49A-1. Organization |
1(1) General. Meetings and Public Workshops held by the Authority Board of the Authority shall be conducted according to the provisions of this rule section, in lieu of the provisions of Chapter 28-2, F.A.C.
35(2) Notice of Meeting or Workshop.
41(a) Except in the case of emergency meetings, the Authority shall give at least seven days public notice of any meeting or workshop by publication in the Florida Administrative Register.
71(b) Such notice of meeting or workshop shall contain:
801. The date, time and place of the event.
892. A brief description of the purpose of the event.
993. The address where interested persons can write to obtain a copy of the agenda.
114(c) A meeting, for the purpose of notice herein, is limited to a gathering for the purpose of conducting public business by the Authority Board.
139(d) A quorum at any meeting shall be declared when at least six members of the Authority Board are present representing four member local governments.
164(e) A workshop, for the purpose of notice herein, is a gathering where the members of the Authority Board are meeting, for the purpose of rule drafting or obtaining information; provided, at which time no official votes may be taken or policy adopted.
207(3) Agenda of Meetings or Workshops.
213(a) The agenda shall be prepared by the Authority Board in time so that a copy may be received seven days prior to the event by any person who has requested a copy.
246(b) The agenda shall list the items in the order they are to be considered. For good cause, items on the agenda may be considered out of their stated order with the approval of the Chairman of the Authority Board.
286(c) The agenda shall be specific as to items to be considered. All matters involving the exercise of agency discretion and policymaking shall be listed and summarized on the agenda.
316(d) The Chairman of the Authority Board may make specific changes in the agenda after it has been made available for distribution, for good cause shown.
342(e) All meetings and workshops shall be open to the public.
353(4) Emergency Meeting.
356(a) The Authority Board may hold an emergency meeting for the purpose of acting upon emergency matters affecting the public health, safety or welfare. This rule shall not apply to emergency rulemaking.
388(b) Whenever an emergency meeting is scheduled to be held, the Authority shall notify one major newspaper of general circulation within its boundaries of the time, date, place and purpose of the meeting.
421(c) The Authority shall publish in the first available issue of the Florida Administrative Register following an emergency meeting notice of the time, date and place of the meeting, a statement setting forth the reasons why an emergency meeting was necessary and a statement setting forth the action taken at the meeting.
