40A-1.510. District Investigations and Probable Cause Determination
Effective on Thursday, March 2, 2000
1(1) Upon receipt of a complaint filed pursuant to Rule 1140A-1.207, 12F.A.C., the District shall conduct an investigation and make a determination of probable cause. The District may conduct other investigations and make other probable cause determinations as are authorized or required by law.
45(2) An investigation or determination of probable cause is a nonadversary executive function to discover or procure evidence as part of the fact-finding function of the District. The District need not have an Order or Notice of Violation pending to conduct an investigation or make such a determination.
