15B-15.0012. Assessment of Penalties for Violations Found During Compliance Reviews

  • 1(1) The following penalties shall apply to violations found during compliance reviews of motor carriers and shippers of hazardous materials. The aggregate of penalties assessed during a compliance review shall not exceed the amounts prescribed in Section 38316.3025 39or 40316.70, F.S.

    223(2) Except for violations specified below, the penalties prescribed above will be waived if, as a result of the first compliance review conducted on a motor carrier or shipper of hazardous materials, the described violations are corrected within 20 days after the receipt of a citation:

    269(a) Violations of 27249 C.F.R. Part 382.

    276(b) Violations of 27949 C.F.R. Part 395 283or Section 285316.302(2)(b), 286(c) or (d), F.S.

    290(c) Violations of hazardous materials requirements.

    296(d) Utilizing any driver without a valid driver’s license, such as having a revoked, suspended, canceled, or expired license, or a license with improper classification, not properly endorsed, or in violation of restrictions.
