108STATEMENT OF THE ISSUE

112Whether the Petitioner is entitled to renewal of a foster

122care license.

124PRELIMINARY STATEMENT

126This case began on August 18, 1997, when the Department of

137Children and Family Services (Department) issued a letter

145informing Petitioner that a license to provide foster care would

155not be renewed. The basis for the denial included: substandard

165housekeeping standards; lack of stability in housing; inadequate

173medical care for a child in the home; and concerns that

184Petitioner's son was dealing illegal drugs. Thereafter,

191Petitioner timely requested an administrative hearing to contest

199the denial. The matter was then forwarded to the Division of

210Administrative Hearings for formal proceedings on September 11,

2181997.

219At the hearing, Petitioner's brother, Isaiah Stewart, was

227granted leave to assist Petitioner in the presentation of the

237case. Petitioner testified on her own behalf and offered the

247testimony of Isaiah Stewart. The Department presented the

255testimony of Daniella Arnold, a family services counselor;

263Alfredo Etienne, Petitioner's former foster care resident; Laura

271Williams, a foster parent liaison employed by the Department;

280Holly Plank, a family services counselor; Holly Dandy, a

289protective services counselor; Mary Bosco, the Department's

296operations and management consultant II; and Rebecca Ann Walker,

305the program operations administrator for the Department. The

313Department's Exhibits numbered 1, 2, 3, and 5 have been admitted

324in to evidence. The Department requested, and official

332recognition has been taken, of Section 409.175, Florida Statutes,

341as well as Rules 65C-13.010, and 65C-13.011, Florida

349Administrative Code.

351A transcript of the proceeding has not been filed. The

361parties were granted ten days from the hearing to file proposed

372recommended orders. The proposed order filed by the Department

381has been considered in the preparation of this order. The

391Petitioner has not timely filed a proposed order.

399FINDINGS OF FACT

4021. Petitioner, Betty Stewart, was licensed by the

410Department to operate a foster care home on August 5, 1991.

421Thereafter, until the instant matter arose, Petitioner received a

430renewal of this license.

4342. On August 18, 1997, the Department notified Petitioner

443that her license would not be renewed. The decision was based

454upon Petitioner's alleged failure to meet the minimum standards

463for foster parenting. More specifically, the denial alleged

471concerns with Petitioner which included:

476Standard housekeeping standards. Counselors

480have reported that your home was not kept

488clean. They noted a stale odor, and observed

496clothes piled up and roach infestations.

502Lack of stability in housing. The licensing

509record indicates that you have had at least

517five different residences since you were

523licensed in 1991. Constant moving does not

530provide stability for the children placed

536with you.

538Inadequate medical care for a child in our

546home. The counselor for a child who had been

555in your home indicated that you failed to get

564timely dental care for a child in your home

573that resulted in the child needing to have a

582tooth extracted. Additionally it was

587reported that you did not follow-up with

594getting a dermatologist's prescription filled

599for this same child.

603Concerns that your son was dealing in illegal

611drugs. While your son did not live with you,

620he was in and out of your home and having

630contact with the foster children in your

637home, which in fact could have a potentially

645negative impact on them. You did admit to

653Laura Williams, the foster parent liaison,

659that you were aware that he was dealing

667drugs.

6683. During the time of Petitioner's licensure, she was

677licensed at five different locations. That is, she moved from

687one property to another and relicensed the new location, five

697times in six years.

7014. Additionally, during the time of licensure, Petitioner

709received a "provisional license" on four occasions. A

717provisional license is issued when the applicant must take

726additional measures to comply with all licensure requirements.

734On four occasions the Department worked with the Petitioner so

744that she would obtain licensure.

7495. For each license, Petitioner executed an agreement to

758provide substitute care for dependent children as prescribed by

767the Department. This agreement required Petitioner to comply

775with all rules implemented for foster care homes and specifically

785required Petitioner to report any illness of a child to the

796Department.

7976. In one instance, the Petitioner failed to seek immediate

807dental care for a child placed in her home. The dental problem

819was made known to the Department when the child was caught

830shoplifting Oragel, an over-the-counter product used to relieve

838toothache.

8397. Petitioner also did not compel a child to attend

849counseling sessions with a licensed therapist. Petitioner was

857responsible for assuring that the child be given transportation

866to and from such sessions.

8718. Although limited to two children by license restriction,

880Petitioner typically had more than two children placed in her

890home.

8919. Given the shortage for foster care homes, the Department

901routinely waived the limit and placed additional children with

910Petitioner even though she was ill-equipped to deal with the

920extra children.

92210. The Petitioner's son, who is now deceased, did not

932reside with Petitioner during the final licensure period.

940Although he resided in the community near her home, there is no

952evidence to support a finding that he was dealing drugs from the

964licensed premises.

966CONCLUSIONS OF LAW

96911. The Division of Administrative Hearings has

976jurisdiction over the parties to, and the subject matter of,

986these proceedings.

98812. Section 409.175(2)(f), Florida Statutes, provides:

"994License" means "license" as defined in s.

1001120.52(9). A license under this section is

1008issued to a family foster home or other

1016facility and is not a professional license of

1024any individual. Receipt of a license under

1031this section shall not create a property

1038right in the recipient. A license under this

1046act is a public trust and a privilege, and is

1056not an entitlement. This privilege must

1062guide the finder of fact or trier of law at

1072any administrative proceeding or court action

1078initiated by the department.

108213. Subsection (4) of Section 409.175, Florida Statutes,

1090authorizes the Department to adopt rules for foster care homes.

1100Such rules have been promulgated and are found in Rule

111065C-13.010, Florida Administrative Code.

111414. Rule 65C-13.010, Florida Administrative Code, provides,

1121in pertinent part:

1124(1) Substitute Care Parents' Role as a Team

1132Member.

1133(b) Family Care Activities

11371. Daily living tasks.

1141a. The substitute care parents are

1147expected to provide structure and daily

1153activities designed to promote the individual

1159physical, social, intellectual, spiritual,

1163and emotional development of the children in

1170their home.

11726. Health Care . . .

1178b. The substitute care parents are

1184expected to transport children for medical,

1190dental or other appointments which may be

1197needed.

1198c. The substitute care parents must inform

1205the counselor of medical and dental treatment

1212of children, and keep clear records of these

1220treatments.

122115. In this case, the Department has established that the

1231Petitioner has not met the minimum requirements for licensure as

1241a foster care parent. Moreover, Petitioner has not demonstrated

1250that she does meet the requirements. Petitioner's history of

1259moves demonstrates a lack of structure and stability which foster

1269care children must have. Moreover, Petitioner failed to provide

1278care to a child requiring dental treatment, failed to notify the

1289Department of the health problem, and failed to insist that the

1300child attend counseling.

130316. Foster care children require structure and consistent

1311interaction between the foster care licensee and the child. In

1321this regard, Petitioner let a minor child "go and come" as he

1333pleased. The child did not attend counseling sessions or school

1343on many occasions. Petitioner had the responsibility of

1351parenting the child. Petitioner was charged with the duty of

1361assisting the child with dental care, therapy transportation, or

1370whatever service might be needed to meet his needs. She failed

1381to do so.

138417. While the agency contributed to Petitioner's failures

1392by placing too many children in her home, it is evident

1403Petitioner did not meet the minimum standards for licensure at

1413the time of the renewal request regardless of the number of

1424children assigned to her home. Future licensure may be available

1434to Petitioner provided she is able to establish stability in her

1445residence and additional training in the requirements for

1453licensure.

1454RECOMMENDATION

1455Based on the foregoing Findings of Fact and Conclusions of

1465Law, it is RECOMMENDED that the Department enter a Final Order

1476denying Petitioner's request for license renewal as a foster care

1486home.
