136STATEMENT OF THE ISSUES
140Whether Respondent committed the violation alleged in the
148administrative complaint; and, if so, what penalty should be
157imposed.
158PRELIMINARY STATEMENT
160This case began on July 5, 1996, when the Petitioner, Agency
171for Health Care Administration , entered an administrative
178complaint against the Respondent, G & M Special Nursing Care,
188Inc., d/b/a G & M Special Nursing Care, that alleged a violation
200of Rule 59A-8.0086(1)(d), Florida Administrative Code , and sought
208to levy a fine in accordance with Section 400.474, Florida
218Statutes . More specifically, the complaint alleged that
226Respondent had not admitted a patient since March of 1994.
236Thereafter, Respondent timely requested an administrative
242hearing, disputed the material allegations of the complaint, and
251the matter was forwarded to the Division of Administrative
260Hearings for formal proceedings on August 28, 1996.
268At the hearing, the Petitioner presented the testimony of
277Faye McGann and Faye Booker. Respondent presented the testimony
286of Graciela Alayon. Respondents exhibits numbered 1, 2, and 3
296have been admitted into evidence. The transcript of the
305proceeding was filed on February 6, 1997. The Respondents
314proposed recommended order has been considered in the preparation
323of this order. Petitioner has not submitted a proposed order.
333FINDINGS OF FACT
3361. The Petitioner is the state agency charged with the
346responsibility of regulating home health care agencies.
3532. A t all times material to this case, Respondent has been
365licensed as a home health care agency.
3723. On March 26, 1996, a registered nurse specialist went to
383the Respondents place of business to perform an annual survey.
393Such survey allows an agency to verify compliance with applicable
403rules and statutes of the Petitioner.
4094. In this instance, the surveyor requested the files of
419the Respondents active patients. Since there were no active
428files on the date in question, Respondent was unable to produce
439same. The surveyor did not review the Respondents files for the
450preceding six months to determine if the agency had had an active
462patient within that time frame. Nor did the surveyor request the
473files for any active patients for the last six months.
4835. In fact, Respondent provided direct nursing services to
492a patient between November 11, 1995, and November 24, 1995.
5026. At all times material to the allegations of this case,
513Respondent provided nursing and home health aide services to
522another agency, but also provided direct nursing services to at
532least one of its own patients every six months.
541CONCLUSIONS OF LAW
5447. The Division of Administrative Hearings has jurisdiction
552over the parties to, and the subject matter of, these
562proceedings.
5638. Section 400.474, Florida Statutes , authorizes the
570Petitioner to deny, revoke, or suspend a license, or impose an
581administrative fine in the manner provided in chapter 120, for a
592violation of the chapter or applicable rules of the Agency for
603Health Care Administration (AHCA).
6079. Rule 59A-8.0086(1)(d), Florida Administrative Code ,
613provides:
614The AHCA shall deny an initial or renewal
622application for license, or impose a fine,
629* * *
632(d) if the applicant fails to provide at
640least one service directly to patients for a
648period of six consecutive months
65310. In this case, the Petitioner bears the burden of proof
664to establish the allegations of the administrative complaint. It
673has failed to meet that burden. First, the administrative
682complaint alleged that the Respondent had not admitted a
691patient since March of 1994. There is no evidence that home
702health care agencies admit patients. Secondly, that Respondent
710may provide nursing and home health aide services to another home
721health care agency as alleged in the administrative complaint
730(paragraph 3a.) is not a violation of any rule or statute.
74111. If Petitioner intended to allege that Respondent failed
750to provide at least one service directly to patients for a
761period of six consecutive months, such claim would be contrary
772to the weight of the evidence presented in this case. In this
784regard Petitioner did not review the Respondents records for the
794six months preceding the survey, did not request documentation
803from Respondent regarding services provided in that time frame,
812and dismissed the record for a patient from November, 1995,
822without further inquiry. Petitioner has failed to meet its
831burden.
83212. The unrefuted evidence presented by Respondent
839establishes that the agency provided services as required by the
849rule and would have made the records available to the Petitioner
860at the time of the survey had a request for same been made.
873RECOMMENDATION
874Based on the foregoing Findings of Fact and Conclusions of
884Law, it is
887RECOMMENDED that the Agency for Health Care Administration
895enter a final order dismissing the administrative complaint
903against this Respondent.
