20-106.001. General Procurement Practices

  • 1Department of Citrus procedures for purchasing commodities and services other than for advertising and promotional purposes shall be in accord with the procedures set forth in Chapter 287, Florida Statutes and Chapter 60A, Florida Administrative Code.

    37(1) Mandatory Written Agreements: All purchases of commodities and services shall be made by a written contract or purchase order. Invoices received pursuant to a verbal agreement or telephone purchase shall not be honored by the Department of Citrus.

    76(2) Execution Prior to Performance: All purchase agreements, whether by contract or purchase order, shall be properly executed prior to commencement of any service or receipt of goods.

    104(3) Requirements for Competitive Bidding:

    109(a) All purchases in excess of CATEGORY 2 as defined in Section 121287.017, 122Florida Statutes, shall be based upon competitive written quotations or informal bids.

    134(b) Exception: Where there is an immediate danger to public health, safety, welfare or an emergency such that formal bidding shall result in a substantial loss to the state, upon written certification of danger or emergency by the agency head, bidding procedures may be waived. Such competition as is practical under the circumstances shall be made.
