53ER08-86. Retailer POWERBALL® and POWERBALL® with Power Play® Bonus Commission Program (Replaced by 53ER12-8)
1(1) 2The Florida Lottery will conduct, as a retailer sales incentive, a Retailer 14POWERBALL 15jackpot 16and 17POWERBALL with 19Power Play 21Bonus Commission Program (“Program”)25. 26Florida Lottery retailers who sell a winning POWERBALL ticket for a $20 million jackpot will receive 42a bonus commission of $20,000. 48An additional $20,000 bonus commission will be paid to the retailer if the winning jackpot ticket was a 67Powerball 68with Power Play ticket72.
73(2) 74In the event that no jackpot winning ticket is sold 84for a POWERBALL drawing, 88the bonus commission 91amount 92will increase 94by 95$5,000 97per draw until a winning jackpot ticket is sold 106or 107to a maximum bonus comm112ission of $100,000.
116(3) The bonus commission 120for the POWERBALL drawing on January 7, 2009, which will be the first drawing in which the Florida Lottery will participate, will be calculated as if the Florida Lottery had been a 152POWERBALL 153participant since the last drawing in which there was a jackpot winner.
165(1664167) 168The bonus commissions will be shared equally in the event that multiple Florida Lottery retailers sell jackpot winning POWERBALL or POWERBALL with Power Play tickets.
193(1945195) Florida retailers who sell a 201Powerball 202with Power Play 205ticket 206that wins $1 million 210for matching 5-of-5 numbers will receive a $1,000 bonus commission. If a special promotion is conducted that includes a multiplier number of 10, Florida retailers who sell a 239Powerball 240with Power Play 243ticket 244that wins $2 million 248for matching 5-of-5 numbers will receive a $2,000 bonus commission.
259(2606261) 262Bonus commissions are in addition to the regular five percent sales commission set forth in Emergency Rule 53ER05-14, 280F.A.281C. 282Award 283of a 285bonus commission is not dependent upon the 292Powerball 293jackpot 294winning 295ticket 296or the 298Powerball 299with Power Play 5-of-5 winning ticket 305being claimed by the winner.
310(3117312) Retailers whose Florida Lottery contracts are terminated or inactivated prior to the bonus commission award shall be paid the bonus commission earned provided said termination or inactivation was not due to noncompliance with Chapter 24, F349.350S351., 352Chapter 53, F355.356A357.358C359., or contract terms.
363(3648365) A bonus commission will be considered compensation to the retailer for Int378ernal Revenue Service purposes. 382The Florida Lottery reserves the right to apply a bonus commission earned against a retailer’s outstanding debt to the Florida Lottery, and to award the remaining balance of 410the bonus commission, if any.
415(4169417) 418POWERBALL or POWERBALL with Power Play 424bonus commissions are subject to availability of funds appropr433iated for retailer incentives. 437This Program is subject to cancellation by future emergency rule if retailer incentive funding is not appropriated or if the Florida Lottery determines that it is no longer in the state’s best interest to use such funds for this purpose.
