107STATEMENT OF THE ISSUES
111Whether Respondent violated Sections 475.25(1)(b),(e),(k),
118and Section 475.42(1)(b), Florida Statutes, and Rule 61J-14.009,
126Florida Administrative Code, and if so, what penalty should be

137PRELIMINARY STATEMENT
139On February 24, 1995, the Department of Business and
148Professional Regulation, Division of Real Estate (Department),
155filed an administrative complaint against Respondent, Tam N.
163Shigley (Shigley), alleging that she violated Sections
170475.25(1)(b),(e),(k), and Section 475.42(1)(b), Florida Statutes,
178and Rule 61J2-14.009, Florida Administrative Code. Shigley
185requested an administrative hearing, and the case was forwarded
194to the Division of Administrative Hearings on October 31, 1996,
204for assignment to an Administrative Law Judge.
211At the final hearing, Shigley failed to appear. Respondent
220called two witnesses and entered 11 exhibits in evidence.
229The transcript was filed on February 20, 1997. At the final
240hearing counsel for Petitioner stated Petitioner would file
248proposed recommended order within ten days of the filing of the
259transcript. The parties did not file proposed recommended
267orders.
268FINDINGS OF FACTS
2711. Respondent, Tam N. Shigley (Shigley) was provided notice
280of the final hearing in this case by Notice of Hearing by Video
293dated December 6, 1996. The final hearing was scheduled to
303commenced at 9:00 a.m. on January 31, 1997. The Administrative
313Law Judge and counsel for Petitioner waited until 9:15 a.m. to
324commence the hearing, but Shigley did not appear. Shigley did
334not advise either the Division of Administrative Hearings or the
344Petitioner that she would not be appearing at the final hearing.
3552. Shigley is now and was at all times material to this
367proceeding a licensed Florida real estate salesperson, issued
375license number 0465639.
3783. On March 27, 1994, Shigley was employed by First
388Nationwide Mortgage. She negotiated a contract between Bich Hue
397and Minh Huynh (hereinafter Buyers) and Lois A. Hopwood
406(hereinafter Seller) for the purchase of a house located in
416Sunrise, Florida. Shigley was listed as the contract escrow
425agent on the contract.
4294. Shigley received a check for $5,500 from the Buyers as a
442deposit to be held in escrow until the closing. Shigley cashed
453the check and did not deposit the proceeds of the check in an
466escrow account.
4685. Shigleys employer was unaware th at Shigley had accepted
478the check, had cashed the check, and had not deposited the check
490in the escrow account.
4946. At the closing of the real estate transaction, Shigley
504did not have the $5,500 which she had received from the Buyers
517and stated that she had lost the money.
5257. On May 23, 1994, Shigley entered into an agreement with
536the seller in which she agreed to pay the Seller the $5,500
549within six months and that if she did not repay the money within
562the specified time that the Seller would report Shigleys actions
572to the Real Estate Board.
5778. Shigley did not repay the money to the Seller.
5879. Michael Millard filed a complaint with the Broward
596County Sheriffs Department in March, 1995, alleging that Shigley
605had absconded with $1350 which he had given her as a deposit on a
619lease.
62010. On March 14, 1995, Harvey Kosberg filed a complaint
630with the Department of Business and Professional alleging that
639Shigley, while registered as a salesperson with Rainbow Realty
648had acted as a broker and took and kept money in her name.
66111. The Department undertook to investigate the allegations
669of Mr. Kosberg and was unable to locate Shigley. She did not
681have a telephone listing, and the post office did not have a
693forwarding address for her.
697CONCLUSIONS OF LAW
70012. The Division of Administrative Hearings has
707jurisdiction over the parties to and the subject matter of this
718proceeding. Section 120.57(1), Florida Statutes.
72313. Petitioner has alleged that Respondent violated
730Sections 475.25(1)(b),(e),(k) and Section 475.42(1)(b), Florida
738Statutes, and Rule 61J2-14.009, Florida Administrative Code.
745Petitioner is seeking the revocation of Respondents license as a
755real estate salesperson. Petitioner has the burden to establish
764by clear and convincing evidence the allegations set forth in the
775administrative complaint. Ferris v. Turlington , 510 So.2d 292
783(Fla. 1987).
78514. Sections 475.25(1)(b),(e),(k), Florida Statutes,
792provide:
793(1) The commission may deny an application
800for licensure, registration, or permit, or
806renewal thereof; may place a licensee,
812registrant, or permittee on probation; may
818suspend a license, registration, or permit
824for a period not exceeding 10 years; may
832revoke a license, registration, or permit;
838may impose an administrative fine not to
845exceed $1,000 for each count, or separate
853offense; and may issue a reprimand, and any
861or all of the foregoing, if it finds that the
871licensee, registrant, permittee, or
875applicant:
876* * * *
880(b) Has been guilty of fraud or
887misrepresentation, concealment, false
890promises, false pretenses, dishonest dealing
895by trick or scheme, or device, culpable
902negligence, or breach of trust in any
909business transaction in this state or any
916other state, nation, or territory; has
922violated a duty imposed upon him by law or by
932the terms of a listing contract, written,
939oral, express, or implied, in a real estate
947transaction; has aided, assisted, or
952conspired with any other person engaged in
959any such misconduct and in furtherance
965thereof; or has formed an intent, design, or
973scheme to engage in any such misconduct and
981committed an overt act in furtherance of such
989intent, design, or scheme. It is immaterial
996to the guilt of the licensee that the victim
1005or intended victim of the misconduct has
1012sustained no damage or loss; that the damage
1020or loss has been settled and paid after
1028discovery of the misconduct; or that such
1035victim or intended victim was a customer or a
1044person in confidential relation with the
1050licensee or was an identified member of the
1058general public.

1064(e) Has violated any of the provision s of
1073this chapter or any lawful order or rule made
1082or issued under the provision of this chapter
1090or chapter 455.
1093* * * *
1097(k) . . .[H]as failed, if a salesperson, to
1106immediately place with his registered
1111employer any money, fund, deposit, check, or
1118draft entrusted to him by any person dealing
1126with him as an agent of his registered
1134employer. . . .
113815. The Department has established by clear and convincing
1147evidence that Shigley violated Sections 475.25(1)(b),(e), (k),
1155Florida Statutes, by accepting, cashing, and not depositing the
1164check from Bich Hue and Minh Huynh in an escrow account. Further
1176Shigley failed to give the money to the Seller or to return the
1189funds to the Buyers.
119316. Section 475.42(1)(b), Florida Statutes, provides:
1199No person licensed as a salesperson shall
1206operate as a broker or operate as a
1214salesperson for any person not registered as
1221his employer.
122317. The Department has established by clear and convincing
1232evidence that Shigley violated Section 475.42(1)(b), Florida
1239Statutes by acting as a broker in the transaction involving the
1250Huynhs and Ms. Hopwood by negotiating a contract for sale and
1261purchase of property and collecting a deposit as escrow agent.
127118. Rule 61J2-14.009, Florida Administrative Code provides:
1278Every salesperson who receives any deposit,
1284as defined above, shall deliver the same to
1292the broker or employer no later than the end
1301of the next business day following receipt of
1309the item to be deposited. Saturday, Sundays
1316and legal holidays shall not be construed as
1324business days. Receipt by a salesperson or
1331any other representative of the brokerage
1337firm constitutes receipt by the broker for
1344purposes of 61J2-14.008(1)(d), Florida
1348Administrative Code.
135019. The Department has established by clear and convincing
1359evidence that Tam Shigley violated Rule 61J2-14.009, Florida
1367Administrative Code by failing to deliver the check from the
1377Huynhs to a broker or her employer.
1384RECOMMENDATION
1385Based on the foregoing Findings of Fact and Conclusions of
1395Law, it is
1398RECOMMENDED that a Final Order be entered finding that Tam
1408N. Shigley violated Sections 475.25(1)(b),(e),(k), and
1416475.42(1)(b), Florida Statutes, and Rule 61J2-14.009, Florida
1423Administrative Code and revoking her license as a real estate
1433salesperson.
