158STATEMENT OF THE ISSUES
162The issue for disposition is whether Petitioner's application for a
172certificate of need (CON) was properly rejected by Respondent for failure to
184file the application by the deadline established in rules 59C-1.008(k)1. and 2.
196and 59C-1.008(4), F.A.C. The parties have stipulated that if the rules are
208determined valid in the companion case, 93-7094RX, the agency was authorized to
220reject the application.
223PRELIMINARY STATEMENT
225On December 16, 1993, Petitioner, Manatee Hospitals and Health Systems,
235Inc., d/b/a Manatee Memorial Hospital (Manatee) filed its petition pursuant to
246section 120.56 to contest the validity of the subject rules. (DOAH #93-7094RX)
258Manatee also filed a petition pursuant to section 120.57(1), F.S., contesting
269the Respondent's (Agency) decision to reject for review a certificate of need
281(CON) application submitted by Manatee. (DOAH #94-0003)
288Without objection, the two cases were consolidated for hearing in an order
300dated January 12, 1994. As provided in section 120.56(3), F.S., a separate
312final order is being issued this same date in DOAH #93-7094RX.
323At the hearing the parties presented a thorough stipulation of material
334facts, and the testimony of Elizabeth Dudek, qualified as an expert in health
347planning and administration of the certificate of need program. Joint exhibits
358#1-6 were received in evidence; official recognition was taken of an amendment
370to former rule 10-5.008, F.A.C., filed on October 28, 1987, and effective
382November 17, 1987. Official recognition was also taken of rules 10-5.002-.024,
393F.A.C., as published in the Florida Administrative Weekly, Vol. 16, number 13,
405on March 30, 1990.
409The proposed findings of fact submitted by both parties are substantially
420adopted here, there being no disputed issues of material fact.
430FINDINGS OF FACT
4331. Manatee Hospitals and Health Systems, Inc. d/b/a Manatee Memorial
443Hospital (Manatee) is a nonprofit corporation which operates a short-term
453general acute care hospital in Manatee County, Florida.
4612. On November 1, 1993, Manatee timely and properly submitted a letter of
474intent to the Agency for Health Care Administration (Agency) seeking authority
485to convert up to 11 substance abuse beds and/or up to 28 acute care beds to 28
502skilled nursing beds for review in the Nursing Home Batch Cycle, 2nd Cycle,
5151993.
5163. On December 1, 1993, Manatee submitted a CON application to the agency
529seeking authority to convert up to 11 adult substance abuse beds and/or up to 28
544acute care beds to 28 skilled nursing beds for review in the nursing home batch
559cycle, 2nd cycle, 1993. The application included the appropriate filing fee.
5704. Manatee failed to submit a copy of its CON application to the local
584health council by 5:00 p.m. on the application due date of December 1, 1993.
598Instead, the application was submitted to the local health council on December
6102, 1993.
6125. By correspondence from Liz Dudek, Chief, Certificate of Need and Budget
624Review Section, dated December 7, 1993, the agency advised Manatee that its CON
637application was not accepted and was being returned to Manatee because Manatee
649failed to submit a copy of its application to the health council by 5:00 p.m. on
665the application due date of December 1, 1993, as required by rules 59C-
6781.008(1)(k)1., and 2., and 59C-1.008(4), F.A.C.
684CONCLUSIONS OF LAW
6876. The Division of Administrative Hearings has jurisdiction in this
697proceeding pursuant to section 120.57(1), F.S.
7037. Section 408.039(3)(a), F.S., provides, in pertinent part:
711(3) Application Processing.--
714(a) An applicant shall file an
720application with the department, and shall
726furnish a copy of the application to the
734local health council and the department.
7408. Rules 59C-1.008(1)(k)1. and 2., F.A.C. provide:
747(k) Certificate of Need Application
752Submission. An application for a certificate
758of need shall be submitted on HRS Form 1455,
767August 1985, and HRS Form 1460, June 1991
775incorporated by reference herein, and shall
781be provided by the agency upon request.
7881. The application must be actually
794received by the agency by 5 p.m. local time
803and a copy must actually be received by the
812local health council by 5 p.m. local time on
821or before the application due date.
8272. An application submitted to the agency
834shall not be accepted by the agency, and the
843application fee will be returned if a copy of
852the application is not received by the
859appropriate local health council as provided
865above.
866Rule 59C-1.008(4), F.A.C. provides:
870(4) Submission to Local Health Council.
876Each applicant shall submit a copy of its
884application to the applicable local health
890council at the same time the application is
898submitted to the agency. Failure to timely
905file with the local health council as set
913forth in Rule 59C-1.008(1)(k), F.A.C., will
919result in the application not being accepted
926by the agency.
9299. The above rules have been found a valid exercise of delegated
941legislative authority in a separate order entered this same date in DOAH case
954#93-7094RX. The parties have stipulated that if the rules are determined valid,
966so also is the agency action in rejecting Manatee's late-filed application.
977RECOMMENDATION
978Based on the foregoing, it is, hereby,
985RECOMMENDED:
986That Petitioner's request that the agency accept its application for
996comparative review in the Nursing Home Cycle, 2nd cycle be DENIED.
