267STATEMENT OF THE ISSUE

271Whether the application of Respondent Lewis for an

279Environmental Resource Permit to construct a finger pier

287qualifies for an exemption from the need to obtain such a permit.

299PRELIMINARY STATEMENT

301In an application dated July 13, 1998, Larry Lewis applied

311to the Department of Environmental Protection ("Department") for

321a standard general permit to construct a three-foot-wide by

330thirty-six-foot-long finger pier on Cypress Creek in Palm Beach

339Gardens, Florida. In a letter dated August 21, 1998, the

349Department stated that it had reviewed the application with

358respect to regulatory authorization, proprietary authorization,

364and federal authorization. The Department of Environmental

371Protection notified Mr. Lewis in the letter that the Department

381had determined that his project was exempt from the requirement

391for an Environmental Resource Permit pursuant to Rule 40E-

4004.051(3)(b), Florida Administrative Code; that the project was to

409be built on sovereign submerged land and that the letter was

420authorization from the Board of Trustees of the Internal

429Improvement Trust Fund to construct the project; and that the

439permit application had been sent to the United States Army Corps

450of Engineers for a determination of whether the project required

460federal authorization.

462Petitioners Edward Scott, Scott and Vicky Porter, Nicholas

470DiBetta, Pamela and Tom Widerman, and Kathy Crawford and Douglas

480Dedo separately filed a petition for a formal hearing to contest

491the Department's decision, and the Department referred all five

500petitions to the Division of Administrative Hearings for

508assignment of an administrative law judge. The five petitions

517were consolidated by order entered February 9, 1999. Pursuant to

527notice, the final hearing was held on May 13 and 14, 1999.

539At the hearing, Petitioners Edward Scott, Douglas Dedo, and

548Scott Porter testified on behalf of all of the Petitioners; Dedo

559Exhibits 1, 2, and 3 and Porter Exhibit 1 were offered and

571received into evidence. Respondent Larry Lewis testified in his

580own behalf and offered the testimony of Francine Vogell; Lewis

590Exhibits 1 and 2 were offered and received into evidence. The

601Department presented the testimony of Jayne Bergstrom, an

609Environmental Specialist II who processes environmental resource

616permit applications for the Department, and Department Exhibits 1

625through 4 were offered and received into evidence. At the

635request of the Department, and without objection from

643Petitioners, official recognition was accorded Rules 40E-4.051,

650Florida Administrative Code, and Section 403.813, Florida

657Statutes. Finally, at the hearing, Mr. Lewis withdrew his

666pending Motion to Compel Discovery.

671A transcript of the proceedings was filed with the Division

681of Administrative Hearings, and the Petitioners, the Department,

689and Mr. Lewis timely filed proposed findings of fact and

699conclusions of law, which have been duly considered.

707FINDINGS OF FACT

710Based on the oral and documentary evidence presented at the

720final hearing and on the entire record of this proceeding, the

731following findings of fact are made:

7371. The Department of Environmental Protection is

744responsible for administering the provisions of Chapter 373, and

753it is specifically responsible for issuing permits for the

762construction of docks in and over surface waters of the State of

774Florida. Sections 373.019(2); 373.026; and 373.413, Florida

781Statutes.

7822. Mr. Lewis applied to the Department for an environmental

792resource permit to construct a finger pier extending into a

802waterway known as Cypress Creek, which is classified as Class III

813Waters and is located on the Intracoastal Waterway in Palm Beach

824Gardens, Florida. According to the plans submitted with the

833application, the finger pier will be three feet wide, will extend

844thirty-six feet from the bulkhead into Cypress Creek, and will

854extend approximately twelve feet past the mean low water line.

864The plans show that the pier will be built on pilings and will

877consist of 108 square feet of surface area. The finger pier will

889be used to dock one boat and will be used as a private dock.

9033. When Mr. Lewis's application was initially reviewed, the

912Department assumed that Cypress Creek flowed over state-owned

920submerged lands. This assumption was reflected in the August 21,

9301998, letter from the Department notifying Mr. Lewis that his

940proposed finger pier qualified for an exemption from the

949requirement for an environmental resource permit pursuant to Rule

95840E-4.051(3)(b), Florida Administrative Code. The Department

964subsequently learned that Cypress Creek is an artificially

972created waterway, and, therefore, the land beneath the creek is

982not state-owned submerged land.

9864. Mr. and Mrs. Lewis own fee simple title to Lot 16 in

999Paradise Point, in Palm Beach Gardens, Florida. Petitioners

1007Douglas Dedo and Kathy Crawford own Lot 17 in Paradise Point.

1018Lot 16 is adjacent to Lot 17 but has no access to Cypress Creek.

10325. Mr. Dedo's and Ms. Crawford's predecessor-in-interest in

1040Lot 17 conveyed to Mr. Lewis's predecessor-in-interest an

1048easement over the westernmost twelve feet of Lot 17, "for

1058purposes of ingress and egress to Cypress Creek and for docking

1069purposes." 1/

10716. The property owned by Petitioners Scott and Vicky Porter

1081is Lot 4 of Cypress Creek Point, which abuts the easement on the

1094west side.

10967. Mr. Dedo and Ms. Crawford have a marginal dock, that is,

1108a dock which is roughly parallel to the shoreline, extending into

1119Cypress Creek to the east of Mr. Lewis's easement. Mr. and

1130Mrs. Porter have what is known as a "T-dock," extending into

1141Cypress Creek to the west of Mr. Lewis's easement. The Porter's

1152T-dock extends from the retaining wall eighteen feet into Cypress

1162Creek.

1163Water Quality

11658. The proposed finger pier will be constructed of wood,

1175which will not adversely affect water quality. However, the

1184proposed finger pier will be built on pilings, and the primary

1195concern regarding the effect of this project on water quality is

1206that the process of driving the pilings for the finger pier

1217causes the sand to lift from the bottom of the waterway, causing

1229turbidity, or cloudiness, in the water. The turbidity will be

1239substantially mitigated for this project because the contractor

1247will use turbidity screens to trap any sediment in the area where

1259the pier is being constructed and around the pilings while they

1270are being driven into the bottom of the creek bed.

12809. In order to construct the finger pier, it will be

1291necessary to drastically trim, and probably destroy, two or three

1301young mangroves that are growing on the creek bottom in front of

1313the retaining wall on the western edge of the easement. In

1324addition, it will be necessary to lightly trim a few other young

1336mangroves adjacent to the proposed pier, but these mangroves

1345should not be destroyed. Although mangroves contribute to good

1354water quality, the effect of the destruction of two or three

1365young mangroves on water quality in Cypress Creek would be

1375negligible.

1376Navigation

137710. In the area in front of Lot 17, the lot owned by

1390Mr. Dedo and Ms. Crawford and on which Mr. Lewis's easement is

1402located, Cypress Creek flows roughly east-and-west, with the

1410entrance to the Intracoastal Waterway to the east of Lot 17.

1421Just to the west of the easement, in front of Mr. and

1433Mrs. Porter's property, the creek narrows and curves to the

1443south. As a result of the narrowing of Cypress Creek in front of

1456Mr. and Mrs. Porter's property, Mr. Lewis's proposed finger pier

1466will not extend as far into Cypress Creek as the existing T-dock

1478on the Porter's property. 2/

148311. Most of the boats that pass the area where Mr. Lewis

1495proposes to construct the finger pier are twenty-to-thirty feet

1504long and have drafts from one-to-two feet.

151112. At mid-tide on May 12, 1999, the water was four feet

1523deep in the center of the channel in Cypress Creek, directly in

1535front of Mr. Lewis's easement. The measurement from waterline-

1544to-waterline in front of the easement was ninety-three feet. The

1554measurement from waterline-to-waterline in front of Mr. and

1562Mrs. Porter's property at mid-tide on May 12, 1999, was sixty-

1573eight feet.

157513. In navigating Cypress Creek, boaters curve toward the

1584area where Mr. Lewis's pier will be located and, at low tide,

"1596hug" the Porter's dock because of a shallow area which extends

1607an undetermined distance into the creek from the north bank

1617opposite the Porter's property. The water thirty-six feet from

1626the bulkhead at the location of the proposed pier was four feet

1638deep at low tide, as measured by Petitioner Dedo. At low tide,

1650again as measured by Petitioner Dedo, approximately twenty-two

1658feet of Mr. Lewis's proposed pier would extend over dry land,

1669with approximately fourteen feet of the pier extending over the

1679water. At low tide on May 13, 1999, as measured by Petitioner

1691Scott, Cypress Creek was sixty-four feet wide from waterline-to-

1700waterline in front of the easement. Therefore, boaters would

1709have approximately fifty feet of water in which to navigate past

1720the proposed finger pier. 3/

1725Flood control

172714. The proposed finger pier will not impede water flow

1737through Cypress Creek and, therefore, will not adversely affect

1746flood control. The pilings will be spaced twelve feet apart, and

1757there will be no wave break or baffle or other impediment to

1769water flow attached to the pier.

1775Summary

177615. The evidence presented at hearing is sufficient to

1785establish with the requisite degree of certainty that the three-

1795foot by thirty-six-foot finger pier Mr. Lewis proposes to

1804construct on the easement at the western edge of Lot 17 of

1816Paradise Point will not violate water quality standards, impede

1825navigation, or adversely affect flood control.

1831CONCLUSIONS OF LAW

183416. The Division of Administrative Hearings has

1841jurisdiction over the subject matter of this proceeding and of

1851the parties thereto pursuant to Sections 120.569 and 120.57(1),

1860Florida Statutes (1997).

186317. As the applicant for a permit to construct a structure

1874extending over waters of the State of Florida, Mr. Lewis has the

1886burden of proving by a preponderance of the evidence that he has

1898met the criteria for issuance of the permit or has met the

1910criteria for exemption from the requirement of obtaining a

1919permit. See Department of Banking and Finance, Division of

1928Securities and Investor Protection v. Osborne Stern and Co. , 670

1938So. 2d 932, 933-34 (Fla. 1996); see also Department of

1948Transportation v. J.W.C. Company, Inc. , 396 So. 2d 778 (Fla.

19581st DCA 1981).

196118. Section 373.413(1), Florida Statutes, provides as

1968follows:

1969Except for the exemptions set forth herein,

1976the governing board or the department may

1983require such permits and impose such

1989reasonable conditions as are necessary to

1995assure that the construction or alteration of

2002any stormwater management system, dam,

2007impoundment, reservoir, appurtenant work, or

2012works will comply with the provisions of this

2020part and applicable rules promulgated thereto

2026and will not be harmful to the water

2034resources of the district. The department or

2041the governing board may delineate areas

2047within the district wherein permits may be

2054required.

"2055Works" are defined in Section 373.403(5), Florida Statutes, as

"2064all artificial structures, including, but not limited to,

2072ditches, canals, conduits, channels, culverts, pipes, and other

2080construction that connects to, draws water from, drains water

2089into, or is placed in or across waters in the state."

210019. The criteria which must be met in order for Mr. Lewis's

2112proposed finger pier to be exempt from the requirement that he

2123obtain an environmental resource permit are found in Section

2132403.813(2)( i), Florida Statutes, and Rule 40E-4.051(3)((c),

2139Florida Administrative Code.

214220. Section 403.813, Florida Statutes (1997), is concerned

2150with projects in and over waters of the State of Florida that are

2163limited in scope. The section sets forth exceptions to the

2173requirement that permits be obtained and provides in pertinent

2182part:

2183(2) No permit under this chapter, chapter

2190373, chapter 61-691, Laws of Florida, or

2197chapter 25214 or chapter 25270, 1949, Laws of

2205Florida, shall be required for activities

2211associated with the following types of

2217projects; however, nothing in this subsection

2223relieves an applicant from any requirement to

2230obtain permission to use or occupy lands

2237owned by the Board of Trustees of the

2245Internal Improvement Trust Fund or any water

2252management district in its governmental or

2258proprietary capacity or from complying with

2264applicable local pollution control programs

2269authorized under this chapter or other

2275requirements of county and municipal

2280governments:

2281* * *

2284( i) The construction of private docks and

2292seawalls in artificially created waterways

2297where such construction will not violate

2303existing water quality standards, impede

2308navigation, or affect flood control.

231321. In Rule 62-330.200(4)(b), Florida Administrative Code,

2320the Department has adopted the provisions of Chapter 40E-4,

2329Florida Administrative Code, including Rule 40E-4.051, Florida

2336Administrative Code, which provides in pertinent part:

2343Exemptions from permitting under Chapters

234840E-4, 40E-40 and 40E-400, F.A.C., are set

2355forth below. The performance of activities

2361pursuant to the provisions of the exemptions

2368set forth in this section does not relieve

2376the person or persons who are using the

2384exemption or who are constructing or

2390otherwise implementing the activity from

2395meeting the permitting or performance

2400requirements of other District rules.

2405Nothing in this section shall prohibit the

2412Department from taking appropriate

2416enforcement action pursuant to Chapter 403,

2422F.S., to abate or prohibit any activity

2429otherwise exempt from permitting pursuant to

2435this section if the Department can

2441demonstrate that the exempted activity has

2447caused water pollution in violation of

2453Chapter 403, F.S.

2456* * *

2459(3) Docking Facilities and Boat Ramps.

2465* * *

2468(c) Construction of private docks in

2474artificially created waterways where

2478construction will not violate water quality

2484standards, impede navigation, or adversely

2489affect flood control.

249222. Based on the findings of fact herein, Mr. Lewis has

2503satisfied his burden of proving by a preponderance of the

2513evidence that the finger pier that is the subject of his

2524application for an environmental resource permit qualifies for an

2533exemption from the permit requirements pursuant to Section

2541403.813(2)( i), Florida Statutes, and Rule 40E4.051(3)(c), Florida

2549Administrative Code. Mr. Lewis and the Department presented a

2558prima facie case establishing that the proposed finger pier met

2568the statutory and rule criteria for an exemption from the permit

2579requirement, and the Petitioners failed to present persuasive

2587evidence to rebut this prima facie case. 4/

2595RECOMMENDATION

2596Based on the foregoing Findings of Fact and Conclusions of

2606Law, it is RECOMMENDED that the Department of Environmental

2615Protection enter a final order finding that the finger pier Larry

2626Lewis proposes to construct on Cypress Creek in Palm Beach

2636Gardens, Florida, is exempt from the requirement that an

2645environmental resource permit be obtained in order to construct

2654such a structure in and over the waters of the State of Florida.

28414/ There was a great deal of speculation by the Petitioners who

2853testified at the hearing regarding the length of the boat

2863Mr. Lewis would dock at the proposed finger pier, the extent to

2875which boats of various sizes would extend into Cypress Creek if

2886they were to be docked at Mr. Lewis's proposed pier, and the

2898extent to which a boat docked at Mr. Lewis's proposed pier would

2910impede navigation of the creek. Although the permit application

2919submitted by Mr. Lewis requested the "Proposed Size (length and

2929draft), Type, and Number of Boats Expected to Use or Proposed to

2941be Mooring [sic] at the facility," the length of the boat

2952proposed or expected to be docked at the pier is not a factor to

2966be considered in determining whether the proposed pier qualifies

2975for an exemption from the requirement of an environmental

2984resource permit.
