53ER16-16. GROUPER® Retailer Sales and Double Sales Commission  


Effective on Wednesday, March 23, 2016
  • 1(1) Beginning March 28, 2016, and continuing through May 22, 2016, (“Promotional Period”) the Florida Lottery will conduct as a retailer sales incentive, the GROUPER26® 27Retailer Sales and Double Sales Commission program. During the Promotional Period, the Florida Lottery will pay Florida Lottery retailers a $.30 sales commission for each GROUPER53® 54play sold, except as provided in subsection (3) below. The $.30 sales commission includes the five percent sales commission set forth in Rule 53ER13-46, F.A.C., 79Retailer Compensation, 81on the purchase price of the $1.00 FLORIDA LOTTO90® 91ticket, the $2.00 FANTASY 596® 97with EZmatch99 100ticket, the $1.00 CASH104105Straight/Box ticket, the $1.00 PLAY 4111 112Straight/Box ticket, and a five percent sales commission on the promotional FREE $1.00 LUCKY MONEY127128ticket included in the GROUPER play.

    134(2) As a bonus, during the first thirty (30) days of the Promotional Period (March 28, 2016 – April 26, 2016 “Double Sales Commission Period”), the Florida Lottery will pay Florida Lottery retailers an additional $.30 sales commission (or double sales commission) for each GROUPER179® 180play sold, except as provided in subsection (3) below, for a $.60 total sales commission.

    195(3) If the Quick Pick numbers selected for either the CASH 3207208or PLAY 4211 212game have been cut off for the day due to the game’s liability limit being reached so that the ticket or tickets for the affected game or games do not print, the purchase price of the transaction will be automatically adjusted, and the retailer will receive the otherwise applicable sales commission (depending on the transaction date) on only the remaining GROUPER tickets, including the promotional FREE $1 LUCKY MONEY281 282ticket.

    283(4) GROUPER sales commissions will be reflected on the retailer’s weekly Settlement Report.

    296(5) GROUPER double sales commissions will be reflected on the retailer’s weekly Settlement Report at the conclusion of the Double Sales Commission Period.

    319(6) Retailers whose Florida Lottery contracts are terminated or inactivated prior to payment of the double sales commissions shall be paid the commissions earned provided said termination or inactivation was not due to noncompliance with Chapter 24, F.S., Chapter 53, F.A.C., or terms of the retailer contract.

    366(7) Double sales commissions will be considered compensation to the retailer for Internal Revenue Service purposes. The Florida Lottery reserves the right to apply a double commission earned against a retailer’s outstanding debt to the Florida Lottery.
