114PRELIMINARY STATEMENT

116This case arose from the Department of Transportation's (Department),

125issuance of an intent to deny Petitioner's Application for Certification as a

137Disadvantaged Business Enterprise (DBE), dated January 10, 1995. Petitioner

146requested a formal hearing on January 30, 1995. This matter was referred to the

160Division of Administrative Hearings on February 28, 1996 and this matter was set

173for hearing in Orlando. The hearing was converted to televideo conference on

185May 17, 1996 and the parties were notified. At the appointed time, Respondent

198and its witness appeared at the teleconference hearing room in Tallahassee,

209Florida. The hearing was to convene at 1:00 p.m. on Tuesday, May 21, 1996.

223However, Petitioner was not present in Orlando. Diligent search and inquiry was

235made but Petitioner did not appear. The hearing convened at 1:42 p.m. No

248representative for Petitioner attended, nor did the undersigned receive any

258further communication from any representative for Petitioner.

265Testimony was received from the Department's DBE Certification Manager, Mr.

275Howard Jemison, and three exhibits were received in evidence. No other evidence

287was presented. The hearing was recorded but not transcribed. Petitioner has

298not submitted proposed findings of fact or conclusions of law as of the date of

313this order. Respondent filed its proposed recommended order on May 22, 1996 and

326each of its proposed findings of facts have been substantially adopted in this

339Order.

340FINDINGS OF FACT

3431. On October 17, 1994 Petitioner, in order to be recertified, submitted

355its Application for Certification as a DBE to the Department.

3652. Following an initial review of Petitioner's application, the Department

375determined that the application as submitted was incomplete.

3833. On October 27, 1994, the Department sent Petitioner a certified letter

395requesting additional information including:

399(a) A copy of Petitioner's financial state-

406ment for the year ending December 31, 1993,

414showing its gross receipts.

418(b) Answers to questions 24, 25 and 26, of

427Petitioner's Application.

429(c) Copies of Petitioner's State Quarterly

435Unemployment Tax Report (LES Form UCT-6) for

442the last three quarters.

446(d) A copy of Petitioner's annual report

453submitted to the Department of State, Divi-

460sion of Corporations, for 1994.

465(e) A completed code sheet indicating the

472Petitioner's area of specialty.

476(f) Documentation indicating Petitioner's

480ethnic status.

4824. The Department's request for additional information was received by

492Petitioner.

4935. The Department's request for additional information notified Petitioner

502that it must submit the requested information within thirty days if it was to be

517considered by the Department in its determination of recertification.

5266. All of the additional information requested by the Department was

537critical in determining Petitioner's inclusion in the DBE Program. Specifically

547it pertained to whether Petitioner continued to be qualified as a Small Business

560Concern.

5617. The Petitioner failed to respond to the Department's request for

572additional information.

5748. The Petitioner did not request an extension of time for filing a

587response to the Department's request for additional information.

5959. On January 10, 1995, having reviewed no response to its request for

608additional information, the Department processed Petitioner's application as it

617was originally provided. The Department notified Petitioner of its intent to

628deny its Application based on Petitioner's failure to demonstrate that it is a

641Small Business Concern.

64410. On January 30, 1995, Petitioner requested a formal hearing pursuant to

656Section 120.57(1), Florida Statutes. However, as indicated above, Petitioner

665failed to appear for the properly noticed hearing and presented no evidence that

678it qualified as a Small Business Concern. Petitioner has constructively

688abandoned its request for recertification as a DBE.

696CONCLUSIONS OF LAW

69911. The Division of Administrative Hearings has jurisdiction over the

709parties to and the subject matter of this proceeding.

71812. Section 339.0805(1)(c), Florida Statutes, provides in part:

726The department shall certify a socially and

733economically disadvantaged business enter-

737prise, which certification shall be valid for

74412 months, or as prescribed by 49 C. F. R.

754part 23.

75613. Rule 14-78.005(7), Florida Administrative Code, provides in part:

765Pursuant to 49 C. F. R. Subtitle A, Subpart D,

775Section 23.62, a firm seeking certification

781and recertification as a DBE shall meet the

789following standards. A firm which does not

796fulfill all the Department's criteria for

802certification shall not be considered a

808Disadvantaged Business Enterprise.

811(a) The firm must be a small business concern;

82014. Rule 14-78.002(17), Florida Administrative Code, provides in part:

829Pursuant to 49 C. F. R. Subtitle A, Subpart D,

839Section 23.62 and Appendix A to Section 23.62

847and Appendix B of Subpart D, "Small Business

855Concern" means those business concerns as

861defined in 13 C. F. R. Section 121.403(a) and

870(b), which regulation is hereby incorporated

876by reference and made a part of these rules.

88515. Rule 14-78.007(2)(a), Florida Administrative Code provides:

892Within 30 days after receipt of an appli-

900cation for certification as a DBE, the Depart-

908ment shall examine the application, notify the

915applicant of any apparent errors or omissions,

922and request any additional information the

928Department if permitted by law to require. In

936order for the additional information to be

943considered , the DBE shall return the requested

950information to the Department within 30 days

957after receipt of the request. If the addi-

965tional information is not received within 30

972days, the Department will process the appli-

979cation with the information as provided un-

986less the applicant has requested and received

993an extension in writing.

99716. Respondent previously was certified as a DBE and is seeking

1008recertification. Therefore the Department bears the burden of proof. Fla Dept.

1019of Transportation v. J. W. C. Company, Inc., 396 So.2d 778, 788 (Fla. 1st DCA

10341981).

103517. Petitioner's failure to respond to the Department's request for

1045additional information made it impossible for the Department to determine

1055Petitioner's status as a Small Business Concern. Petitioner failed to

1065demonstrate that it is a Small Business Concern as defined in Rule 14-

107878.007(17), Florida Administrative Code.

108218. The Department correctly followed the statutory and regulatory

1091requirements in denying Petitioner's Application for Certification as a DBE on

1102January 10, 1996.

110519. By failing to provide additional information to the Department or at

1117the formal hearing, Petitioner has abandoned its request to be certified as a

1130DBE.

1131RECOMMENDATION

1132Based on the foregoing Findings of Fact and Conclusions of Law, it is

1145RECOMMENDED that a Final Order be entered denying Petitioner's Application

1155for Certification as a DBE.
