95STATEMENT OF THE ISSUE

99The issue for consideration in this hearing is whether

108Petitioner meets the academic requirements for licensure as a

117registered nurse in Florida.

121PRELIMINARY MATTERS

123By Notice of Educational Deficiency dated May 20, 1999, the

133Board of Nursing notified Petitioner, Pascal Canesse, that a

142review of his nursing education reflects insufficient

149classroom/clinical instruction in obstetrical nursing to meet the

157educational standards for examination for licensure as a

165registered nurse in Florida. By petition dated September 20,

1741999, Petitioner requested formal hearing on the agency’s

182proposed denial, and this hearing ensued.

188At the hearing, Petitioner testified in his own behalf and

198presented the testimony of Ashley L. Canesse, his wife; Michelle

208Allen, director of critical care at Blake Hospital and

217Petitioner’s supervisor; and Mary Kay Jacobsen, nursing education

225director for the Florida Board of Nursing. Petitioner also

234introduced Petitioner’s Exhibits 2 and 4 through 9. Respondent

243also presented the testimony of Ms. Jacobsen and introduced

252Respondent’s Exhibit A.

255A Transcript of the proceedings was provided. Subsequent to

264the hearing, both counsel submitted matters in the form of

274proposed recommended orders which have been carefully considered

282in the preparation of this Recommended Order.

289FINDINGS OF FACT

2921. At all times pertinent to the issues herein, Respondent,

302Board of Nursing, has been the state agency responsible for the

313licensing of registered and licensed practical nurses in Florida

322and the regulation of the nursing profession in this state.

3322. On November 25, 1998, while residing in France,

341Petitioner, Pascal Canesse, filled out an application for nursing

350licensure (DH Form 1204. 8/98), seeking licensure by examination

359as a registered nurse in Florida which he submitted in January

3701999.

3713. Prior to the hearing, the parties stipulated, and it is

382found, that:

384a. Petitioner attended the nursing program

390at Institute Formation en Soins Infirmiers

396(the Institute) in France from 1993 - 1995,

404b. The Official Transcript submitted by the

411Institute does not list classroom instruction

417or clinical practice in obstetrics.

422c. The Training Sessions, or clinical

428practice, portion of the Official Transcript

434submitted by the Institute includes a

440breakdown of 350 hours of surgery training

447that includes the following subject areas:

453(1) emergency

455(2) polyvalent intensive care

459(3) digestive surgery and urology

464d. The Form B submitted by the Institute

472states that Petitioner had 600 hours of

479classroom instruction and 490 hours of

485clinical practice in surgical nursing.

490e. The Training Sessions, or clinical

496practice, portion of the Official Transcript

502submitted by the Institute lists a total of

5101,715 hours of training.

515f. The theoretical Assessment portion of the

522Official Transcript submitted by the

527Institute does not include the number of

534hours of instruction but breaks down the

541training to include nursing care to patients

548in the following categories:

552(1) psychosis patients

555(2) patients with breathing problems

560(3) patients with ENT-stomatology-

564dermamtology troubles

566(4) patients with endocrinous troubles

571(5) patients with digestive troubles

576(6) patients with troubles of the

582nutriment duct

584(7) pediatrics and child psychiatry

589(8) elderly patients with

593neuropsychiatry troubes

595(9) elderly patients

598(10) patients with nervous system

603troubles

604(11) patients in emergencies-intensive

608care-blood transfusions

610(12) patients with

613hematology/urology/ nephrology

615troubles

616g. In answer to question 6 on his

624application, Petitioner stated that he

629completed 40 hours of training in obstetrical

636nursing under the categories listed on the

643transcript.

644h. The Form B anscript of Nursing

651Education in a Foreign Country submitted by

658the Institute and relating to Petitioner

664reflects that he received 40 hours of

671classroom instruction in obstetrical nursing.

676No hours of clinical practical in obstetrical

683nursing are reflected.

686i. In correspondence to the Board dated

693June 10, 1999, Petitioner set forth his

700explanation of the discrepancies in the

706application, Form B, and his transcript.

7124. Petitioner contends that when he filled out his

721application and the supporting documentation therefor, he listed

729525 hours of clinical medical nursing practice and 490 hours of

740clinical surgical nursing practice. While he reflected 40 hours

749of instruction in obstetric nursing, he failed to indicate any

759obstetric clinical practice. He claims the number of hours

768claimed as being in medical/surgical area comprises the number of

778hours in both, including obstetrics. His failure to enter any

788clinical practice in the obstetrics area was the result of a

799combination of that discipline with medical/surgical training as

807is done in France. This reflects clinical hours only. His claim

818of 40 hours training is for classroom work in obstetrics only.

829It is not combined with surgery. It would have been much clearer

841if he had marked down the course he took rather than just the

854hours taken.

8565. A review of the Official Transcript provided by the

866Institute to be submitted to the Florida authorities in support

876of Petitioner’s application clearly fails to specifically

883indicate any obstetrical training.

8876. The "Addendum to Transcript" dated May 4, 1999, reflects

89770 hours of obstetric classroom in addition to two weeks'

907clinical obstetrics experience. This is different from the

915surgical nursing that had been combined with surgical nursing on

925the Form B originally submitted. Other documentation from the

934Institute, a letter dated June 25, 1999, indicates that two

"944weeks" is equivalent to 70 hours.

9507. That same letter notes that much of the training in

961France is hospital-based with a significant amount of training

970being clinical in nature with a heavy emphasis in surgery. The

981French authorities claim that those surgical hours are

989comprehensive, and it is in that curriculum that the students

999receive clinical and classroom obstetrics training, with the

1007clinical portion being a full two weeks - that is, "a minimum of

102070 hours."

10228. Petitioner also introduced a syllabus for the module in

1032the Institute’s nursing training program which relates to

1040gynecology. This reflects the areas covered and includes a

1049significant amount of information apparently related to

1056obstetrics and childbirth. The syllabus reflects an extensive

1064amount of clinical instruction over the three years of nursing

1074training. However, again, the supporting documentation does not

1082clearly quantify that portion of the training which deals with

1092obstetrics, nor does it show where the training is integrated

1102into the surgical nursing training as claimed by Petitioner.

11119. Petitioner was unable to convincingly recall at which

1120point in the three-year training program he took the required

1130clinical obstetrics training. At one point, in his deposition,

1139he claimed it was integrated in his emergency medicine training.

1149At hearing, however, he claimed it was integrated with medical

1159surgical training. The fact that the obstetrical clinic may have

1169been integrated with another service is not, of itself,

1178disqualifying. The Board of Nursing accepts integrated nursing

1186training, under certain conditions.

119010. When course integration is claimed, however, the Board

1199requires the submission of a detailed course outline that

1208delineates where the specific course content, here, obstetrics,

1216is presented. Further, the Board considers the integration of

1225obstetrics with emergency surgery as inappropriate because the

1233basic nature of the disciplines is not the same. While one is

1245reactive, the other is pro-active.

125011. No doubt, Petitioner was exposed to an obstetrics

1259curriculum which included both classroom and clinical

1266instruction. From the state of the evidence presented, however,

1275it is impossible to determine the breadth and content of this

1286exposure.

128712. According to Ms. Jacobsen, the Board’s nursing

1295education director, staff which reviewed Petitioner’s application

1302was concerned over the unexplained inconsistency in the

1310supporting documentation submitted therewith. None of the

1317information on the various submitted documentation matched. On

1325its Notice of Educational Deficiencies dated May 20, 1999, it was

1336suggested that Petitioner have his school write a letter

1345explaining the discrepancy. The Institute’s letter of June 25,

13541999 asserts that the required clinical training was provided,

1363but does not define with any particularity at which point in the

1375training the obstetrics discipline is treated. It appears to be

1385integrated into the surgical clinical training, but from the

1394state of the documentation presented, the particulars cannot be

1403determined.

1404CONCLUSIONS OF LAW

140713. The Division of Administrative Hearings has

1414jurisdiction over the parties and the subject matter of these

1424proceedings. Section 120.57(1), Florida Statutes.

142914. Petitioner in this case seeks to take the Florida

1439examination for licensure as a registered nurse. Section

1447464.008, Florida Statutes, requires applicants to show proof of

1456their graduation from an approved nursing program or equivalent

1465to be eligible to sit for the examination for licensure.

147515. An "Approved Program Equivalent" is defined in Rule

148464B9-3.001(2), Florida Administrative Code, as one conducted in a

1493school, college or university outside the State of Florida which

1503has been approved by the Board of Nursing in the jurisdiction in

1515which it is located, if such Board exists, and which demonstrates

1526it meets the criteria in the Rules of the Board of Nursing found

1539in Chapter 64B9-2, Florida Administrative Code.

154516. The specific requirements for professional nursing

1552programs, as defined by Rule 64B9-2.006(2), Florida

1559Administrative Code, include theoretical instruction and clinical

1566experience in medical, surgical, obstetric, pediatric, geriatric,

1573and psychiatric nursing. Rule 64B9-3.002(1)(c), Florida

1579Administrative Code permits the Board of Nursing to accept

1588evidence that training which is not approved by a state board of

1600nursing, such as foreign nursing training, is equivalent to that

1610required in Florida at the time of the application for licensure.

1621This rule also requires the applicant to demonstrate completion

1630of the program equivalent by submission of an official certified

1640transcript which specifically sets forth all courses successfully

1648completed.

164917. Notwithstanding Petitioner's genuine efforts to obtain

1656documentation that meets the rule requirement, he has not been

1666able to do so. Notwithstanding his assurances that the training

1676he received from the Institute included a comprehensive course of

1686both classroom and clinical training in obstetrics, the

1694documentation from the Institute does not specifically set forth

1703the courses relating to that discipline which Petitioner

1711completed. His inconsistent recollection of his obstetrical

1718training does not meet the rule requirements.

172518. It would appear that with the exception of the clinical

1736obstetrical training, Petitioner meets all other requirements to

1744sit for examination.

1747RECOMMENDATION

1748Based on the foregoing Findings of Fact and Conclusions of

1758Law it is recommended that Petitioner’s application to sit for

1768examination for licensure as a registered nurse in Florida be

1778denied until he provides sufficient explanation of the clinical

1787training he received in obstetrical nursing or proof of

1796completion of the required training at an alternative approved

1805site.
