53ER20. Emergency Rule For Year 2020 |
1(1) 2Beginning October 26, 2020 and continuing through January 4, 2021, (“Promotion Period”) the Florida Lottery will conduct the 20Holiday Bonus Play Promotion 24(“Promotion”) in which 27players can enter winning and non-winning FLORIDA LOTTO35® 36Draw Game tickets purchased during the Promotion Period (“qualifying FLORIDA LOTTO ticket”), and non-winning Florida Lottery Scratch-Off tickets (also known as instant tickets) from the following holiday games into a Holiday Bonus Play 69s70econd chance drawing for a chance to win a cash prize or gift card:
84(a) Game Number 1471, $10,000 HOLIDAY CASH;
92(b) Game Number 1472; NATIONAL LAMPOON’S CHRISTMAS VACATION100™
101(c) Game Number 1473, $1,000,000 MONEY TREE;
110(d) Game Number 1474, HOLIDAY CASH BLOWOUT; and
118(e) Game Number 1470, 200X THE CASH.
125Winning and non-winning FLORIDA LOTTO130® 131Draw Game tickets purchased during the Promotion Period, and non-winning Scratch-Off lottery tickets from 145the five above-listed Holiday Scratch-Off games may be entered throughout the entire Promotion Period for entry into the next available drawing. 166Winning Scratch-Off lottery tickets from the above-listed Holiday Scratch-Off games cannot be used for entry into a 183Holiday Bonus Play second chance drawing.
189(2) How to Enter.
193(a) 194A player may enter a winning or non-winning qualifying FLORIDA LOTTO 205Draw game ticket or a non-winning Holiday Scratch-Off lottery ticket on the Florida Lottery’s website at 221flalottery.com 222or using the Florida Lottery’s Mobile Convenience App (“App”)231. 232On the home page of the Florida Lottery’s website, players are to click on the 247Promotions 248banner, select the Holiday Bonus Play Promotion and follow the directions. Players will be prompted to log-in or register. On the App, players may click on either of the Promotions buttons, log-in, select the Holiday Bonus Play Promotion and follow the directions. A Promotions button is located on the main menu and also on the bottom navigation bar. 306A player may only create one account. Any attempt by a player to use more than one account by using multiple or different email addresses, identities, registrations, logins, or any other methods will subject the player and any associated entries to disqualification.
348(b) On the ticket entry page, players are to enter the entire FLORIDA LOTTO or Holiday Scratch-Off ticket serial number in the designated ticket entry area on the website or scan the ticket barcode using the App.
3851. For FLORIDA LOTTO Draw Game tickets, 392the 19-digit ticket serial number is located on the front of the ticket near the bottom. 408The ticket barcode is also located on the front of the ticket at the bottom.
4232. For Holiday Scratch-Off tickets, players are to scratch off the latex covering on the front of the ticket to reveal the 24-digit ticket serial number (4-digit game number and 20-digit ticket number) and the ticket barcode. The ticket serial number is located below the play area on the front of the ticket and the ticket barcode is also located on the front of the ticket.
489(c) 490Entry Determination. Each qualifying FLORIDA LOTTO Draw Game ticket and non-winning Holiday Scratch-Off lottery ticket is assigned a predetermined number of entries. A FLORIDA LOTTO ticket will receive five (5) entries, regardless of the total ticket purchase price. The number of entries for a Holiday Scratch-Off ticket corresponds to the price of the non-winning ticket, as shown in the table 550below.

605Each valid FLORIDA LOTTO Draw Game ticket and each valid non-winning Holiday Scratch-Off ticket number may only be scanned or entered one time and only into one drawing during the Promotion Period. Tickets should not be mailed to the Florida Lottery unless players are contacted by the Florida Lottery and requested to do so. Lottery 660tickets received in the mail by the Florida Lottery will not be entered into a drawing and will not be returned. 681The odds of winning depend on the number of entries entered. 692All entries are subject to validation by the Florida Lottery and may be disqualified if eligibility requirements are not met.
712(3) 713Promo Codes. Various promo codes will be available to players during the Promotion via social media platforms, websites, emails, commercials and TV touchpoints. A player may earn five (5) additional entries by entering a promo code at the time the player enters a qualifying FLORIDA LOTTO Draw Game ticket number or non-winning Holiday Scratch-Off ticket number into a drawing. 772A qualifying FLORIDA LOTTO Draw Game ticket number or a non-winning Holiday Scratch-Off ticket number must be entered to enable the promo code feature on the entry page, and the ticket number and the promo code must be entered at the same time815. Promo codes must be manually entered and cannot be scanned for entry. Each promo code is only valid for the corresponding entry period for which it is designated and can only be entered one time. However, more than one different promo code may be entered with a different qualifying FLORIDA LOTTO Draw Game ticket or a different non-winning Holiday Scratch-Off ticket number during the corresponding entry period for which it is designated.
888(4) Prizes. 890The following table sets forth the prizes available in the Promotion.

952(5) Drawings. A total of 957two drawings will be held. Prizewinners for each drawing will be randomly selected from entries submitted and received before midnight 977(978ET979) 980on the last day of the entry period for that drawing. The entry periods, drawing dates and winner announcement dates are set forth in the ta1006ble below. Drawings shall be held in Tallahassee, Florida, and witnessed by an accountant employed by an independent certified public accounting firm.

1064In 1065each of the drawings, a total of 418 valid entries will be drawn by the Florida Lottery using a certified random number generation process. The first valid entr1093y 1094drawn will win the top prize of $25,000. The second and third valid entries drawn will each win a second prize of $10,000. The fourth through the eighth valid entries drawn will each win a third prize of $5,000. The ninth through the eighteenth valid entries drawn will each win a fourth prize of $2,500. The nineteenth through the two hundred and sixty-eighth valid entries drawn will each win a fifth prize of a $1,000 The Home Depot1177® 1178gift card. The remaining entries drawn will be used in the order in which they were drawn and in the order of need to select an alternate top, second, third or fourth prize winner in the event a top, second, third or fourth prize cannot be awarded. Alternate entries will not be drawn or used for fifth prizes.
1236(6) Prizewinner Notification.
1239(a) The prizewinners in each second chance drawing will be posted on flalottery.com on the announcement date set forth in the table in subsection (5) above for the related drawing, or as soon thereafter as practicable.
1275(b) 1276The F1278lo1279r1280ida Lottery will attempt to notify each prizewinner by telep1290ho1291n1292e or email using the contact information provided in th1302e 1303prizewinner’s registration data 1306no later than one business day (Monday-Friday) after the prizewinners are posted on the Florida Lottery’s website. The Florida Lottery deems the winner’s registration data as the prizewinner’s official contact information, including the physical mailing address. The Florida Lottery will not attempt to further locate a prizewinner if the attempt to reach the winner by telephone or email is unsuccessful. 1366If the Florida Lottery is unable to have contact by telephone or email with a prizewinner within seven calendar days of the date the prizewinners are posted on the website, the winner will forfeit his or her right to claim the prize and the Florida Lottery will award the prize to an alternate prizewinner in accordance with subsection (5) above. For top, second, third and fourth prizes, 1433if the Florida Lottery is unable to have contact by email or telephone with the alternate prizewinner within seven calendar days of the date of notification, the alternate prizewinner will forfeit his or her right to claim the prize and the Florida Lottery will award the prize to the next alternate prizewinner. This process will continue until an alternate prizewinner is contacted or the Florida Lottery has exhausted the list of alternate prizewinners due to unsuccessful notification attempts or due to failure by a prizewinner or an alternate prizewinner to timely provide required claim documentation as set forth in subsection (7) below. If the Florida Lottery exhausts the list of alternate prizewinners, the prize will not be awarded.
1551(7) How to Claim a Prize. To claim any prize in a second chance drawing, the prizewinner must submit to the Florida Lottery a completed Winner Claim Form DOL 173-2, revised 2/18, or Spanish Winner Claim Form DOL 173-2S, revised 3/19 and a copy of acceptable identification. 1598Forms DOL 173-2 and DOL 173-2S are hereby incorporated by reference 1609and may be obtained at any Florida Lottery office or retailer, from the Florida Lottery’s website at flalottery.com, or by writing to: Florida Lottery, Customer Service, 250 Marriott Drive, Tallahassee, Florida 32399-4016. Acceptable identification is set forth in the rule of the Florida Lottery governing payment of prizes. A copy of the current prize payment rule can be obtained from the Florida Lottery, Office of the General Counsel, 250 Marriott Drive, Tallahassee, Florida 32399-4011. For all prizes, the required documentation must be received by any Florida Lottery office no later than fourteen calendar days after the Florida Lottery has made personal contact with the prizewinner. If the Florida Lottery has not received the required documentation from a prizewinner by the fourteenth calendar day after notification, the prizewinner will forfeit his or her right to claim the prize. For top, second, third and fourth prizes, the Florida Lottery will award the prize to an alternate prizewinner 1764in accordance with subsections (5) and (6) above. The same timeframe for a prizewinner to return required documentation to the Florida Lottery shall apply to an alternate prizewinner. 1792A prizewinner in this Promotion is not required to submit to the Florida Lottery the FLORIDA LOTTO Draw Game ticket or the Holiday Scratch-Off ticket that he or she used to generate an entry into the drawing in order to claim a prize.
1835(8) Award of Top Prizes. Upon 1841the Florida Lottery’s timely receipt of a top prize winner’s required documentation, the Lottery will award a top prize of $25,000, less applicable federal income tax withholding.
1869(9) Award of Second Prizes. 1874Upon 1875the Florida Lottery’s timely receipt of a second prize winner’s required documentation, the Lottery will award a second prize of $10,000, less applicable federal income tax withholding.
1903(10) 1904Award of Third Prizes. Upon 1909the Florida Lottery’s timely receipt of a third prize winner’s required documentation, the Lottery will award a third prize of $5,000.
1931(11) 1932Award of Fourth Prizes. Upon 1937the Florida Lottery’s timely receipt of a fourth prize winner’s required documentation, the Lottery will award a fourth prize of $2,500.
1959(12) 1960Award of Fifth Prizes. Upon 1965the Florida Lottery’s timely receipt of a fifth prize winner’s required documentation, the Lottery will award a fifth prize of a $1,000 The Home Depot Gift Card.
1993(13) Taxes. Except as specifically described herein, all federal, state and/or local taxes or other fees on the prizes won in the 2015Holiday 2016Bonus Play Promotion 2019will be the responsibility of the prizewinner. 2026Thirty percent federal income tax withholding will be withheld from any cash prize won by a nonresident alien prizewinner in the Promotion, regardless of the amount of the prize. For fifth prizes, a nonresident alien claimant will be required to pay the federal income withholding tax on the value of the prize or forfeit the prize. The reporting and subsequent payment of any additional federal, state and/or local taxes shall be the responsibility of the nonresident alien prizewinner.
2104(14) Other Restrictions and Provisions.
2109(a) All prizes are subject to the provisions of Chapter 24, F.S., and rules promulgated thereunder. Prizes shall be paid in accordance with the rule of the Florida Lottery governing payment of prizes. A copy of the current prize payment rule can be obtained from the Florida Lottery, Office of the General Counsel, 250 Marriott Drive, Tallahassee, Florida 32399-4011.
2168(b) Top, second, third and fourth prizewinners will be analyzed for state-owed debt. If a prizewinner is identified as owing an outstanding debt to any state agency or owes child support collected through a court, the debt will be offset in accordance with Section 221224.115(4), F.S. 2214If the debt is an amount less than the amount of the prize, the balance of the prize after deduction of the debt shall be awarded. If the debt is an amount greater than the amount of the prize, the entire prize amount will be applied to the outstanding debt.
2264(c) Players must be at least 18 years of age. Persons prohibited by Section 227824.116, F.S., 2280from purchasing a Florida Lottery ticket are not eligible to enter the Holiday Bonus Play Promotion.
2296(d) By entering the 2300Holiday Bonus Play Promotion, 2304a player gives his or her permission for the Florida Lottery to photograph and/or videotape and record the prizewinner with or without prior notification and to use the name, photograph, videotape, and/or recording of the prizewinner for advertising or publicity purposes without additional compensation.
