53ER18. Emergency Rule For Year 2018 |
1(1) Beginning June 11, 2018, and continuing through August 6, 2018, (Promotional Period) the Florida Lottery will conduct the GROUPER21® 22Retailer Bonus Sales Commission Promotion. The Florida Lottery will pay Florida Lottery retailers a five percent bonus sales commission in addition to the standard five percent sales commission set forth in rule 53ER13-46 F.A.C., 56Retailer Compensation, 58for a total ten percent sales commission on the value of each GROUPER play sold during the Promotional Period. A GROUPER play is valued at $6.00. Therefore, a retailer will earn a $.30 standard sales commission plus a $.30 bonus sales commission for a $.60 total sales commission per GROUPER play sold.
110(2) A GROUPER play is comprised of a $1.00 PICK 4121™ 122Straight/Box ticket, a $1.00 FANTASY 5128® 129ticket, a $1.00 FLORIDA LOTTO134® 135ticket, a $2.00 CASH4LIFE139® 140ticket and a FREE $1.00 LUCKY MONEY147™ 148ticket. If the Quick Pick numbers selected for the PICK 4 game have been cut off for the day due to the game’s liability limit being reached so that the PICK 4 ticket in the GROUPER play does not print, the purchase price of the transaction will be automatically adjusted, and the retailer will receive the otherwise applicable standard sales commission and bonus sales commission on only the remaining tickets in the GROUPER play, including the FREE $1.00 LUCKY MONEY228™ 229ticket.
230(3) The standard sales commissions will be reflected on the retailer’s weekly Settlement Report.
244(4) The bonus sales commissions will be reflected on the retailer’s weekly Settlement Report as an adjustment credit as follows: (1) following the end of the 2017-2018 fiscal year for bonus sales commissions earned June 11 through June 30, 2018, and (2) following the conclusion of the Promotional Period for bonus sales commissions earned July 1 through August 6, 2018.
304(5) Retailers whose Florida Lottery contracts are terminated or inactivated prior to payment of the GROUPER bonus sales commissions shall be paid the bonus sales commissions earned provided said termination or inactivation was not due to noncompliance with chapter 24, Florida Statutes, chapter 53, F.A.C., or terms of the retailer contract.
355(6) GROUPER bonus sales commissions will be considered compensation to a retailer and will be reported to the Internal Revenue Service by the Florida Lottery. The Florida Lottery reserves the right to apply bonus sales commissions earned against a retailer’s outstanding debt to the Florida Lottery, and to award the remaining balance of the bonus sales commissions, if any.
