53ER14. Emergency Rule For Year 2014 |
1(1) Beginning Monday, 4March 24, 620174, 8through 9Sunday, 10May 18, 12201134, 14the Florida Lottery will conduct 19the Miami 21Heat Playoff Experien24ce Promotion (or “Promotion”). 28Retailers in the 31Florida 32Lottery’s West Palm Beach and Miami Sales Districts will be included in the Promotion. During the promotion period, players who purchase a $55556.00 57Big 3 Power Pack 61at a Florida Lottery (or “Lottery”) retailer location in the 71two 72districts specified above will receive a voucher with a unique number that can be entered into one of two drawings on the Florida Lottery’s website for a chance to win 102Miami Heat team prizes. 157(2) 158How to Enter. 161To enter a voucher number into the Miami Heat Playoff Experience Promotion, players must enter on the Lottery’s website at 181www.flalottery.com182. 183On the home page of the Lottery’s website, players can click on the 196Miami Heat Playoff 199Experience Promotion 201banner and follow the directions. Players can also access the Lottery’s website to enter a voucher number via 219a link 221on 222the Miami Heat’s website at 227www.heat.com228. 229The entry voucher will be attached to the bottom of the 240FLORIDA LOTTO 242ticket. The voucher entry number is located at the bottom on the front of the voucher. Players are to enter the first 13-digits of the 19-digit voucher entry number. 271Qualifying Big 3 Power Pack ticket 277purchases will produce entry vouchers from the beginning of the promotion period until 10:29100 292p.m. 293(294ET295) 296on 297May 18, 2014300. 929(a) Grand Prize Winner 933– If 935the Florida Lottery is unable to have 942personal 943contact with the grand prize winner within three business days of the date of the drawing, the winner will forfeit his or her right to claim the prize, and the Florida Lottery will award the prize to the first alternate winner as described in subsection (5). If the Florida Lottery is unable to contact the first alternate winner within two business days, the alternate winner will forfeit his or her right to claim the prize and the Florida Lottery will award the prize to a second alternate winner. This notification process will continue until an alternate is contacted or the Florida Lottery has exhausted the list of available alternates. If the Florida Lottery is unable to contact an alternate winner, the prize will not be awarded.
1069(b) 1070Second, Third, Fourth, Fifth and Sixth Prize Winners. 1078If the Lottery is unable to have 1085personal 1086contact 1087with a 1089second, third, fourth, 1092fifth 1093or 1094sixth 1095prize winner 1097within 1098two 1099weeks of the date of the drawing, the winner will forfeit his or her right to claim the prize and the Florida Lottery will award the prize to the first available alternate winner as described in subsection (5) above. 1138If the Florida Lottery is unable to 1145have personal 1147contact the first available alternate winner within 1154two 1155week1156s, 1157the alternate winner will forfeit his or her right to claim the prize and the Florida Lottery will award the prize to the second available alternate winner. 1222(c) 1223Seventh Prize Winners. 1226If 1227the Florida Lottery is unable to have personal contact with a seventh prize winner within three business days of the date of the drawing, the winner will forfeit his or her right to claim the prize, and the Florida Lottery will award the prize to the first alternate winner as described in subsection (5). If the Florida Lottery is unable to contact the first alternate winner within two business days, the alternate winner will forfeit his or her right to claim the prize and the Florida Lottery will award the prize to a second alternate winner. This notification process will continue until an alternate is contacted or the Florida Lottery has exhausted the list of available alternates. If the Florida Lottery is unable to contact an alternate winner, the prize will not be awarded.
1361(1362d1363) 1364Eighth and Ninth Prize Winners. 1369If the Florida Lottery is unable to 1376have personal 1378contact 1379with 1380a1381n 1382eighth 1383or 1384nin1385th prize winner within 1389two weeks 1391of the date of the drawing 1397in order to confirm the winner’s mailing address, 1405the winner will forfeit his or her right to claim the prize and the prize will not be awarded.
1424(1425e1426) All entries are subject to validation by the Florida Lottery and may be disqualified if eligibility requirements are not met.
1447(7) How to claim a prize.
1453(a) To claim the grand prize in a drawing, a 1463winner must submit to the Florida Lottery the original valid voucher bearing the unique number selected in the drawing, a completed Winner Claim Form DOL-173-2, revised 0149091491/114923, 1493or 1494Spanish Winner Claim Form 1498DOL-173-2S, revised 0150191502/115033, 1504a copy of acceptable identification as listed on 1512www.flalottery.com, 1513and 1514any and all required releases. 1519Forms DOL-173-2 1521and 1522DOL-173-2S 1523are hereby incorporated by reference and can be obtained from any Lottery office, from the Lottery’s website, 1540www.flalottery.com, 1541or by writing to: Florida Lottery, Customer Service Division, 250 Marriott Drive, Tallahassee, Florida 32399-4016. 1556The required forms must be received by the Florida Lottery no later than three business days after the winner is notified by the Lottery that he or she is a winner. 1587If the Florida Lottery has not received the required forms by the third 1600business 1601day after notification, 1604the winner will forfeit his or her right to claim the prize and the Florida Lottery will award the prize to an alternate winner in accordance with subsection (5) and paragraph (6)(a) above1637.
1638(b) To claim 1641a 1642second, third, fourth, 1645fifth, 1646or 1647sixth prize 1649in a drawing, a 1653winner must submit to the Florida Lottery the original valid voucher bearing the unique number selected in the drawing along with a Winner Claim Form, 1678required releases 1680and identification referenced in 1684paragraph 1685(7)(a) above. The required documentation must be received by the Florida Lottery no later than 1700two weeks 1702after the winner is notified by the Lottery that he or she is a winner. 1717If the Florida Lottery has not received the required forms by the 1729fourteen1730th day after notification, 1734the winner will forfeit his or her right to claim the prize and the Florida Lottery will award the prize to an alternate winner in accordance with subsection (5) and paragraph (6)(b)1766.
1767(c) 1768To claim a seventh prize in a drawing, a 1777winner must submit to the Florida Lottery the original valid voucher bearing the unique number selected in the drawing along with a Winner Claim Form, required releases and identification referenced in 1808paragraph 1809(7)(a) above. The required documentation must be received by the Florida Lottery no later than three business days after the winner is notified by the Lottery that he or she is a winner. 1842If the Florida Lottery has not received the required forms by the third business day after notification, 1859the winner will forfeit his or her right to claim the prize and the Florida Lottery will award the prize to an alternate winner in accordance with subsec1887tion (5) and paragraph (6)(c).
1892(1893d1894) 1895Eighth 1896and 1897ninth 1898prize winners are not required to submit the original valid voucher bearing the entry number selected in the drawing or the documentation listed in paragraph (7)(a) in order to claim the merchandise prize.
1931(8) 1932Award of Prizes.
1935(a) Grand Prize.
19381. Grand Prize 1941‒ 1942(Miami Heat Playoff Fly Away Trip Package). Upon 1950the Florida Lottery’s receipt of a grand prize winner’s required documentation, the Florida Lottery will award a prize of 1969a 1970Miami Heat Playoff 1973Fly Away Trip Package (“Trip Package”). The Lot1981tery will mail the grand prize winner a check for the cash portion of the prize along with a certificate describing the Trip Package and information necessary for the prizewinner to make reservations to fulfill the trip. The Trip Package includes the following: 2024two tickets to one 20120294 2030Miami Heat Playoff away game, round-trip airfare for two persons from 2041any U.S. regional or international airport to the city in which the game is played, 2056two nights’ hotel stay (room and room tax only), and $1,000 cash. The game shall be the first practicable Miami Heat playoff away game of the 20120844 2085Miami Heat season after the prize is claimed by the winner. However, the winner will have the option to attend a 21062014 playoff 2108game in Miami and forfeit the airfare and/or hotel portion of the prize package. If the playoff results prohibit the fulfillment of a trip to a 20121354 2136playoff game in which Miami Heat plays, or if attendance by the winner at a 20121524 2153playoff game in which Miami Heat plays is not practicable, the trip shall be to an away game (determined by Miami Heat) in the first round of playoffs in 20121835 2184in which Miami Heat plays. The estimated retail value of the prize, including the cash portion, is $6,000. The actual retail value of the prize 2210depends on 2212the cost of airfare from the airport used by the winner to the airport in which the game is played. The Florida Lottery will pay applicable Federal income tax withholding on the actual retail value of the grand prize. The reportable taxable value of the grand prize is the actual retail value of the prize plus the value of the federal income tax withholding paid by the Lottery. The reportable taxable value of a gran2287d prize is estimated at $8,000.
22942. A grand prize is not transferable 2301or assignable without the express written consent of the Lottery. If the prizewinner advises the Lottery at the time the grand prize is claimed that he or she is unable to attend the 20123354 2336Miami Heat playoff game, the grand prize winner may 2345transfer 2346the airline ticket/hotel/game ticket portions of the grand prize 2355to another person; 2358however, t2360he cash portion of the prize will be paid to the grand prize winner and the entire value of the grand prize shall remain 2384taxable to the grand prize winner. An alternate winner of a grand prize may 2398transfer 2399the airline ticket/hotel/game ticket portions of the grand prize 2408to another person 2411provided he or she advises the Lottery of such 2420transfer 2421at the time of notification of his or her selection as an alternate.
24343. 2435A grand prize does not include travel (except as specified above), gratuities, parking fees, baggage fees, 2451any items not expressly specified, meals or per diem for meals, incidentals, tips, and personal expenses such as telephone calls, valet service or laundry, etc., or revision, rebooking, transfer or cancellation fees that may be charged by the airline, hotel or other suppliers.
24944. 2495The Florida Lottery reserves the right, in its sole discretion, to substitute a different prize of comparable value should a grand prize become unavailable.

3149(9) 3150Taxes. 3151Except as specifically mentioned herein, all federal, state and/or local taxes or other fees on the prizes will be the responsibility of the winner. 3175Federal income taxes are required to be withheld from a prize awarded to a nonresident alien claimant at the rate of thirty percent (30%) pursuant to applicable provisions of the Internal Revenue Code. A nonresident alien claimant who is selected as a winner of a prize for which tax withholding is not paid by the Florida Lottery will be required to pay the withholding tax or forfeit the prize. The reporting and subsequent payment of any additional federal, state and/or local taxes shall be the responsibility o3262f the nonresident alien winner.
3267(10) 3268State-Owed Debt. 3270If the winner of a grand prize in a drawing is identified as owing an outstanding debt to a state agency or child support collected through a court, the debt will be collected in accordance with 3306S3307ection 330824.115, 3309F.S3310. If the debt is an amount less than the cash portion of the prize, the non-cash portion of the prize and the cash portion of the prize less the amount owed shall be awarded. If the winner is identified as owing such a debt in an amount greater than the cash portion of the prize, the winner’s entire cash portion of the prize will be applied toward the outstanding debt as provided in 3384S3385ection 338624.115, 3387F.S., 3388and the winner will receive the remaining non-cash portion of the prize, if any.
3402(11) No cash option is available in lieu of the non-cash prizes.
3414(12) The right to claim a prize cannot be assign3424ed to another person or entity.
3430(13) All prizes are subject to the provisions of Chapter 24, 3441F.S., 3442and rules promulgated thereunder. Prizes will be paid in accordance with the rule of the Florida Lottery governing payment of prizes. Copies of the current prize payment rule can be obtained from the Florida Lottery, Office of the General Counsel, 250 Marriott Drive, T3486allahassee, Florida 32399-4011.
3489(14) Players must be at least 18 years of age. Persons prohibited by Section 350324.116, 3504F.S., 3505from purchasing a Florida Lottery ticket are not eligible to play.
3516(15) 3517By entering the Miami Heat Playoff Experience Promotion, 3525a player gives his or her permission for the Florida Lottery to provide the player’s address and telephone number to the fulfillment entity for prize fulfillment purposes.
3552(16) A player entering the 3557Miami Heat Playoff Experience 3561Promotion is deemed to have granted permission for the Florida Lottery to photograph and/or videotape and record the prizewinner with or without prior notification and to use the name, photograph, videotape, and/or recording of the prizewinner for advertising or publicity purposes without additional compensation.
3605(17) Entry into the 3609Miami Heat Playoff Experience 3613Promotion 3614and/or acceptance of a prize constitutes permission to use the prizewinner’s name, biographical information and/or likeness for purposes of advertising and promotion without further compensation as permitted by law by the Florida Lottery, Miami Heat Limited Partnership, the American 3653Airlines Arena, the National Basketball Association and its Member Teams, NBA Properties, Inc., NBA Media Ventures, LLC and/or each of their respective parent companies, subsidiaries, affiliates and advertising/promotion agencies.
