDD is currently zoned as "Urban

1103Residential", "Activity Center" and "Proposed Activity Center". Westinghouse

1112has entered into the record, as Exhibit "C", an Application for Public Hearing

1125for Rezone and Conditional Use Requests and a draft Planned Unit Development

1137document for a portion of the community consisting of approximately 1086.5

1148acres. The draft Planned Unit Development document authorizes a mixture of land

1160uses, including single and multi-family housing, limited to 780 dwelling units

1171and a 27-hole golf course with clubhouses.

117817. Westinghouse has acknowledged in its Amended Petition that the Collier

1189County Water-Sewer District is the permanent supplier of all water, wastewater

1200and irrigation service in the CDD and that the CDD shall be obligated to convey

1215all water, sewer and irrigation facilities to the County and its Water-Sewer

1227District upon completion.

123018. Westinghouse also acknowledges certain rights and obligations of the

1240CDD with respect to the construction and operation of interim water, wastewater

1252and irrigation facilities. The cost of such facilities will be borne by the CDD

1266through various types of financing mechanisms. Only those persons who receive

1277the benefit of the services will pay the costs involved in provision of the

1291facilities.

1292Summarization of Testimony and Evidence

129719. Mr. Louis H. Hoegsted is Executive Vice President of Westinghouse

1308Communities of Naples, Inc., the corporation that filed the Petition and Amended

1320Petition in this matter. Mr. Hoegsted has general responsibility for planning

1331the Pelican Marsh community, including the filing of the petitions.

134120. Westinghouse, a Florida corporation, has developed the community of

1351Pelican Bay in Collier County, Florida. Mr. Hoegsted was involved as the

1363company representative in the formation and operation of the former Pelican Bay

1375Improvement District, created by special act of the Florida Legislature.

1385Pelican Bay was merged by Collier County into the County Water-Sewer District.

139721. Mr. Hoegsted identified Westinghouse's Composite Hearing Exhibits "A"

1406through "R". All of the below-described documents were prepared under the

1418supervision of Mr. Hoegsted. The exhibits identified by Mr. Hoegsted are as

1430follows:

2471considerations and the proposed establishment

2476of the Pelican Marsh CDD.

2488Exhibit "R-1" is an additional consent of

2495the remaining land owners within the CDD.

2502(Exhibit D-4 contains the originally filed

2508consent documents.) Exhibit "R-2" is an

2514updated estimate of proposed infrastructure

2519construction costs and deadlines.

252322. As Executive Vice President of Westinghouse Communities of Naples,

2533Inc., Mr. Hoegsted directed the planning and preparation of the Petition and

2545Amended Petition filed in this matter. The consultants who reviewed the project

2557on behalf of Westinghouse were directed to assume that the CDD would provide all

2571services and facilities which it was able to provide under Sections 190.011 and

2584190.012, Florida Statutes, with the exception of the County's provision of

2595water, wastewater and irrigation services and facilities. (As addressed

2604elsewhere herein, the County Water and Sewer District is to be the sole provider

2618of water, wastewater and irrigation water within the Water-Sewer District

2628boundaries in accordance with Collier County Ordinance Nos. 78-10, 79-33, 88-76,

263990-86 and 90-87.)

264223. The consultants were directed to consider the factors enumerated in

2653Subsection 190.005(1)(e), Florida Statutes. Based upon review of their

2662analysis, Mr. Hoegsted asserts that all statutory criteria have been satisfied.

2673There is no evidence to the contrary.

268024. The Statement of Economic Impact prepared for the CDD by Fishkind &

2693Associates, Inc., includes an analysis of economic costs and benefits to all

2705persons directly affected by the Petition, estimates the impact of the CDD on

2718competition in the open market and describes the source of information and

2730methodology used in preparing the statement. According to the statement, the

2741creation of the CDD will not constitute a significant burden to either the State

2755of Florida or Collier County. There is no evidence contrary to that contained

2768within the Fishkind report.

277225. Thomas R. Peek is a professional engineer with Wilson, Miller, Barton

2784and Peek, Inc., an engineering consulting firm located in Naples, Florida. Mr.

2796Peek was accepted as an expert in civil engineering related to provision of

2809infrastructure development in Southwest Florida communities.

281526. Mr. Peek is familiar with the CDD and with the status of the

2829development approvals and related land development permits and approvals from

2839local and state authorities for the Pelican Marsh community. He is

2850knowledgeable as to the steps involved in engineering basic systems, facilities

2861and services for community developments. He opined that there is a high

2873probability for quality long term infrastructure maintenance by an independent

2883special district government.

288627. Mr. Peek testified that he had reviewed the Amended Petition and

2898attachments and that they contained no information inconsistent with engineering

2908considerations raised by the state or the Collier County Comprehensive Plans.

291928. It is anticipated that the CDD will be requested to provide water

2932management, utilities, roads, landscaping and street lighting. Mr. Peek is

2942unable to predict whether the CDD will be asked to exercise any additional

2955powers pursuant to Section 190.012(2), Florida Statutes. Such additional powers

2965relate to certain public improvements and community facilities as parks, fire

2976prevention, schools, security, and mosquito control.

298229. Mr. Peek opined that the land within the proposed CDD is of sufficient

2996size, compactness and contiguity to be developable as one functionally

3006interrelated community and is amenable for a CDD, that there are no land

3019features or facilities which could make the benefits of the CDD difficult to

3032provide, and that the CDD will not be inconsistent with the Collier County local

3046government comprehensive plan.

304930. There is no evidence contrary to that provided by Mr. Peek. His

3062testimony is accepted.

306531. Dr. Lance deHaven-Smith is a political science professor and provost

3076of the Broward County campus of Florida Atlantic University. He was accepted as

3089an expert in political science and in alternative ways to provide community

3101infrastructure.

310232. Dr. deHaven-Smith reviewed the Petition from a general infrastructure

3112and growth management policy perspective. He further addressed the relevant

3122statutory criteria. Based on his review he prepared a report, "Growth

3133Management Considerations in the Proposed Establishment of the Pelican Marsh

3143Community Development District". The report is identified as Westinghouse

3153Exhibits "D-9" and "E-9".

315833. According to Dr. deHaven-Smith, Collier County has experienced

3167substantial growth in recent years, requiring a rapid expansion in

3177infrastructure for transportation, water, waste water treatment, law

3185enforcement, recreation, and many other services. Community development

3193districts play an important role in growth management by facilitating large

3204scale, high quality development and relieving local governments of the burden of

3216paying for and managing many of the services and public works that such

3229developments require.

323134. According to Dr. deHaven-Smith, to the extent that there are

3242weaknesses in the state's growth management system, community development

3251districts provide a means of appropriate controlled development. Even though

3261the state has adopted a state comprehensive plan, the need for CDDs exists,

3274especially in areas such as Collier County where growth is at a rate twice that

3289of other Florida communities. Accordingly, Dr. deHaven-Smith opined that the

3299CDD is a good tool in the growth management process.

330935. Dr. deHaven-Smith described the manner in which the CDD would operate

3321and carry out the powers prescribed in the development order for Pelican Marsh

3334District. He opined that, relative to the alternatives for providing the

3345infrastructure necessary for the Pelican Marsh community, the CDD mechanism is

3356the most appropriate alternative.

336036. He further noted that although the CDD has a range of specific and

3374general powers, it is controlled by substantive and procedural limitations and

3385would be subservient to Collier County.

339137. Dr. deHaven-Smith reviewed the statutory factors and related

3400information that must be considered in order to establish a CDD. He opined that

3414all statements within the petitions are true and correct, that the creation and

3427establishment of the CDD is not inconsistent with applicable portions of the

3439state and local comprehensive plans, that the area of land within the CDD is of

3454sufficient size, is sufficiently compact, and is sufficiently contiguous to be

3465developable as one functional interrelated community, that the CDD is the best

3477alternative for delivering community development services and facilities, that

3486the services and facilities are compatible with the capacity and uses of

3498existing local and regional community development services and facilities, and

3508that the area to be served is amenable to separate special-district services and

3521facilities. There is no evidence contrary to the witness' testimony which is

3533hereby accepted.

353538. David Crawford is Director of Planning and Governmental Relations with

3546Westinghouse Bayside Communities, Inc. He has 15 years experience in the

3557planning of infrastructure provision for community development and has been

3567involved in the preparation of comprehensive plans for several Florida counties.

357839. He testified as to the permitting and development approval status of

3590the Pelican Marsh community and the physical characteristics and situations to

3601be found within the area of the proposed CDD, including two existing roadways, a

3615drainage canal, an outfall and various utilities which cross the property.

362640. Mr. Crawford described the state comprehensive plan and how the

3637establishment of the CDD would be consistent with and facilitate certain

3648enumerated policies in the plan. Mr. Crawford stated that the CDD will not be

3662inconsistent with the Collier County Comprehensive Plan. With respect to state

3673concurrency requirements, Mr. Crawford asserted that the CDD is the best method

3685to provide sustained infrastructure to a community.

369241. Mr. Crawford stated that the CDD is a responsive, efficient, timely

3704and economic means of providing services to a community's future population

3715without over-burdening the existing residents. He asserted that the land within

3726the CDD is of sufficient size, compactness and contiguity to be developable as

3739one functionally interrelated community and that the land area in the CDD is

3752amenable to separate special-district government. According to Mr. Crawford,

3761the establishment of the CDD will not create any incompatibility with the

3773existence of any regional systems, services or facilities.

378142. In Mr. Crawford's opinion, the establishment of the CDD will not

3793overburden the Collier County government with respect to providing maintenance

3803over the long-term infrastructure to the proposed development nor overburden the

3814taxpayers of Collier County. Furthermore, he opined that the CDD will not be a

3828needless or unacceptable proliferation of local government in view of the six

3840factors required to be considered for its establishment under Chapter 190.

385143. Mr. Crawford testified that it is not premature to establish the CDD

3864before issuance of the final development order under Section 380.06, Florida

3875Statutes. Because infrastructure construction activities require construction

3882permitting from the county, it is unlikely that the CDD would construct

3894infrastructure inconsistent with the eventual development order to be issued by

3905the county.

390744. There is no evidence contrary to the testimony of Mr. Crawford and it

3921is accepted.

392345. Gary L. Moyer serves as district manager for twenty-three community

3934development districts throughout the state. As a district manager, he

3944coordinates the planning, financing, construction, operation, and maintenance of

3953infrastructure provided to new community developments. Mr. Moyer was accepted

3963as an expert in district management and government.

397146. Mr. Moyer reviewed the factors used in FLWAC's determination regarding

3982whether the petition should be approved. He concluded that all criteria were

3994satisfied. Within the context of his expertise, Mr. Moyer opined that all

4006statements in the Amended Petition to be true and correct, that the CDD is

4020compatible with all state and local comprehensive plans, that the land area of

4033the CDD is of sufficient size and compactness and is sufficiently contiguous to

4046be developable as one functional interrelated community, that the CDD is the

4058best alternative for delivering the proposed services and facilities to the

4069development, that the CDD is not incompatible with the capacity and uses of

4082existing local and regional community development services and facilities, and

4092that the area to be served is amenable to separate special-district government.

410447. Mr. Moyer noted that the CDD will be subject to the same checks,

4118balances and accountability as other general purpose governmental entities. The

4128CDD Board of Supervisors is governed by state ethics laws, "Government in the

4141Sunshine," public records law and statutes related to accountability of public

4152officials. Mr. Moyer noted that, once established, the CDD becomes a "partner"

4164with local government in achieving the goals and objectives of the community.

417648. Mr. Moyer stated that the operations of the CDD must be in accordance

4190with local government's comprehensive plan and construction standards. He

4199further noted that the CDD must supply planning documents to the local

4211government to ensure consistency with the local comprehensive plan.

422049. There being no evidence to the contrary, Mr. Moyer's testimony is

4232accepted as being credible on these issues.

4239CONCLUSIONS

424050. Having considered the entire record in this cause, and without

4251evidence to the contrary, it is concluded that:

425951. All statements contained within the Petition have been found to be

4271true and correct. Section 190.005(1)(e)1., Florida Statutes.

427852. The creation and establishment of the CDD is consistent with

4289applicable elements or portions of the state comprehensive plan and the Collier

4301County comprehensive plan, as amended. Section 190.005(1)(e)2., Florida

4309Statutes.

431053. The area of land within the CDD is of sufficient size, is sufficiently

4324compact, and is sufficiently contiguous to be developable as one functional

4335interrelated community. Section 190.005(1)(e)3., Florida Statutes.

434154. The CDD, in accordance with applicable state and local law and the

4354Memorandum of Agreement executed by Westinghouse and Collier County, is the best

4366alternative available for delivering community development services and

4374facilities to the area that will be served by the CDD. Section 190.005(1)(e)4.,

4387Florida Statutes.

438955. In accordance with applicable state and local law and the Memorandum

4401of Agreement executed by Westinghouse and Collier County, the community

4411development services and facilities of the CDD will be compatible with the

4423capacity and uses of existing local and regional community development services

4434and facilities. Section 190.005(1)(e)5., Florida Statutes.

444056. The 2,075 acre tract of land that will be served by the CDD is

4456amenable to separate special-district government, in accordance with the

4465provisions of Chapter 190, Florida Statutes, and the Memorandum of Agreement

4476between Westinghouse and Collier County. Section 190.005(1)(e)6., Florida

4484Statutes.
