232PRELIMINARY STATEMENT

234By joint motion filed August 14, 1997, Respondents and

243Intervenor seek dismissal of the Petition Challenging Plan

251Amendments and Findings of Compliance.

256The gravamen of the motion is that Petitioner Russ lacks

266standing to bring this proceeding in that he is not an "affected

278person" within the definition set forth in Section

286163.3184(1)(a), Florida Statutes.

289At the hearing upon the joint motion, Respondents and

298Intervenor presented testimony of three witnesses and two

306exhibits, in addition to affidavits attached to the joint motion.

316Petitioner Russ testified in his own behalf. No transcript of

326the hearing was provided. The parties waived the submission of

336proposed findings of fact.

340FINDINGS OF FACT

3431. Petitioner Russ did not submit oral comments to the

353local governments between the time of the transmittal hearing for

363the plan amendment at issue in this case and the adoption of the

376plan amendment.

3782. Petitioner Russ testified that he faxed letters to

387Tallahassee City Commissioner Ron Weaver and Leon County

395Commissioner Gary Yordan during the required time period, but

404this assertion is not corroborated by any other testimony or

414exhibits. Although Petitioner Russ testified that he used paper-

423printed original documents to effectuate the fax of the written

433comments or letters, he did not present any documentary evidence

443in corroboration. He presented no documents or other evidence of

453attempts to follow-up or confirm receipt of his faxed comments by

464the local governments.

4673. A reasonable, diligent and thorough search by those

476personnel charged with responsibility for maintaining

482correspondence files of City Commissioner Ron Weaver and Leon

491County Commissioner Gary Yordan, as well as the joint city/county

501planning department, was conducted in order to locate the written

511comments purportedly faxed to the local governments by Petitioner

520Russ. No documents, relating to those written comments and

529allegedly sent during the comment period for the plan amendment,

539have been found.

5424. Petitioner Russ admitted at the hearing that he possesses

552copies of all correspondence and pleadings generated by himself

561in this challenge to the amended plan with exception of those

572initial written comments.

5755. In the course of his testimony, Petitioner Russ

584speculated with regard to his inability to corroborate his

593assertion that he did fax written comments. That speculation

602included his supposition that computerized copies of the

610documents in his computer may have been lost through possible

620destruction of the files during a computer repair or renovation,

630or that he might have saved the documents on a floppy disk which

643has subsequently been misplaced.

6476. The overwhelming evidence clearly and convincingly

654establishes that the documents are not, and have never been, in

665the possession of the local governments in this case. Such

675evidence results in the finding that contrary testimony, absent

684some extrinsic corroboration that the documents were submitted,

692cannot be credited.

695CONCLUSIONS OF LAW

6987. The Division of Administrative Hearings has jurisdiction

706of the parties and subject matter of this proceeding. Section

716120.57 and Chapter 163, Florida Statutes.

7228. Communications in the era of cyberspace and the

731information highway include electronic transmission of documents.

738Further, electronically transmitted documents share a common

745definition with conventional written documents under the Florida

753evidence code. Section 90.951, Florida Statutes. It would

761therefore appear that cases involving disputes over receipt of

770documents sent through electronic technology should be resolved

778in the same manner as conventionally mailed documents; through a

788fact finding inquiry or evidentiary hearing such as the instant

798proceeding.

7999. The mailing of an item creates a presumption that the

810item was indeed received, but the presumption is a rebuttable

820one. Additionally, mere denial of receipt is inadequate to

829overcome the presumption. Scutieri v. Miller , 584 So. 2d 15,16

840(Fla. 3rd DCA 1991). Consequently, Respondents and Intervenor

848were given, and utilized, their opportunity to offer proof in

858support of the local governments’ denials of receipt of

867Petitioner Russ’s written comments. That proof creditably and

875convincingly established that the local governments in this

883matter did not receive the purported correspondence of Petitioner

892Russ. That proof was not effectively refuted because Petitioner

901Russ was unable to corroborate his assertion that he had

911submitted the required written comments.

91610. In order for Petitioner Russ to maintain these

925proceedings, he must meet "standing" requirements of Section

933163.3184(1)(a), Florida Statutes, which requires, in pertinent

940part, that an "affected person" shall:

946have submitted oral or written comments,

952recommendations, or objections to the local

958government during the period of time

964beginning with the transmittal hearing for

970the plan or plan amendment and ending with

978the adoption of the plan or plan amendment.

98611. Absent creditable proof to establish his submittal of

995the required written comments or their receipt by the local

1005governments, Petitioner Russ has not met the standing requirement

1014of submitting written comments within the specified time frame.

1023He does not possess standing to maintain this challenge to the

1034plan amendment which is the subject of this proceeding.

1043RECOMMENDATION

1044It is recommended that a final order be entered in this

1055case, Division of Administrative Hearings Case Number 97-2750GM,

1063finding that Petitioner Russ is without standing to maintain

1072these proceedings and dismissing his Petition Challenging Plan

1080Amendments And Findings of Compliance.
