132Whether the Respondent committed the violation alleged and,

140if so, what penalty should be imposed.

147PRELIMINARY STATEMENT

149The Petitioner, Department of Business and Professional

156Regulation (Department), filed an Administrative Complaint

162against the Respondent, James L. Brown, on November 2, 1998. The

173complaint alleged that the Respondent violated Section

180468.621(1)(f), Florida Statutes. More specifically, the

186complaint alleged that the Respondent filed a false record by

196initialing inspections reports prior to being licensed to do so.

206The Respondent timely filed an Election of Rights disputing the

216allegations of fact and requested a formal hearing. The matter

226was forwarded to the Division of Administrative Hearings for

235formal proceedings on December 23, 1998.

241The case was placed in abeyance during a time when the

252parties attempted to reach a settlement. After the parties'

261stipulated settlement agreement was rejected by the Board, the

270matter was rescheduled for final hearing for August 8, 2000.

280This case was heard concurrently with Department of Business and

290Professional Regulation, Building Code Administrators and

296Inspectors Board v. Bobby T. Chambers , DOAH Case No. 99-4892. A

307separate Recommended Order has been entered in that matter. The

317record of both cases will be forwarded to the Department

327together.

328At the hearing, the Petitioner presented testimony from

336Martin A. Joyce, Jr.; Charles Sabin, and Robert Holsclaw. The

346Petitioner's Exhibits 1 through 4 and 7 through 10 were admitted

357into evidence. Official recognition was taken of the provisions

366of law cited in the record. The Respondent presented testimony

376from Bartley D. Stuart and Kevin Hempel.

383The Transcript of the proceeding was filed with the Division

393of Administrative Hearings on August 30, 2000. The Petitioner

402was granted leave to late-file a Proposed Recommended Order. All

412proposed orders have been fully considered in the preparation of

422this order.

424FINDINGS OF FACT

4271. The Petitioner is the state agency charged with the

437responsibility of regulating building code administrators and

444inspectors.

4452. At all times material to the allegations of this case,

456the Respondent was either an applicant for licensure or held a

467building inspector license, license number BN 0002765.

4743. At all times material to this case, the Respondent was

485employed by the Martin County Building Department as a Building

495Inspector.

4964. Harriet R. Edwards owns a residence located at 2595

506Hickory Avenue, Jensen Beach, Florida. This home is located in

516Martin County, Florida.

5195. At some point in early 1996, it became Ms. Edwards'

530desire to construct an addition to her residence. She retained a

541contractor to perform the work and returned to Ohio during the

552time of the construction.

5566. When Ms. Edwards returned to Florida she was

565dissatisfied with the quality of the work. Mr. Joyce,

574Ms. Edwards' friend, expressed that they had expressed a desire

584for, and requested only, a high quality of work for the addition

596to Ms. Edwards' home.

6007. Upon investigation it was discovered that the permit

609card located at the construction site had been initialed by the

620Respondent. All of the inspections listed on the permit card

630occurred prior to December 17, 1996.

6368. The Respondent was issued a provisional license to

645perform building inspections on or about December 17, 1996.

6549. All of the inspections initialed by the Respondent had

664been performed by another inspector employed by the Martin County

674Building Department, Bobby T. Chambers. Mr. Chambers was fully

683licensed at the times of the inspections and acted as the

694Respondent's training supervisor.

69710. The Respondent accompanied Mr. Chambers during a

705training period during which time Mr. Chambers was to instruct

715the Respondent in the procedures and practices of the Martin

725County Building Department.

72811. At all times material to the allegations of this

738complaint, the Martin County Building Department allowed

745unlicensed employees to assist its inspectors at construction

753sites. Such employees were authorized to initial permit cards

762and to radio to the main office the information regarding

772inspections performed at the job sites. Because of this informal

782and haphazard reporting system the official records maintained by

791the County falsely reflected that the Respondent had performed

800the inspections listed in this Administrative Complaint. He did

809not. The records were maintained inaccurately.

81512. By initialing the permit card and transmitting the

824information to the County, the Respondent was performing his

833duties as an employee-in-training and as directed by his

842supervisors. The Respondent did not intend to mislead officials

851and did not intend to file a false report required by law.

86313. As a result of the flawed training system used by the

875Martin County Building Department, this Respondent initialed

882permit documents prior to licensure.

887CONCLUSIONS OF LAW

89014. The Division of Administrative Hearings has

897jurisdiction over the parties to and the subject matter of these

908proceedings.

90915. The Petitioner bears the burden of proof in this cause

920to establish by clear and convincing evidence the allegations of

930the violation.

93216. Section 468.621(1), Florida Statutes, provides, in

939pertinent part:

941(1) The following acts constitute grounds

947for which the disciplinary actions in

953subsection (2) may be taken:

958* * *

961(f) Making or filing a report or record

969which the certificateholder knows to be

975false, or knowingly inducing another to file

982a false report or record, or knowingly

989failing to file a report or record required

997by state or local law, or knowingly impeding

1005or obstructing such filing, or knowingly

1011inducing another person to impede or obstruct

1018such filing.

102017. The Petitioner has failed to establish that this

1029Respondent knowingly filed a false report. In this case the

1039clear and convincing evidence established that this Respondent

1047was following the instructions and training given to him. The

1057County supervisors directed the instant conduct. This Respondent

1065should not face administrative penalties due to a

1073miscommunication in the recording of the name of the person who

1084actually performed the inspections. Mr. Chambers admitted he

1092performed the inspections described in this case. The

1100Respondent's conduct in this case was in accordance with the

1110employer's directives and was not an attempt to obstruct the

1120accurate filing of required inspection records.

1126RECOMMENDATION

1127Based on the foregoing Findings of Fact and Conclusions of

1137Law, it is RECOMMENDED that the Department of Business and

1147Professional Regulation, Building Code Administrators and

1153Inspectors Board, enter a final order dismissing the

1161Administrative Complaint against this Respondent.
