114STATEMENT OF THE ISSUES
1181. Was the Department of Education's (Department) refusal
126to review and evaluate Nationwide Credit, Inc.'s (Nationwide)
134response to the Department's Request for Proposal, Collection

1722. Was the Department's failure to consider the reason for

197PRELIMINARY STATEMENT
199This cause is a challenge to the Department's refusal to
209review and evaluate Nationwide's response to the Department's
217RFP. The RFP was issued by the Department on October 9, 1998.
229Nationwide filed a Formal Written Protest and Petition for
238Administrative Hearing (Petition) on February 26, 1999. On
246March 11, 1999, an informal meeting was held which proved to be
258unsuccessful. The Petition was then forwarded to the Division of
268Administrative Hearings (Division) by the Department for the
276assignment of an Administrative Law Judge and for the conduct of
287a hearing. The undersigned Administrative Law Judge was assigned
296to hear this matter and a hearing was scheduled for
306April 15, 1999.
309At the hearing, Nationwide presented the testimony of
317David Lubets. Nationwide's Exhibits Numbered 1A-1C and 2 were
326received as evidence. The Department presented the testimonies
334of Henry C. Bergmann (incorrectly spelled in trial Transcript as
"344Burgmann") and Ashley Roseborough. Department's Exhibits
351Numbered 1 and 2 were received as evidence. Joint Exhibits
361Numbered 1-6 were received as evidence. Chapter 287, Florida
370Statutes; Rules 60A-1.001 and 60A-1.002, Florida Administrative
377Code; and Form PUR 7033 Revised 6/1/98, Request for Proposal were
388officially recognized. On May 4, 1999, subsequent to the filing
398of the Transcript but prior to the filing of the parties'
409proposed recommended orders, Nationwide filed a Request for
417Judicial Notice and Motion to Supplement the Record which shall
427be treated as a request for official recognition. After
436consideration of it, the request was granted and the Department
446of Education's Motion to Relinquish Jurisdiction and Remand to
455Agency, in Collection Technology, Inc, vs. Department of
463Education , Case No. 99-1901BID and the Department's same motion
472in NCO Financial Inc. vs. Department of Education , Case No. 99-
4831902BID , were officially recognized.
487A Transcript of this proceeding was filed with the Division
497on April 29, 1999. The parties filed their Proposed Recommended
507Orders.
508FINDINGS OF FACT
511Upon consideration of the oral and documentary evidence
519adduced at the hearing, the following relevant findings of fact
529are made:
5311. Nationwide is a foreign corporation authorized to do
540business in the State of Florida. Nationwide is in the business
551of collecting defaulted student loans and has worked with the
561State of Florida, and specifically the Department, for
569approximately nine years.
5722. On October 9, 1998, the Department issued RFP No.99-06,
582which solicited proposals for the provision of collection
590services for defaulted student loans. The technical requirements
598and requests found in the RFP were prepared by the Office of
610Student Financial Affairs (OSFA) which was the section within the
620Department requesting the services and the section which
628ultimately performed the review and evaluation of the responses
637to the RFP.
6403. The initial deadline for receipt of responses to the RFP
651was 3:00 p.m. Eastern Standard Time (EST) on December 3, 1998.
662The responses were to be delivered to the Department's Office of
673Purchasing for initial inspection and distribution to OSFA.
6814. The Department, through four separate RFP addenda,
689received and accepted by Nationwide, revised and postponed the
698response deadline until January 20, 1999, at 3:00 p.m. EST. The
709postponement was caused by the delay of the Department responding
719to questions posed by prospective vendors during the question and
729answer portion of the RFP procurement process.
7365. Nationwide had been prepared to submit it proposal to
746the Department on the date of the previous deadlines.
7556. The Department scheduled the deadline for receipt of
764proposals at 3:00 p.m. to accommodate those prospective vendors
773who used third-party delivery services.
7787. The response review process as established by the RFP
788consisted of the following: (a) a review of the technical
798components to be completed by February 3, 1999; (b) a cost
809proposal evaluation to be completed by February 9, 1999; and (c)
820a posting of intended award by February 16, 1999. In accordance
831with the RFP, multiple contracts were to be entered into based on
843the highest ranked responses. The actual signing of these
852contracts was not to occur until March 1999, after approval of
863the awards by the State Board of Education.
8718. Nationwide has previously provided the Department with
879the same services called for by the RFP. It was Nationwide's
890wish that it continue to provide those services and accordingly,
900its employees expended between 50 and 70 hours preparing
909Nationwide's response.
9119. On January 19, 1999, Nationwide, from its office in
921Marietta, Georgia, utilized a third party, Federal Express, to
930deliver Nationwide's response to the Department's RFP.
937Nationwide's general business practice is to use Federal Express
946and there has never been a problem with late delivery.
956Nationwide does not have an office in Tallahassee, Florida.
965Nationwide's only Florida office is in south Florida.
97310. Nationwide directed Federal Express to ship its
981response to the RFP by Priority Overnight Service and further
991directed Federal Express to deliver Nationwide's response to the
1000RFP to the Department by 10:00 a.m. EST on January 20, 1999.
1012These instructions to Federal Express were clearly reflected on
1021the Airbill. Federal Express picked up Nationwide's proposal at
10301:20 p.m. EST on January 19, 1999. Due to an error in the
1043Federal Express distribution process, Nationwide's response to
1050the RFP was not delivered to the Department until January 21,
10611999, at 10:41 a.m. EST.
106611. Nationwide did not contact the Department on
1074January 20, 1999, after 10:00 a.m. EST (the time Federal Express
1085was to deliver Nationwide's proposal) to determine if its
1094proposal had been delivered timely by Federal Express.
110212. There was sufficient time between 10:00 a.m. and
11113:00 p.m. on January 20, 1999, for Nationwide to hand deliver its
1123proposal to the Department had Nationwide been aware that its
1133proposal had not been delivered by Federal Express as requested
1143by Nationwide.
114513. Eighteen responses were submitted to the Department's
1153Office of Purchasing prior to 3:00 p.m. EST on January 20, 1999.
1165In order to ensure that no vendor had access to another vendor's
1177proposal, the proposals were locked in a secured room. At
11873:01 p.m. EST on January 20, 1999, the Office of Purchasing
1198physically opened the 18 responses that were timely submitted and
1208in its possession. The Office of Purchasing then conducted an
1218initial review which included a tabulation of the responses to
1228ensure that all responses satisfied procedural requirements. The
1236timely proposals were also inspected to ensure that the
1245appropriate transmittal letter was enclosed. The Office of
1253Purchasing did not open the technical or price components of the
1264responses.
126514. Once the initial review was completed by the Office of
1276Purchasing, the proposals were sent to OSFA for purposes of
1286conducting the detailed technical review contemplated by the RFP.
1295The initial review by the Office of Purchasing took two days, and
1307the proposals were not forwarded to OSFA until around
1316January 25, 1999.
131915. At the time Nationwide's proposal was received by the
1329Department, the Office of Purchasing was still in the process of
1340completing its initial review. None of the timely proposals had
1350been forwarded to OSFA for detailed review at this time.
136016. By letter dated January 27, 1999, the Department
1369advised Nationwide that its proposal had been received after the
1379deadline and that its proposal must be "retrieved no later than
1390February 15, 1999." At this time, the evaluation of the
1400technical and costs proposals by OSFA had not been completed.
1410The Department similarly advised another vendor whose proposal
1418had been received 30 minutes after the deadline. Nationwide did
1428not retrieve its proposal, and it still remains in an unopened
1439state with the Department.
144317. The Department rejected Nationwide's proposal without
1450any consideration being given to the circumstances surrounding
1458the untimeliness of Nationwide's proposal. At the time
1466Nationwide's proposal was rejected, the Office of Purchasing had
1475knowledge of the fact that Nationwide had submitted its proposal
1485to Federal Express in advance of the due date and in sufficient
1497time to be delivered timely to the Department.
150518. On February 8, 1999, after contacting the Office of
1515Purchasing to determine the reasons for the rejection of its
1525proposal, Nationwide provided the Department with a written
1533explanation from Federal Express explaining why Nationwide's
1540proposal was untimely. Nationwide then requested the Department
1548to consider the circumstances and use its discretion to waive the
1559late filing and review the proposal.
156519. By letter dated February 12, 1999, the Department
1574advised Nationwide that it was unable to consider Nationwide's
1583untimely proposal. It is the Department's policy that, under the
1593purchasing rules of the State of Florida, it should never
1603consider or review a proposal received from a vendor after the
1614date and time specified in the RFP regardless of the reason for
1626the untimeliness. However, the Department did indicate that it
1635may waive that policy where the untimeliness is due to an "act of
1648God," such as a tornado or hurricane, which prevented timely
1658delivery or resulted in the Department's office being unable to
1668accept delivery in a timely fashion.
167420. General Conditions, Paragraph 3, of Form PUR-7033,
1682revised 6/1/98, provides in relevant part as follows:
1690PROPOSAL OPENING: Shall be public, on the
1697date, location, and the time specified on the
1705acknowledgement form. It is the proposer's
1711responsibility to assure that this proposal
1717is delivered at the proper time and place of
1726the proposal opening. Proposals which for
1732any reason are not so delivered, will not be
1741considered. (Emphasis furnished.)
174421. Section 40.16 of the RFP provides as follows:
175340.16 PUBLIC OPENING OF PROPOSALS
1758Each proposal will be dated, time-marked, and
1765logged by the department as received. Each
1772will also be examined to verify that it is
1781properly addressed and sealed. Any proposal
1787received after the specified date and time
1794for receipt of proposals will be rejected and
1802returned unopened to the contractor.

180922. Section 40.17 of the RFP provides as follows:
181840.17 REJECTION OF PROPOSALS
1822Proposals which do not conform to the
1829requirements of this Request for Proposal may
1836be rejected by the department. Proposals may
1843be rejected for reasons which include, but
1850are not limited to, the following:

1859The proposal is received late. (Emphasis

186623. Section 40.15 of the RFP provides as follows:
187540.15 ACCEPTANCE OF PROPOSALS
1879* * *
1882The department also reserves the right, in
1889its sole discretion, to waive minor
1895irregularities in proposals . A minor
1901irregularity is a variation from the Request
1908for Proposal which does not affect the price
1916of the proposal, or give the contractor an
1924advantage or benefit not enjoyed by other
1931contractors, or adversely impact the interest
1937of the department . (Emphasis furnished.)
1943CONCLUSIONS OF LAW
194624. The Division of Administrative Hearings has
1953jurisdiction over the parties and the subject matter of this
1963proceeding pursuant to Section 120.57(1), Florida Statutes.
197025. Section 120.57(3)(f), Florida Statutes, provides as
1977follows:
1978(f) In a competitive-procurement protest, no
1984submissions made after the bid or proposal
1991shall be considered. Unless otherwise
1996provided by statute, the burden of proof
2003shall rest with the party protesting the
2010proposed agency action. In a competitive-
2016procurement protest, other than a rejection
2022of all bids, the administrative law judge
2029shall conduct a de novo proceeding to
2036determine whether the agency's proposed
2041action is contrary to the agency's governing
2048statutes, the agency's rules or policies, or
2055the bid or proposal specifications. The
2061standard of proof for such proceedings shall
2068be whether the proposed agency action was
2075clearly erroneous, contrary to competition,
2080arbitrary, or capricious. . . . (Emphasis
2087furnished.)
208826. Clearly, Nationwide has failed to establish facts to
2097show that the Department's proposed action is contrary to its
2107governing statutes, rules or policies, or proposal
2114specifications. While the Department may have the discretion to
2123accept and review an untimely proposal, it has always been its
2134policy not to exercise that discretion, except possibly in
2143situation where the untimeliness is caused by an "act of God."
2154Based on the foregoing Findings of Fact and Conclusions of
2164Law, it is
2167RECOMMENDED that the Department enter a final order
2175dismissing Nationwide's protest.
