  • 1For the purposes of this chapter, the following terms are defined as follows:

    14(1) “Agriculture” is as defined in Section 21570.02(1), F.S.

    23(2) “Agricultural Cooperative” means 27an established organization 30where 31farmers 32pool their resources in certain areas.

    38(3) “Agricultural Lands” means lands on which Agriculture is conducted.

    48(4) 49“Aquifer Recharge Areas” means regions that provide water to an aquifer that is critical to springs, sinks, lakes, rivers, other natural systems, or water supply.

    74(5) “Baseline Documentation Report” means a report used for long term Perpetual Easement monitoring that documents existing land conditions at the time of execution of the easement.

    101(6) “Best Management Practices” or “BMPs” means a practice or combination of practices established by rule of the Department, based on research, field-testing, and expert review, to be the most effective and practicable on-location means, including economic and technological considerations, of protecting environmental values.

    145(7) “Board” or “Board of Trustees” means the Board of Trustees of the Internal Improvement Trust Fund of the State of Florida.

    167(8) “Commissioner” means the Florida Commissioner of Agriculture.

    175(9) “Council” means the Acquisition and Restoration Council, pursuant to Section 186259.035, F.S.

    188(10) “Department” means the Department of Agriculture and Consumer Services.

    198(11) “Division” means the Florida Forest Service in the Department of Agriculture and Consumer Services.

    213(12) 214“Natural Floodplain” means Federal Emergency Management Agency (FEMA) “special flood hazard areas (SFHA)” associated with major rivers. In counties where no FEMA data is available, the Natural Floodplain is estimated based on water management district landcover data, landsat data, and National Wetlands Inventory data.

    258(13) “Outparcel” means land within the boundaries of a parcel which is not owned or under the control of the parent tract owner or is intended to be excluded from the Project by the parent tract owner.

    295(14) “Perpetual Easement” means a conservation easement as defined in Section 306570.71(2)(a), F.S., 308or a rural lands protection easement as defined in Section 318570.71(3), F.S.

    320(15) “Program” means the Rural and Family Lands Protection Program (RFLPP).

    331(16) “Project” means the proposed acquisition of a Perpetual Easement as provided for in Section 346570.71, F.S.

    348(17) “Significant Natural Areas” as contained in Section 356570.71(1)(c), F.S., 358means areas of relatively undisturbed land or water features that promote healthy functioning habitats important to native plant and wildlife species and hydrology.

    381(18) “Species Habitat” means an environment consisting of an assemblage of plants, animals, soils, and associated processes that provide a plant or animal with its physical and chemical requirements.

    410(19) “Supplemental Standards” means the Supplemental Appraisal Standards for Board of Trustees Land, 423which contains 425appraisal requirements that establish public policy and add to the standard appraisal procedures and practices of the appraisal profession for the development and reporting of all appraisal services, including those outlined in Chapters 253 and 570, F.S., and in accordance with subsection 46718-1.002(23), 468F.A.C.

    469(20) “Uniform Standards of Professional Appraisal Practices (USPAP)” means the generally accepted and recognized standards of real property appraisal practice in the United States promulgated by the Appraisal Foundation and used by state and federal agencies and others, which is incorporated by reference in Rule 51461J1-9.001, 515F.A.C.

    516(21) “Water Resources” means water bodies, Aquifer Recharge Areas, aquifers, wetlands, and watersheds.
