137STATEMENT OF THE ISSUE
141The issue for determination is whether Respondent
148discriminated against Petitioner on the basis of race, color,
157sex, religion, presu med handicap, national origin, age, and
166marital status; and whether Respondent retaliated against
173Petitioner in violation of the Florida Civil Rights Act of 1992,
184as amended.
186PRELIMINARY STATEMENT
188Anne R. Webster filed a Charge of Discrimination with the
198F lorida Commission on Human Relations (FCHR) against the
207Metropolitan Dade County, Clerk of the County Court (Clerk)
216alleging that the Clerk discriminated against her on the basis
226of race, color, sex, religion, presumed handicap, national
234origin, age, marit al status, and retaliation. On August 2,
2441999, the FCHR issued a Determination of No Cause and a Notice
256of Determination of No Cause. By Order filed October 27, 1999,
267the FCHR granted Ms. Webster an extension of time to file, on or
280before November 12, 19 99, a Petition of Relief from an Unlawful
292Employment Practice (Petition for Relief). Ms. Webster filed a
301Petition for Relief with the FCHR against the Clerk. On
311December 9, 1999, the FCHR referred this matter to the Division
322of Administrative Hearings (D OAH).
327The hearing was originally scheduled for March 10, 2000.
336Ms. Webster requested a continuance of the hearing, to which the
347Clerk did not object, and the hearing was continued. The
357hearing was re - scheduled for May 25, 2000. On May 5, 2000, a
371Notice of Appearance was filed by counsel for Ms. Webster.
381Subsequently, counsel for Ms. Webster requested a continuance,
389to which the Clerk did not object. The continuance was granted,
400and the hearing was re - scheduled for July 26, 2000. On July 20,
4142000, Ms. Webster's counsel filed another motion for
422continuance, to which the Clerk did not object, and the hearing
433was continued. Subsequently, the hearing was re - scheduled for
443November 8, 2000. By Order dated November 7, 2000, the hearing
454was continued and this matter was placed in abeyance based on
465the parties' representation that they were engaging in ongoing
474discovery and serious settlement negotiations. After a passage
482of time, the parties represented that settlement was not
491successful and, therefore, a hea ring was necessary; the hearing
501was scheduled for January 12, 2001. Afterwards, the parties
510requested a different hearing date, and the hearing date was
520changed to January 25, 2001.
525This matter was transferred to the undersigned. The
533hearing scheduled fo r January 25, 2001, was changed to a video
545teleconference hearing. On January 23, 2001, Ms. Webster's
553counsel of record filed a request to withdraw. The request to
564withdraw was heard at the hearing and was orally granted. An
575Order dated January 26, 2001 , was issued granting the request to
586withdraw. Additionally, on January 23, 2001, counsel for
594Ms. Webster requested a continuance of the hearing scheduled for
604January 25, 2001, to which the Clerk did not object. This
615motion was also considered at the hea ring. An Amended Order
626dated February 9, 2001, was issued granting the continuance and
636holding the case in abeyance to provide an opportunity for
646Ms. Webster to obtain new counsel or a qualified representative.
656Subsequently, an order was issued directing Ms. Webster to
665provide a status report as to her progress in obtaining
675representation in this matter. Base upon her response, the case
685was continued in abeyance by Order dated December 18, 2001. The
696parties again attempted to resolve this matter without the need
706for a hearing but were unsuccessful. Further, Ms. Webster was
716unable to obtain representation and was proceeding pro se . She
727frequently filed pleadings requesting the undersigned to
734instruct her as to how to handle her case, which the undersigne d
747could not do.
750By Order dated August 22, 2002, the parties were directed
760to provide dates for the re - scheduling of the hearing in this
773matter. The hearing was re - scheduled for June 10 and 11, 2003.
786Ms. Webster attempted to engage in discovery. She
794reque sted a continuance and the hearing scheduled for June 10
805and 11, 2003, was continued. With the concurrence of the Clerk,
816as guidance for and assistance to Ms. Webster, she was provided
827with a copy of McDonnell Douglas Corporation v. Green , 411 U.S.
838792, 9 3 S. Ct. 1817 (1973). The length of time necessary for
851the hearing increased, and the hearing was re - scheduled for
862March 16 through 18, 2004.
867The Clerk was engaging in discovery to which Ms. Webster
877was not responding. During a telephone conference, th e parties
887requested a re - scheduling of the hearing, which was granted, and
899the hearing was re - scheduled for April 14 through 16, 2004.
911A telephone conference was held regarding the Clerk's
919failure to adequately respond to discovery from Ms. Webster and
929reg arding a continuance of the hearing due to the inadequate
940responses. As to the continuance, the parties had been notified
950by the undersigned that a death had occurred in his family which
962prevented the hearing from going forward, and the hearing was
972cancel ed. By Order dated April 22, 2004, among other things,
983the Clerk was directed to sufficiently respond to the discovery
993and to show cause why sanctions should not be imposed.
1003Subsequently, Ms. Webster was filing pleadings and exhibits
1011which were confusing as to whether she desired to re - open
1023discovery, with the undersigned pointing - out that he was not
1034persuaded that discovery should be re - opened, and as to whether
1046pleadings filed by her and entitled exhibits were already
1055admitted and could be used as eviden ce at hearing, representing
1066that the Clerk already had copies of them. By Order dated
1077August 24, 2004, among other things, Ms. Webster was directed to
1088make a decision as to whether she wanted to re - open discovery,
1101which the undersigned was not persuaded s hould occur, the
1111parties were advised that rulings on the admissibility of
1120exhibits would be made at hearing, and the parties were directed
1131to provide dates for re - scheduling the hearing. The hearing was
1143re - scheduled for November 30 through December 2, 20 04.
1154Prior to hearing, the Clerk had agreed to assist in making
1165sure that certain witnesses appeared at hearing without being
1174served with a subpoena and had agreed that subpoenas for certain
1185witnesses would be accepted by an identified person in the
1195Clerk's office. Confusion developed in the Clerk's office as to
1205what was to be done regarding accepting the subpoenas, which
1215resulted in several pleadings being filed by Ms. Webster. Also,
1225among other things, Ms. Webster requested to have read into the
1236hearing record, instead of testifying, certain affidavits
1243prepared by her for her own testimony so that she would not be
"1256mis - understood"; the Clerk objected; and this request was
1266denied. Additionally, Ms. Webster requested that certain
1273documents that she regarde d as evidence of the Clerk's pretext
1284to be admitted into evidence prior to hearing and before any
1295argument by the Clerk would be permitted; the Clerk did not
1306respond to the request; and the undersigned denied the request
1316indicating that admissibility of do cuments was the decision of
1326the undersigned not the Clerk.
1331The final hearing in this matter was not concluded on
1341December 2, 2004. The hearing was re - scheduled for February 3
1353and 4, 2005.
1356Again, the final hearing in this matter was not concluded
1366on Februa ry 3 and 4, 2005. The hearing was re - scheduled for
1380August 24 through 26, 2005. The undersigned issued an order
1390regarding the appearances of witnesses on behalf of Ms. Webster.
1400As a result of a hurricane impacting the Miami area, the hearing
1412was not held on August 26, 2005. The hearing was re - scheduled
1425for December 15, 2005, at which time the final hearing was
1436completed.
1437At hearing, Ms. Webster testified in her own behalf,
1446presented the testimony of 23 witnesses, and entered 120
1455exhibits (Petitioner's Ex hibits numbered 1, 2B, 4A, 4B, 4C, 4E,

1586Ms. Webster, with the consent of the Clerk, proffered the
1596testimony of some of her witnesses. The Clerk did not call any
1608witnesses to testify and entered two e xhibits (Respondent's
1617Exhibits numbered 4 and 2) into evidence.
1624The Clerk ordered a transcript of the hearing. The
1633following volumes, with hearing dates, were filed by the Clerk
1643with DOAH, to which Ms. Webster filed pleadings protesting the
1653failure of the Clerk to file these volumes: on September 27,
16642005 -- Volumes I and II of the hearing held on November 30, 2004,
1678and Volume III of the hearing held on December 1, 2004; and on
1691September 28, 2005 -- Volume IV of the hearing held on December 1,
17042004, and Volume s V and VI of the hearing held on December 2,
17182004. The court reporter filed with DOAH, on September 14,
17282005, two volumes of the hearing held on August 24 and 25, 2005.
1741By an Amended Order to Show Cause dated December 9, 2005,
1752the Clerk was directed to s how cause why sanctions should not be
1765imposed for failing to file the volumes of the transcript for
1776the hearing held on February 3 and 4, 2005. At the hearing on
1789December 15, 2005, the Clerk persuaded the undersigned that good
1799cause existed not to impose sanctions for the failure to file
1810the volumes of the transcript. Three volumes for the hearing
1820held on February 3 and 4, 2005 were filed on December 23, 2005.
1833The Clerk filed with DOAH, on January 24, 2006, the one volume
1845of the transcript of the hearing held on December 15, 2005. All
1857of the volumes of the transcript had now been filed with DOAH.
1869At the request of the parties, the time for filing post -
1881hearing submissions was set for more than ten days following the
1892filing of the transcript. The Transcri pt, consisting of 12
1902volumes, was filed on September 14, 27, 28, and December 23,
19132005, and January 24, 2006. Ms. Webster filed her post - hearing
1925submission prior to the conclusion of the hearing, and,
1934therefore, she was permitted to file an amended post - h earing
1946submission. The Clerk requested an extension of time to file
1956its post - hearing submission; the request was granted, and the
1967post - hearing submission was accepted. Subsequently, Ms. Webster
1976requested to file an amendment to her post - hearing submissio n,
1988to which the Clerk did not file a response; the request was
2000granted, and the amendment was accepted. The Recommended Order
2009was further delayed by the undersigned's surgery.
2016The parties' post - hearing submissions were considered in
2025the preparation of thi s Recommended Order.
2032FINDINGS OF FACT
20351. Ms. Webster is a female, Caucasian, who prefers to be
2046referred to as "a White Anglo," and a Quaker of German descent.
2058She was born on September 7, 1943. At the time of the hearing,
2071she was married. She is a memb er of the protected class as it
2085relates to discrimination.
20882. At all times material hereto, the Clerk was an employer
2099as defined by the Florida Civil Rights Act of 1992, as amended.
21113. Ms. Webster has a Bachelor of Business Administration
2120and a Master of Business Administration. She was a certified
2130public accountant (CPA) but voluntarily relinquished her Florida
2138CPA license to the Board of Accountancy in October 2003.
21484. Ms. Webster had been an employee with Metropolitan Dade
2158County since February 21, 1 978. She was employed with the Clerk
2170as an Accountant II in the Comptroller's Division since 1982.
2180Adolphus James was the supervisor of her accounting unit and to
2191whom she reported.
21945. Mr. James' supervisor was Margaret Enciso, the Deputy
2203Comptroller. M s. Enciso reported to Martha Alcazar, the
2212Comptroller.
22136. Ms. Alcazar reported to Ricky Schechtman, the Director
2222of the Office of Administrative Services. Ms. Schechtman had
2231the authority to terminate employees under her supervision.
22397. Ms. Webster's un it was comprised of employees who were
2250majority Hispanic descent. In the unit, she saw herself as a
"2261minority White Anglo American woman of Quaker religious
2269customs." She saw the Hispanic workers as shutting her out by
2280speaking Spanish.
2282Dismissal
22838. On August 10, 2005, Ms. Webster was issued a
2293Disciplinary Action Report (DAR) by her supervisor, Mr. James.
2302Mr. James was recommending her dismissal from employment with
2311the Clerk, as her performance was unacceptable and in direct
2321violation of personnel rule s. In the DAR, Ms. Webster was
2332charged with "violating the County's Personnel Rules, Chapter
2340VIII, Section 7: Paragraph: A, B, D and S," which were indicated
2352as follows:
2354(A) That the employee is incompetent or
2361inefficient in the performance of his [sic]
2368duty.
2369(B) That the employee has been offensive in
2377his [sic] conduct toward his [sic] fellow
2384employees, wards of the County or public.
2391(D) That the employee has violated any
2398lawful or official regulation or order, or
2405failed to obey any lawful and reason able
2413direction given him/her by a supervisor,
2419when such violation or failure to obey
2426amounts to insubordination or serious breach
2432of discipline which may reasonably be
2438expected to result in lower morale in the
2446organization or result in loss,
2451inconvenience or injury to the County
2457service or to the public.
2462(S) That the employee is antagonistic
2468towards superiors and fellow employees,
2473criticizing orders, rules and policies, and
2479whose conduct interferes with the proper
2485cooperation of employee and impairs the
2491e fficiency of the County service.
24979. Mr. James attached to the DAR specific facts and
2507instances. Some of the facts and instances included the
2516following:
2517(a) Non - Performance: Ms. Webster failed to complete
2526assigned reconciliations -- after she returned fr om a medical
2536leave of absence from February to mid - June, in a memo from
2549Mr. James, dated June 19, 1995, Ms. Webster was given until
2560July 14, 1995, to complete reconciliations of some general
2569ledger accounts for May 1995; the reconciliations for May 1995
2579we re not completed as directed; and two months of
2589reconciliations were not completed as requested and they had to
2599be assigned to other personnel.
2604(b) Insubordination -- Ms. Webster "exhibited" gross
2611insubordination toward Mr. James, on August 4, 1995, when sh e
2622failed to meet with him after he repeatedly directed her to meet
2634with him before she left for the day (the meeting was re -
2647scheduled). Further, this instance was not the only instance
2656where she failed to follow directives of Mr. James When he asks
2669you [ Ms. Webster] to refrain from certain behavior or when he
2681explains your duties, you frequently directly ignore what he
2690tells you and proceed to do only what you wish to do.
2702(c) Disruptive Behavior -- Ms. Webster exhibited disruptive
2710behavior constantly. In particular, on August 7, 1995, she
2719indicated to a co - worker, Julio Lucio - O'Farrill, who is
2731Hispanic, that his constant working on his computer was
2740disturbing her. Mr. Lucio - O'Farrill spoke with Mr. James who
2751instructed Ms. Webster not to interfere with t he co - worker doing
2764his work. Later, Ms. Webster asked another co - worker, Devon
2775Marrett, who is African - American, whether he knew anyone "like
2786him [Mr. Marrett]" who could "take care of" Mr. Lucio - O'Farrill.
2798Mr. Marrett inquired what Ms. Webster meant by her remarks, and
2809she responded, "a big, black and ferocious man from Liberty
2819City." On other occasions, Ms. Webster has requested
2827information, which has nothing to with her duties and
2836responsibilities, from workers outside her unit, and the workers
2845felt t hat she was being disruptive in preventing them from doing
2857what they were required to do. Further, on other occasions,
2867Ms. Webster has approached workers, who were engaged in a
2877conversation, and demanded to know what they were discussing and
2887demanded to j oin in the conversation.
289410. Mr. James also attached to the DAR, the Metro - Dade
2906Personnel Department Essential Job Functions Form; his
2913memorandum to Ms. Webster, dated June 19, 1995, regarding "Work
2923Assignments; the aforementioned reconciliations; and a
2929m emorandum from Mr. James to Ms. Webster, dated July 24, 1994,
2941regarding "Work assignments and Performance."
294611. At hearing, as to the reconciliations, the evidence
2955demonstrated that the expectation for Ms. Webster to complete
2964the reconciliations was appro priate and warranted and that she
2974failed to complete them.
297812. At hearing, as to insubordination, the evidence
2986demonstrated that Mr. James gave reasonable directives, that the
2995directives were lawful, and that Ms. Webster failed to comply
3005with the directiv es.
300913. Further, at hearing, as to Ms. Webster's disruptive
3018behavior, the evidence demonstrated that her attitude towards
3026Mr. Lucio - O'Farrill was that he was a Hispanic who believed that
3039women should be controlled by men but that she, being a "White
3051Anglo " woman was not going to allow him to control her; and that
3064he wanted her to be as a "wife" to him, but she was not going to
3080do that. The evidence further demonstrates that her attitude
3089towards him caused disruption in the workplace.
309614. As to Mr. Marret t, the evidence demonstrates that he
3107was offended by Ms. Webster's remark to him, and that he
3118believed that Ms. Webster was inquiring of him as to whether he
3130knew of an African - American who would harm Mr. Lucio - O'Farrill.
314315. Both Messrs. Lucio - O'Farrill and Marrett were
3152extremely concerned with Ms. Webster's behavior. Mr. Lucio -
3161O'Farrill was so concerned that he called the police, and a
3172police report was filed.
317616. At hearing, Mr. James testified that he was very
3186concerned with Ms. Webster's behavior, t hat he had done what he
3198could do for her, and that he had to consider the well - being of
3213his staff and the office, as well as her behavior. The
3224undersigned finds his testimony credible.
322917. On August 16, 1995, Ms. Schechtman met with
3238Ms. Webster to provid e Ms. Webster an opportunity to address the
3250allegations set forth in the DAR. Ms. Webster was unable to
3261verbally communicate her response and, therefore, Ms. Schechtman
3269permitted Ms. Webster to submit her response in writing; which
3279she did on or about Aug ust 18, 1995 and which consisted of
3292several pages. Having considered the DAR and Ms. Webster's
3301response, Ms. Schechtman decided to terminate Ms. Webster. By
3310letter dated August 22, 1995, Ms. Schechtman notified
3318Ms. Webster of her termination and, among o ther things, her
3329rights to appeal.
3332Suspension
333318. Prior to her termination, on February 13, 1995,
3342Ms. Webster was suspended for six days (February 13 through 20,
33531995) by the Clerk based upon a DAR dated February 3, 1995.
336519. On February 3, 1995, Mr. Jam es issued a DAR against
3377Ms. Webster. Mr. James was recommending her suspension from
3386employment with the Clerk. In the DAR, Ms. Webster was charged
3397with violating the "County's Personnel Rules, Chapter VIII,
3405Section 7: Paragraph D" as follows:
3411That the em ployee has violated any lawful or
3420official regulation or order, or failed to
3427obey any lawful and reasonable direction
3433given him/her by a supervisor, when such
3440violation or failure to obey amounts to
3447insubordination or serious breach of
3452discipline which may reasonably be expected
3458to result in lower morale in the
3465organization or result in loss,
3470inconvenience or injury to the County
3476service or to the public.
348120. Mr. James attached to the DAR specific facts and
3491instances. Some of the facts and instances incl uded the
3501following:
3502(a) Recent Absences -- Ms. Webster had unplanned absences
3511over the past two months which resulted in inconveniences to
3521management and co - workers in that they had to perform her work
3534requirements which were her responsibility; and indica tes with
3543specific instances of absences, beginning with December 8, 1994
3552through January 27, 1995, for which a leave of absence was
3563granted, with some of the leave being granted for her inability
3574to "focus" on her work, "accomplish work objectives," lack o f
3585job performance, "unusual and disruptive behavior" in the
3593office, and to prepare to attend the fitness for duty physical
3604examination (FFDPE).
3606(b) Unusual and Disruptive Behavior -- specific instances
3614and dates were indicated, beginning December 5, 1994 th rough
3624January 30, 1995, in which Ms. Webster, among other things, was
3635attempting to train an employee who was not under her
3645supervision and she (Ms. Webster) became upset when it was
3655brought to her (Ms. Webster's) attention; was going through the
3665office li stening to conversations, including management
3672conversations, and being uncooperative and critical of co -
3681workers; continued to complain about not having sufficient work
3690space and about the work environment even after she was advised
3701by her supervisor to co ncentrate on her work; repeatedly
3711mentioned that group problems existed at work, which were
3720related to ethnic backgrounds; refused to follow her
3728supervisor's directives and exhibited behavior which was
3735disruptive to the work environment; was continually co unseled to
3745work on past - due work but walked around the office, talking
3757about ham operators; caused an employee concern due to what he
3768described as a glazed look in her eyes; and was making strange
3780and nonsensical telephone calls to other employees.
3787(c) La ck of Job Performance and Inability to Met [sic]
3798Work Objectives -- failure to meet required job requirements and
3808related work objectives, with specificity; failure to be
3816responsive to counseling and to show improvement; and, on
3825occasion, been insubordinate when queried regarding status of
3833past due work.
383621. Mr. James also attached a "Facts" section in which he
3847indicated, among other things, the following: that a meeting was
3857held on January 17, 1995, with Martha Alcazar, Acting
3866Comptroller, Ms. Webster, and himself regarding a FFDPE
3874scheduled for January 19, 1995, as a result of Ms. Webster's
3885recent absences, disruptive behavior and lack of performance on
3894the job; that the FFDPE was re - scheduled at a later date,
3907January 26, 1995, at Ms. Webster's request; tha t Ms. Alcazar
3918requested Ms. Webster to come into her (Ms. Alcazar's) office on
3929January 20, 1995, to complete the paperwork for the FFDPE but
3940that Ms. Webster failed to do so; that Ms. Webster failed to
3952attend the FFDPE on January 26, 1995; and that she (Ms . Webster)
3965was previously informed that her failure to comply with the
3975directive may result in disciplinary action up to and including
3985dismissal.
398622. Furthermore, Mr. James recommended that Ms. Webster be
3995suspended without pay until she complied with all the
4004requirements of a FFDPE; that she be required to participate in
4015the Employee Assistance Program (EAP), which had been beneficial
4024to her in the past, before returning to and during work; that
4036management be provided monthly status reports from Ms. Webste r's
4046doctor and/or professional counselor; and that her failure to
4055comply with the recommendations result in disciplinary action up
4064to and including dismissal.
406823. At hearing, Mr. James testified that Ms. Webster's
4077behavior gave him more concern than anyth ing else in that it was
4090unusual for her and her work pattern and that he wanted to help
4103her, as much as he could, with her behavior and retain her
4115position. The undersigned finds his testimony credible.
412224. By letter dated February 13, 1995, the Clerk n otified
4133Ms. Webster that she was suspended without pay until she
4143submitted to a FFDPE and complied with the recommendations
4152associated therewith and that it was recommended that she
4161participate in the EAP, with monthly status reports provided to
4171management from her doctor or professional counselor. He
4179further advised her that she had two weeks to comply, and, if
4191she did not, disciplinary action would result up to and
4201including dismissal.
420325. A letter dated February 3, 1995, was also sent to
4214Ms. Webster by Martha Alcazar, the Acting Comptroller.
4222Ms. Alcazar indicated, among other things, that a meeting was
4232held on January 17, 1995, with Mr. James, Ms. Webster, and
4243herself regarding a FFDPE scheduled for January 19, 1995, as a
4254result of Ms. Webster's recent absences, disruptive behavior and
4263lack of performance on the job; that Ms. Webster was informed at
4275the meeting that failure to comply with the directive may result
4286in disciplinary action; that Ms. Webster requested a re -
4296scheduling of the FFDPE for January 26, 1995; that Ms. Webster
4307failed to appear for the FFDPE; that, as a result of
4318Ms. Webster's failure to appear, she failed to comply with a
4329direct order; and that her disciplinary action session was
4338scheduled for February 9, 1995, specifying the particul ar
4347violation.
434826. By letter dated February 14, 1995, Ms. Webster was
4358notified by the Clerk that, among other things, her examination
4368was scheduled for February 21, 1995. He further advised her
4378that her failure to comply would result in disciplinary act ion
4389up to and including dismissal.
439427. By letter dated February 22, 1995, the Clerk notified
4404Ms. Webster that, among other things, her psychological
4412evaluation was scheduled for February 28, 1995. Again, he
4421further advised her that her failure to comply would result in
4432disciplinary action up to and including dismissal.
443928. By letter dated March 10, 1995, the Clerk clarified
4449his letter dated February 13, 1995, regarding the results of her
4460disciplinary action hearing. He advised her, among other
4468things, t hat the dates of her suspension were February 13
4479through 20, 1995, a six - day suspension, and that beginning
4490February 21, 1995, she was placed on administrative leave,
4499pending the results of the physical and psychological
4507examinations.
450829. By letter dated March 23, 1995, Ms. Alcazar notified
4518Ms. Webster, among other things, that her (Ms. Webster's) doctor
4528indicated that she (Ms. Webster) should return to treatment with
4538her (Ms. Webster's) physicians who should provide the Clerk with
4548progress reports and her recommendations concerning ability to
4556return to work and that, based on the progress reports,
4566Ms. Webster would be contacted regarding the terms and
4575conditions of her returning to work.
458130. In letters from a psychologist and a psychiatrist,
4590dated April 1 2 and 19, 1995, respectively, both recommend that
4601Ms. Webster be permitted to return to work. Neither the
4611psychologist nor the psychiatrist was performing the FFDPE.
461931. By letter dated May 9, 1995, Mr. James notified
4629Ms. Webster, among other things, tha t her FFDPE was scheduled
4640for May 12, 1995.
464432. The physician who performed the FFDPE recommended on
4653May 12, 1995, that Ms. Webster be returned to her previous
4664duties.
4665Appeal of Suspension and Dismissal
467033. Ms. Webster appealed her six - day suspension and
4680dismissal. By agreement of the parties, the cases were heard by
4691a Hearing Examiner of the American Arbitration Association in a
4701two - day hearing. The Hearing Examiner rendered his decision on
4712March 1, 1996, with findings of fact and conclusions, and
4722reco mmended sustaining the six - day suspension and dismissal of
4733Ms. Webster.
473534. The Hearing Examiner's findings included a finding
4743that Ms. Webster's response to the six - day suspension and
4754dismissal did not refute the contentions of the Clerk and "to a
4766great degree" address issues that were either "not relevant to
4776the personnel actions" or "unrelated" to them. The undersigned
4785concurs in the Hearing Examiner's findings.
479135. The Hearing Examiner's further findings included a
4799finding that Ms. Webster's conduct constituted insubordination
4806and that the testimony supports the violations in the DAR
4816relating to the termination.
482036. The evidence in the instant matter also demonstrates
4829that Ms. Webster engaged in insubordination and committed the
4838violations indicated in the DAR regarding her termination.
484637. As conclusions, the Hearing Examiner included, among
4854other things, a conclusion that the Clerk, as Ms. Webster's
4864employer, had a responsibility to and did assist Ms. Webster in
4875resolving the behavior that she was exhibiting; that Ms. Webster
4885was clearly and repeatedly provided with warnings by her
4894supervisor as to the consequences of the failure of her non -
4906compliance with work standards and assigned work, but she still
4916failed to comply; that her failure to comply a dversely affected
4927the work of the other employees in her unit; that her conduct
4939and verbal statements towards her African American and Hispanic
4948co - workers conveyed an attitude of intolerance and prejudice;
4958and that she was provided ample opportunity to cha nge her
4969behavior but she failed to do so.
497638. The evidence presented in the instant matter
4984demonstrates and supports the conclusions expressed by the
4992Hearing Examiner.
499439. On March 20, 1996, the County Manager, Armando Vidal,
5004P.E., having reviewed the re cord of the Hearing Examiner, upheld
5015the six - day suspension and dismissal of Ms. Webster.
5025Retaliation
502640. Ms. Webster filed a discrimination complaint with the
5035Clerk's Affirmative Action Office (AAO) alleging that the DAR of
5045August 10, 1995, (the dismissa l) was in retaliation for her
5056having filed a formal discrimination complaint with the Clerk's
5065AAO on July 13, 1995. The complaint was against "management in
5076general for employment actions taken and not taken against her
5086and the manner in which her co - work ers interact with her." The
5100complaint related to behaviors of co - workers as perceived by
5111Ms. Webster and her reaction based on her perception; the
5121exhibited pattern of dominance by men over women; differential
5130treatment with her than men because upper man agement suggested
5140that she be placed on two medical leave of absences and a FFDPE
5153be performed; a violation of Title I of the ADA when a vacancy
5166occurred for the Deputy Controller position in that she was not
5177considered due to her not applying because she was on medical
5188leave; women in lower positions than men and performing equal
5198work but not receiving equal remuneration; and the DAR of
5208August 10, 1995.
521141. The complaint was investigated by AAO's Senior
5219Affirmative Action Specialist, Carmen Dieguez, for w hich a
5228report, dated August 21, 1995, of the investigation was
5237prepared. In the process of preparing the report, Ms. Dieguez
5247attended the hearing on the DAR of August 10, 1995, as an
5259observer. In essence, Ms. Dieguez found Ms. Webster's formal
5268discrimina tion complaint with the AAO to be meritless and
5278concluded, among other things, the following:
5284After having discussed the complainant's
5289actions with her and management which
5295precipitated the DAR and which are
5301specifically addressed in said document and
5307havi ng attended the DAR hearing on
5314August 16, 1995 as an observer, I conclude
5322that Webster's superiors have not retaliated
5328against her as, [sic] she alleges. The
5335incidents described in the DAR of non -
5343performance, insubordination and disruptive
5347behavior appear to have been of concern to
5355management even before Webster filed her
5361complaint of discrimination. And, it is
5367management's responsibility to discipline
5371employees for what appear to be job - related
5380reasons. . . . It is, therefore, concluded
5388that the DAR pres ented to Webster is not
5397intended to retaliate or otherwise
5402discriminate against her.
540542. On August 25, 1995, the Director of AAO, Marcia
5415Saunders, issued a report to the Clerk on Ms. Webster's formal
5426complaint of discrimination filed with the Clerk's AAO . The
5436report included Ms. Dieguez's report. Ms. Saunders concurred
5444with Ms. Dieguez that Ms. Webster's complaint was meritless.
5453Ms. Saunders stated, among other things, in her report the
5463following:
5464I have reviewed her [Ms. Dieguez's] report
5471and the conc lusions drawn therein of the
5479seven allegations which were made. You will
5486find that none have been found to be
5494substantiated. To the contrary, there has
5500been corroboration that she [Ms. Webster]
5506instead, whether consciously or
5510unconsciously, harassed her fellow - workers
5516about diversity issues i.e. their 'group
5522behavior patterns and communication styles'
5527to the point that some individuals found her
5535behavior to be offensive and intrusive.
5541Webster's preoccupation with making
5545assumptions about race/ethnic/cult ural and
5550her own religious differences may be
5556somewhat misguided. . . .
5561Webster also alleged that an August 10th
5568D.A.R. she received was in retaliation
5574because of filing this formal discrimination
5580complaint. Dieguez attended the D.A.R.
5585hearing as an obse rver to ensure the issues
5594presented were not in regard to, nor
5601appeared to be precipitated by this
5607complaint. She [Ms. Dieguez] affirms that
5613the issues addressed in the hearing were not
5621retaliatory but a progressive process
5626related to Webster's performanc e,
5631insubordination and disruptive behavior.
5635Discrimination statutes do not preclude an
5641employer from exercising its right and
5647responsibility to discipline an employee in
5653accordance with lawful personnel rules and
5659procedures.
566043. The evidence in the inst ant matter demonstrates that
5670the retaliation purported by Ms. Webster is meritless. The
5679undersigned concurs in the conclusion reached by the Clerk's
5688AAO.
568944. At the hearing in the instant matter, Ms. Webster
5699insisted, among other things, that her being a White Anglo
5709Quaker caused communication and attitude problems between her
5717and the Clerk's employees. She testified that the majority of
5727the Clerk's employees were Hispanic and wanted her to act as a
5739Hispanic woman as it concerned relations with Hispanic men,
5748i.e., to act as their "wife"; and that they failed to understand
5760her behavior, such as her shyness, low tone in talking, and the
5772lowering of her head when she spoke. But, the evidence
5782demonstrated that Ms. Webster, among other things, tried to
5791force her ways upon them and acted irrationally when the
5801employees would not conform to what she wanted. Further, the
5811evidence at the instant hearing demonstrates that Ms. Webster
5820stereotyped her fellow employees and made prejudiced remarks
5828about them. Ms. Web ster is correct that ethnic differences can
5839cause communication problems but one cannot force someone to
5848conform to one's way in order to communicate.
585645. At hearing, no evidence was presented demonstrating
5864that similarly situated employees were treated d ifferently.
587246. Ms. Webster presented evidence as to her financial
5881situation since her termination.
588547. Ms. Webster presented evidence as to costs that she
5895incurred associated with the hearing in the instant matter.
5904CONCLUSIONS OF LAW
590748. The Division o f Administrative Hearings has
5915jurisdiction over the subject matter of this proceeding and the
5925parties thereto, pursuant to Sections 760.11 and 120.569,
5933Florida Statutes (2006), and Subsection 120.57(1), Florida
5940Statutes (2006).
594249. Section 760.10, Florida Statutes (1995), provides in
5950pertinent part:
5952(1) It is an unlawful employment practice
5959for an employer:
5962(a) To discharge or to fail or refuse to
5971hire any individual, or otherwise to
5977discriminate against any individual with
5982respect to compensation, term s, conditions,
5988or privileges of employment, because of such
5995individual's race, color, religion, sex,
6000national origin, age, handicap, or marital
6006status.
6007(b) To limit, segregate, or classify
6013employees or applicants for employment in
6019any way which would dep rive or tend to
6028deprive any individual of employment
6033opportunities, or adversely affect any
6038individual's status as an employee, because
6044of such individual's race, color, religion,
6050sex, national origin, age, handicap, or
6056marital status.
6058* * *
6061(7) It is an unlawful employment practice
6068for an employer . . . to discriminate
6076against any person because that person has
6083opposed any practice which is an unlawful
6090employment practice under this section, or
6096because that person has made a charge,
6103testified, assis ted, or participated in any
6110manner in an investigation, proceeding, or
6116hearing under this section.
612050. A three - step burden and order of presentation of proof
6132have been established for unlawful employment practices.
6139McDonnell Douglas Corporation v. Green , 411 U.S. 792, 93 S. Ct.
61501817, 36 L. Ed. 2d 688 (1973); Aramburu v. The Boeing Company ,
6162112 F.3d 1398, 1403 (10th Cir. 1999). The initial burden is
6173upon Ms. Webster to establish a prima facie case of
6183discrimination. McDonnell Douglas , at 802; Aramburu , at 1403.
6191Ms. Webster establishes a prima facie case of discrimination by
6201showing: (1) that she belongs to a protected group; (2) that
6212she was subjected to an adverse employment action; and (3) that
6223her employer treated similarly situated employees outsid e the
6232protected group differently or more favorably. McDonnell
6239Douglas , supra ; Holifield v. Reno , 115 F.3d 1555 (11th Cir.
62491997); Aramburu , supra . See Kendrick v. Penske Transportation
6258Services , 220 F.3d 1220 (10th Cir. 2000) (similarly situated
6267employee s need not be outside the protected group).
627651. Once Ms. Webster establishes a prima facie case, a
6286presumption of unlawful discrimination is created. McDonnell
6293Douglas , at 802; Aramburu , at 1403. The burden shifts then to
6304the Clerk to show a legitimate, nondiscriminatory reason for its
6314action. McDonnell Douglas , at 802; Aramburu , at 1403. If the
6324Clerk carries this burden, Ms. Webster must then prove by a
6335preponderance of the evidence that the reason offered by the
6345Clerk is not its true reason, but only a pretext for
6356discrimination. McDonnell Douglas , at 804; Aramburu , at 1403.
636452. However, at all times, the ultimate burden of
6373persuasion that the Clerk intentionally discriminated against
6380her remains with Ms. Webster. Texas Department of
6388Community Af fairs v. Burdine , 450 U.S. 248, 101 S. Ct. 1089, 67
6401L. Ed. 2d 207 (1981).
640653. Applying the prima facie standards, the evidence
6414demonstrates that Ms. Webster has satisfied the first two prongs
6424but failed to satisfy the third prong of the test. She has
6436dem onstrated that she belongs to the protected class (race,
6446color, sex, religion, national origin, age, and marital status)
6455and that she was subjected to an adverse employment action
6465(dismissal). However, she failed to demonstrate that the Clerk
6474treated simi larly situated employees, whether inside or outside
6483the protected group, differently or more favorably. Holifield ,
6491supra at 1562; McGuinness v. Lincoln Hall , 263 F.3d 49, 53, 54
6503(2d Cir. 1997); Shuway v. United Parcel Service, Inc. , 118 F.3d
651460, 64 (2d Ci r. 1997); Anderson v. WBMG - 42 , 253 F.3d 561, 565
6529(11th Cir. 2001); Kendrick , supra .
653554. Assuming Ms. Webster had established a prima facie
6544case, the Clerk has demonstrated a legitimate, nondiscriminatory
6552reason for its employment action of terminating her . The Clerk
6563demonstrated that she failed to complete assigned and required
6572reconciliations, which were her responsibility, even after she
6580was directed to do so; that she committed gross insubordination;
6590and that she engaged in constant disruptive behavior at the
6600workplace. All valid reasons for termination according to the
6609County's Personnel Rules.
661255. Further, Ms. Webster failed to demonstrate that the
6621Clerk's reasons for terminating her were not the true reason,
6631but a pretext for discrimination.
6636Handic ap
663856. A prima facie case of discrimination under the
6647Americans with Disabilities Act (ADA) is established by showing
6656that Ms. Webster "(1) had, or was perceived to have, a
"6667disability"; (2) was a "qualified" individual; and (3) was
6676discriminated against because of her disability. (citation
6683omitted) The ADA defines "disability" as "(A) a physical or
6693mental impairment that substantially limits one or more of the
6703major life activities of such individual; (B) a record of such
6714impairment; or (C) being regard ed as having such an impairment."
6725[citation omitted] Curruthers v. BSA Advertising , 357 F.3d
67331213, 1215 (11th Cir. 2004) (citation omitted).
674057. Ms. Webster is "regarded" as disabled "if her employer
6750perceives her as having an ADA - qualifying disability, even if
6761there is no factual basis for that perception. [citation
6770omitted]. As with actual impairments, however, the perceived
6778impairment must be one that, if real, would limit substantially
6788a major life activity of the individual. [citations omitted]."
6797Id. at 1216. A person is also "regarded" as being disabled by
6809meeting one of three conditions: "(1) has a physical impairment
6819that does not substantially limit major life activities but is
6829treated by an employer as constituting such a limitation; (2)
6839ha s a physical or mental impairment that substantially limits
6849major life activities only as a result of the attitude of an
6861employer toward such impairment; or (3) has no physical or
6871mental impairment but is treated by an employer as having such
6882an impairment . [citation omitted] Rossbach v.City of Miami ,
6891371 F.3d 1354, 1359, 1360 (11th Cir. 2004). In order to prevail
6903under this theory, the person "must show two things: (1) that
6914the perceived disability involves a major life activity; and (2)
6924that the percei ved disability is substantially limiting and
6933significant. [citation omitted]. Id. at 1360.
693958. Ms. Webster failed to demonstrate a prima facie case
6949of discrimination under the ADA. The evidence was insufficient
6958to demonstrate that she suffered from an ADA disability.
6967Furthermore, she failed to demonstrate that the perceived
6975disability (mental impairment) involved a major life activity
6983and that the perceived disability was substantially limiting and
6992significant.
699359. Furthermore, as previously indica ted, Ms. Webster
7001failed to demonstrate that that the Clerk's reasons for
7010terminating her were not the true reason, but a pretext for
7021discrimination.
7022Retaliation
702360. Ms. Webster failed to demonstrate that she was
7032retaliated against through her dismissal fo r filing a
7041discrimination claim against the Clerk with the Clerk's AAO.
705061. The evidence demonstrates that Ms. Webster was
7058terminated for legitimate non - discriminatory reasons.
7065RECOMMENDATION
7066Based on the foregoing Findings of Fact and Conclusions of
7076Law, it is
7079RECOMMENDED that the Florida Commission on Human Relations
7087enter a final order dismissing the discrimination complaint of
7096Anne R. Webster against Metropolitan Dade County, Clerk of the
7106County Court.
