40E-10. Water Reservations |
1(1) Applicants for consumptive use permits shall meet the requirements of this rule by providing reasonable assurances that Rule 2040E-2.301, 21F.A.C., and Section 3.11 of the “Applicant’s Handbook for Water Use Permit Applications within the South Florida Water Management District,” incorporated by reference in Rules 4740E-2.091, 48F.A.C., are met.
51(2) Water reserved for the protection of fish and wildlife contained within the Picayune Strand and Fakahatchee Estuary is defined in subsections 7340E-10.041(1)-74(2), F.A.C.
76(3) Water reserved for the protection of fish and wildlife contained within the North Fork of the St. Lucie River is defined in subsection 10040E-10.051(1), 101F.A.C.
102(4) Water reserved for the protection of fish and wildlife contained within Nearshore Central Biscayne Bay is defined in subsections 12240E-10.061(1)-123(2), F.A.C.
125(5) Water reserved for the protection of fish and wildlife contained within and released, via operation, from the Caloosahatchee River (C-43) west Basin Storage Reservoir is defined in subsection 15440E-10.041(3), 155F.A.C.
156(6) Water reserved for the protection of fish and wildlife released via operation from the EAA Reservoir is defined in paragraph 17740E-10.061(3)(a), 178F.A.C.
179(7) Water reserved for the protection of fish and wildlife contained within the Upper Chain of Lakes, Headwaters Revitalization Lakes, Kissimmee River, and Contributing Waterbodies is defined in Subsections 20840E-10.071(1)-209(3), F.A.C. These water reservation rules do not adjudicate property rights or dictate the operation of the Central & Southern Florida Flood Control Project (C&SF Project).
